1987 at 5:00 p.m. at the City Administration Building, 161 N. Section
Street.
Present: Chairman Maxwell Killoch, members Cecil Pitman, Tim Kant,
James P. Nix, Cindy McBrearty, William Lucey, Richard Sanderson
Jeanette Puckett
The minutes of the April 6, 1987 meeting were approved as written
by Richard Sanderson, seconded by William Lucey and unanimously
carried.
The public hearing on the amendments to the Zoning Ordinance
under Article V- Sections 5.21.1, 5.31.1, 5.411, 5.412, 5.422,
5.451, 5.513, and Article Viii Section 8.10 were considered by
the commission. The Chairman called for any comments from
the audience. There were none. Richard Sanderson moved
to recommend approval of changes to the City Council for
action. Cecil Pitman seconded and motion carried unanimously.
Corte Office Park, final approval was being sought. Ack Moore
was present to represent this application. Bob's comments were
noted. He had reported that the conditions of preliminary approval
had been satisfied. He recommended final approval subject to
posting of financial guaranty assuring installation of streets and
utilities, screening of residential areas and landscaping of green
belt, to include the storm water retention area. James P. Nix moved
to recommend approval subject to the points Bob made,Cecil Pitman
seconded and motion carried unanimously.
Final plat approval was also being sought for Covered Bridge Estates
Unit V. Mr. Moore was representing Mr. Pope. Bob had pointed out
that preliminary master plan of Covered Bridge Estates established
that limits of rear yards shall be fixed by prescribed measurement
from inner boundary of sloughing easement 15 ft. from top of bluff
of gully. Plat presented needed to be revised to show this. Also,
street grades shown needed to be flatter at temporary turn arounds,
Jack Pope was present and said that would not be a problem, the
other thing pointed out was the streets and utilities, which are a
part of the 1987 street improvement program, so therefore final
approval was recommended. James P. Nix moved subject to these
points approval be given, William Lucey seconded and motion carried
unanimousy.
Shore Village subdivision had requested to be brought up again before
the commission for consideration. Ack Moore asked at this time to with-
draw application. He said he had contacted the County Commission
about installing pipe on Molokai Lane and request had been denied.
He was going to monitor water, but we have not had enough rain, so
he just wished to withdraw at this time. James P. Nix moved to
allow him to withdraw application at this time, William Lucey seconded
and motion carried unanimously.
Under new business, Bob brought up a request from Matt Dial for
release of lot 15 of Huntlee subdivision. He reported that lot 15 & 2
fronts on Hwy 27 therefore no improvements would be necessary.
That there is a buyer for lot 15 and a building permit for dwelling
for this lot prior to end of May, that no special assessments lien
would be necessary as there is no abutting frontage. Further that
he recommended release so this could be sold. William Lucey moved
to allow release as requested, Jeanette Puckett seconded and motion
carried unanimously.

Bob had two more requests he was making under the Attorney
General's Opinion No. 81-00128 rendered 09- December. 1980:
One being a request on Faye L'Orange leasehold of FSTC 207 Magnolia
Street , conditioned on lease being capable of division wishes to construct
his own dwelling on half of leasehold and to transfer remaining half
as a dwelling site to another party(B-3b district -R-3 restrictions)
And second one a request for FSTC property , nine acre tract leased
by Oliver M. Rockwell on Highway 48(Fairhope Ave and Oberg Rd)
to be divided into two lots leasing half to Mabry Stone.
William Lucey moved to approvethe request of Ms. L'Orange leasehold
being divided, Tim Kant seconded, motion carried unanimously.
James P. Nix moved to approve request on Rockwell division of property,
Cindy McBrearty seconded and motion carried unanimously.
At this time Robert Adger addressed the Commission saying he was
a property owner that would be affected by the Shore Village subdivision
and that they could not handle any more water than what they are getting
now. Billy Delaney also spoke saying he owned land next to Molokai Lane
and that he thought he should have been notified about meeting. He
was informed that adjacent property owners to the subdivision were
only people required to be notified.
There being no further business, meeting was duly adjourned.
