at a special meeting Thursday, November 13, 1986 at 5:00 p.m.
to hear the continuation of preliminary application of Harold
Thompson, el al, for South Moseley Meadows subdivision.
Present: Maxwell Killoch, Chairman; members Richard Sanderson,
Cindy McBrearty, Tim Kant and William Lucey
Mr. Claude Arnold spoke on ,behalf of Mr. Thompson. Mr. Arnold read
it a letter- from Mr. Percy Nixon, County Engineer which he says that the
proposed street plan for the subject subdivision is in accord with County
requirements and the County does plan in the near future to increase
the capacity of the culvert presently running under Moseley Road.
Mr. Arnold went on to say that since the last meeting he has made a drainage
study of the half section where the subdivision is located, and he has
recommended to Mr. Nixon another drainage structure be installed under
Moseley Road. He has also attached to the plans presented a statement saying
that the property downstream will not be unduly affected by this subdivision.
That they have followed the requirements as set out under the subdivision
regulations, and they plan to follow the County regulations as the County
II will have to maintain the roads. Edith Calloway spoke asking if we were
going to get a second engineer's opinion. She was informed that Mr. Nixon
was in fact an engineer and that his letter said the design was adequate.
Mrs. Calloway said they were not against the development, but just
wanted to know it would be done right and that there would not be any ,
added drainage problems. Julie lovelock spoke saying that the way it ,
looked to her there would be increased runoff on their property from
the subdivision. Mr. Arnold assured her there would not be any more.
She asked about the setback requirements, there are none required, but
if Mr. Thompson has restrictive covenants setback requirements would
be covered in that. Doreen Warner asked if approval will come
if the subdivision regulations met and the County gives approval. She
was told yes. Mr. Arnold said he had re-routed the drainage off of
Mr. Lovelock's property, Mr. Dean's and Mr. Byrd's and deflected it over
onto Mr. Thompson's property which would decrease the runoff on Lovelock,
and the paved street will runoff onto Mr. Thompson's property. He said
that they were going to install a 30" culvert when all that was needed was
an 18" but they were trying to think of what's down the road. He related
the subdivision of the 7 lots in 1978, which he has discovered was done
illegally, but was told at that time that the City had no interest in this
being done. He was asking approval on 7 lots already divided, the 20 ft
strip along Lovelock's property with another 10 ft added, for a utility ease-
ment. He said that Mr. Thompson would have restrictive covenants, and
probably a 30 ft. setback line on the lots which would be comparable to R-2
Bob recommended preliminary approval on the 20 lots shown, but not on 7
li already divided as Mr. Thompson is having problems getting signatures
on the plat, until such time as the seven owners enter into the subdivision
by signing the plat. If they don't, consult with the City Attorney as to what
I, action to take on this property. Mr. Lucey related he had talked with Mrs.
Byrd and they would go along with what proposed. Mr. Arnold said
Mr. Thompson had tried to correct the problems, the only requirement
would be to have the 7 owners sign and have the plat corrected. Jack
Lucey moved to give preliminary approval on 20 lots, Tim 2nd, motion
carried unanimously. Tim Kant moved that the 7 owners be able to meet
within the next 60 days and determine what they would do, Jack Lucey
seconded and motion carried unanimously, if nothing done in that time then
(, we consult the City Attorney as to action to take.
Cindy asked that we set a date for a study session to talk about sign
ordinance and then possibly meet with the owners of the 2 shopping centers
to see if we could talk them out of pylon signs. Bob reminded the Commission
that he did bring both shopping centers to them in study session asking about
signs and landscaping. A study session was set for Tuesday at 5:00 p.m.
There being no further business, meeting was duly adjourned.
