HomeMy WebLinkAbout06-02-1986 Regular MeetingThe Planning & Zoning Commission of the City of Fairhope met June 2, 1986 at 5:00 p.m. at the City Administration Building 161 N. Section St. Present: Chairman Maxwell Killoch; members Mary Doug Foreman, Cindy McBrearty, James Nix, Cecil Pitman, Richard Sanderson, William Lucey, Barney Shull The minutes of the May meeting were approved as written on motion by James P. Nix, seconded by Barney Shull. Mr. Killoch acknowledged receipt of letter from John Friend requesting review all subdivision plans proposed for the historical development districts within our jurisdiction. Mr. Killoch remarked that he would advise him that he has access thru the newspaper notices and meetings. He also acknowledged the letter from the homeowners on Vo lanta opposed to the Marina and their request for a traffic study in this area. The public hearing on the Glen Ingersoll property re -zone request was held. Mr. Ingersoll was requesting a zone change from R-4 to B-4. Larry Chason spoke to the Commission members saying that he wished to build a office complex on this site. He showed a drawing to Commission members. Mr. Killoch called for comments from the audience. Mr. Dave Beaudoin who lives on Washington Dr. spoke saying he was concerned about spot zoning. Mr. Cruickshank who lives on Edwards St. spoke saying he had a real bad probelm when we had a heavy rain and he questions what will happen when this is built, will it continue to runoff on him. Larry Chason introduced Wm. Bridges of Rester & Coleman who spoke saying he was hired to do drainage plan of proposed project. He said that they are required to do complete well thought out plan and what is proposed will offer no more runoff than there is now, actually it will reduce it. James Darrow said he is against Greeno Road being changed to business. George Weems spoke saying it seems we fight this battle every few months. Cindy spoke saying that time and time again the Greeno Rd property owners apply for business and say that it is not useable as residential but look at Colonial Acres it accesses Greeno Road and there was no trouble selling those houses, maybe used as R-4 or R-5. Several people spoke saying they would not want multi- family housing next to them, would prefer office complex. Dorothy Weems spoke saying she lived in Colonial Acres but traffic from Richmond Square was entirely too much now. Larry spoke again saying Mr. Ingersoll deserves consideration for his request as much as anyone else. Mr. Lucey said he would like the drainage looked at seriously, maybe get more than one opinion. Mr. Killoch said that this would be the beginning of Greeno Road going commercial and he is against it, this would open the door. Cindy remarked that it is zoned R-4 now. Mayor Nix said he is totally opposed to the rezoning of Greeno Road. That he is not opposed to Mr. Ingersoll's application and sorry he got caught up in the middle of this, as he can see what he is trying to do and R-4 to B-4 is a good transition, but this has got to stop somewhere. Mark Weisener spoke saying if the drainage is improved, not run water any more than now but better by 3 CFS might be all right but not go further than this property. Carl Gallagher spoke saying he lives in Richmond Circle and this is "spot zoning" that we have a problem with Greeno Road and we need to face up to the problem, that we have enough businesses uptown going to pot without add inq new ones. It was brought out that the City is required to study these plans to see that the drainage plans are in order. Mr. Killoch said this counteracts the fundamental plan that we have been working on for a year now, and has been adopted for only 3 months, how can we stop the rest of the people(Greeno Rd residents 1. Mr. killoch further moved for denial of rezone. Mr. Sanderson 2nd. Larry brought out that Mr. Ingersoll was told this was correct step to take when comprehensive plan was still being considered. Mr. Pitman said he did not believe B-4 was good for this neiqhborhood. Barney spoke saying Greeno Rd had been a sore spot for a number of years and it is obviously easier to get a commercial developer than residential, that Greeno Road should be carefully considered, that we have studied comprehensive plan for a _year and that he personally favors "transitional"utilization of props ty, that we n�-have-our-plan-in-place MMr.-Luce_y_emphasi.z.ed7that we had public hearings arid. -all was advertised before the comprehensive plan was -finally adopted.�Mr: Killoch said we had "the survey and results showed most considered residential for this area. Mr. Killoch's motion was acted on and was denied as vote was 3 for denial and 5 against. James P. Nix moved that this be forwarded on to the City Council for recommendation of re -zone to B-4 with the understanding that unless it is property directly across street needing rezoning, this is it, we are drawing the line and he is going on record against further re -zoning on Greeno Road, that we have studied for over lea he comprehensive plan and it is a good plan, stick by it. Barney Shull seconded, motion carried unanimously. The Commission accepted for public hearing at the next regular meeting a re -zone request for Wayne Kahlbau from R-1 to R-3PGH property at the Southwest corner of Colonial Acres. The next item on the Agenda was eleven re -zone applications from property owners on Greeno Road. Mayor Nix remarked that if these passed it would virtually change the character of Greeno Road. That we are bound to hear it but suggest we hold off on advertising until we have a referendum on it to get public's 'view. Larry Chason spoke saying that these applications have been made several times by each owner over the years and that he feels that the Mayor has an excellent idea but would request it be tabled until a decision could be reached about this. Barney Shull moved that application be tabled, Max Killoch seconded and motion carried unanimously. Bill Eadie of McCrory & Williams presented a sketch plan of a subdivision across from the Middle School on the South side of Fairhope Avenue containing 46 lots. Bob's comments were sought and he said that he would recommend that instead of cul-de-sac shown that a temporary turnaround be put there with easement running all the way to the West property line so that there would be a , way to extend the street in the future. That this is only informal discussion, but plan is good. Cindy said that there would be a number of young families probably locating in this area that we need to think about how we would handle their crossing Fairhope Avenue to get to school. James P. Nix moved that sketch plan be okeyed with Bob's recommended changes made. Cindy McBrearty seconded and motion carried unanimously. 5'/p Bill McCrory brought the Commission a revised sketch plan of Ecor Rouge Estates. It showed the road being moved to the South side of the property. Same number of lots(6) and they believe they could develop without any variances being needed . The question of whether or not the residents in the area had seen this as they were the ones opposed when it was brought up last time was discussed. Mr. Killoch said he thought it best to hold over action until they saw it and bring back for preliminary approval at next meeting. Bob said they would have to conform to all requirements(15000 sq ft lots, Health Dept requirements, and drainage, street grades & plan w/public right of way) JP Nix moved plan acceptable Wm. Lucey seconded and motion carried unanimously. Cindy McBrearty said she would like a second opinion on drainage plans, would Mr. McCrory object. He indicated he would not. Dick Sanderson mentioned Bob's plea for cooperation applications and seeking support from Commission o if submitted after cut-off date. All said they would on people not completing n his refusal of same stand with him on this. There being no futher business, meeting was duly adjourned.
