Fairhope Civic Center, 161 N. Section Street
Present: Vice -Chairman Richard Sanderson, members Tim Kant,
William Lucey, Cindy McBrearty, Cecil Pitman, David Bishop
The minutes of the June I, 1987 meeting were approved on motion by William
Lucey, seconded by Tim Kant and unanimously carried. The minutes of
the June 16, 1987 special meeting were approved on motion by Cindy
McBrearty, seconded by David Bishop and unanimously carried.
Flying Creek Estates preliminary application was presented by Ack Moore
Ack pointed out that this was going to be a privately maintained subdivision
South of Parker Road. Bob's comment were asked for and he said
that he had problem with the two roads planned and asked if possible
to have Salee Drive continue instead of changing name once road gets
around the curve. Ack said they would check into that and see if Dr.
Booth would agree. He further pointed out that the property owners
had to sign an agreement to maintain the roads, that they needed at least
one more fire hydrant, we needed restrictive covenants and some more
information on the road centerlines and somebench mark datum information.
Ack said he was agreeable to all points Bob made. Bill Workman a property
owner adjacent to the planned subdivision stated that he was not opposed to
the planned subdivison. He noted that there is a lot of slope on portion of
lots going to Fly Creek, could we possible consider having some permanent
easement where portions could not be built on. Further he was questioning
whether this development would increase the flashiness of Fly Creek and
could we have a green belt established between the two subdivisions. Ack
said the green belt was already a part of plan. Ack pointed out on map
where more than likely the houses would start being built at elevation 20 or
above. Bob remarked that we are charged with ADEM & FEMA's codes. Mr
Workman called out attention to the fact that there is a 70 foot drop from Parkes
Road to Fly Creek and that he hoped that some provision would be made to
prevent erosion control on the temporary road construction. Mr. Sanderson
thanked Mr. Workman for his points and said only thing Planning Commission
could do was approve subdivision plans, that the County had say so on the
roads, that we can alert the County Engineer on the possible problems.
William Lucey moved, subject to all Bob's points being adhered to, and to
notification made to County Engineer on roads, approvel of preliminary plan
be granted, Cindy McBrearty seconded. Cecil asked if a possible turnaround
could be installed at lot 19, Ack said he would check into this. Motion
was voted on and carried unanimously.
In informal discussion, the Commission had a request from Mrs. Davis and Mrs.
Winberg who were here to discuss the possibility of extending(by dedication
to the City as a road) a 50 feet strip running thru their properties thereby
creating frontage for four parcels in their adjacent lots. Mrs. Conlee spoke
saying they were trying to seek a way to divide so land can be used for con-
struction. Under the subdivision regulations they are required to pave this
50 foot strip but Mr. Troup has had his open since 1972 and still not
paved. Under comments the Commission informed them that they would hope
that Mrs. Davis and Winberg some time in the near future would seek paving
under an assessment program but that did not want to hold them up from using
their land. Bob poi nted out that mere dedication did not necessarily mean
that the City would accept maintenance. Mrs. Davis told the members that
the Troup's had shells on their part and they would probably do this also.
The property which extends from Mobile Bay eastward to 300 feet west of
Gayfer Court has as the only practicable public access southward
from Grand Avenue via the southerly extension of north Mobile A\,enue
through Airey Heights and the Alan Troup property. There is a right-of-
way width of 30 feet thru Airey Heights widening to 50 feet thru the Troup
property. No formal action was required, Mr. Sanderson suggested they
proceed with comments given here today as guidance.
Mr. Sanderson recognized Ms. Haynes, of Tonsmeire Develor.ment Co. who
was trying to subdivide the Gaston leasehold. Since all of capers were not
in order she was told if and when she satisfies- Mr. Lunsforu—.As to requirements
if necessary we could call special meeting to expedite transaction.
There being no further business, meeting was duly adjourned.
