HomeMy WebLinkAbout08-15-2016 Board of Adjustments MinutesThe City of Fairhope Board of Adjustments and Appeals met on Monday, August 15, 2016 at 5:00 PM in the City Council Chambers at the City Administration Building, located at 161 N. Section Street. Members Present: Anil Vira, Vice-Chair; Dick Schneider; Troy Strunk; John Avent; Jonathan Smith, Director of Planning and Zoning; Emily Boyett, Secretary. Absent: Chairperson Cathy Slagle The meeting was called to order at 5:00 PM by Vice-Chairperson Vira. The minutes of the June 20, 2016 meeting were considered. Dick Schneider moved to accept the minutes as written and was 2nd by John Avent. Motion carried unanimously. BOA 16.06 Request of Fairhope Point Clear Rotary Youth Club for a Special Exception for a Daycare for property located at 19128 Young Street. Jonathan Smith, Director of Planning and Zoning came forward and gave the staff report. STAFF INTERPRETATION: The subject property is located in the City of Fairhope and is zoned R-1 Low Density Single Family Residential District. The Fairhope Point Clear Rotary Youth Club is seeking a Special Exception for a Daycare (Pre-K program). In the R-1 district, as well as all zoning districts where a Daycare could possibly be allowed, a Special Exception is required. Table 3-1: Use Table states the use is allowed “only on appeal and subject to special conditions.” The subject property has been the site of extracurricular and after-school activities since December 1996. The Fairhope Point Clear Rotary Youth Club has been in operation at the subject property since May 2009. The subject property is bordered to the north, east, and south by unzoned County property. It is bordered to the west by R-1 and unzoned properties. STAFF RECOMMENDATION: Staff recommends the Board approve the proposed Special Exception for the subject property. Mr. Smith added this approval is needed in order to obtain a State license to add a Pre-K program at the facility. Skipper Tonsmeire address the Board saying this program has been an asset to the City for 25 years. He stated the summer program has an enrollment of 160 children and 105 in after-school care. He explained this approval will allow the facility to start a Pre-K program for the 4 year olds in the area which the Baldwin County Board of Education can’t accommodate. Mr. Schneider commended the Fairhope Point Clear Rotary Youth Club for their service to the community. Mr. Vira opened the public hearing. Having no one present to speak, he closed the public hearing. Dick Schneider made a motion to accept the staff recommendation to approve the proposed Special Exception for the subject property to allow a Daycare. Troy Strunk 2nd the motion and the motion carried unanimously. Having no further business, Dick Schneider made a motion to adjourn. Troy Strunk 2nd the motion and the motion carried unanimously. The meeting was adjourned at 5:06 PM.
