May 5, 1986 at 5:00 p.m. in the City Council Chambers, Municipal
Complex, 161 N. Section Street Fairhope, Alabama.
Present: Maxwell Killoch, Chairman; members Tim Kant
James P. Nix, Jack Lucey, Cindy McBrearty
The minutes of the April 7 meeting were approved on motion
by J.P. Nix, seconded by Jack Lucey. The minutes of the April 28
meeting were approved with secretary noting in minutes Mrs. McBrearty
asking the Corte family what assurance we had that they would not
build fast food place on the highway since they were not zoning. With
Cortes replying that they had agreement with the City that would protect
this area. Motion to approve by J.P. Nix seconded by Tim Kant.
The Commission

at the next regularly
scheduled meeting
a re -zone request by Mr.
Glen Ingersoll from
R-4 to B-4 his
property
fronting on Greeno
Road & Edwards Avenue.
This change is
requested
for use in establishing professional offices.
Motion made by
J.P. Nix
seconded by Cindy
McBrearty.
A public hearing was held on a re -zone request of Mr. Chester Hunt
for his property located at 415 Young Street from R-1 Low Density
Single Family to R-5 High Density Dwelling Residential. The Chairman
asked Bob for his comments. He remarked-ahat this had apparently
come into the ci ty as R-1 zoning in 1977, that he now has use for
it other than what zoned originally. There was no one present to
speak against change. Jack Lucey moved to recommend zone change
to City Council as requesledTim Kant seconded and motion carried unanimous
A public hearing was held on R-2 zoning concurrent with annexation for
South Rolling Oaks subdivision property of Jack Glover, property off
Bishop Road. A 19 lot subdivision. Mr. Robert Orr spoke to the Commissior
regarding the proposed R.O.W. between lots 3 & 4 to the North. He
asked if there was going to be access to this property in the future. That
he had heard that the property owner to the North wanted to put up
multi -family housing and Mr. Glover had agreed to provide an access.
Bob said the plat had not been finalized, preliminary only submitted.
Les Stejskal spoke saying he had also heard that apartments planned
for out there and that they own land abutting and don't want apartments,
also commented on property line dispute. Bob said this was outside
the city limits and we have no control over apartments going in there
if the owner wishes to do this. Les asked if, it wasn't the responsibility
of the Commission to judge boundaries correct. Bob responded we had
survey saying what presented is correct, that dispute is between Stejskal
and Glover. Mr. John Glover was present and said that he could speak
for Jack and that he knew nothing was planned for this area but single
family residences. Mr. Orr spoke again saying if this access is cut
through it would only lead to a congested mess. The Mayor pointed
out that they do not have to come into the City but by coming in
we have c ontrol, He encouraged Mr. Glover to have this R.O.W. deleted
from any future plans and have the boundary dispute settled before coming
back for final approval. Mr. Lucey moved to recommend this to City Co unci
with Commission recommendation that ROW be removed, Tim Kant seconded
and motion carried unanimously.
Bob brought to the Commission's attention a plat of a two lot subdivision
Seaview, located West of County Road II and requested approval of filing
a corrected plat to clear up the title on same. J.P. Nix moved, seconded
by Cindy McBrearty and unanimously carried.
There being no further business meeting was duly adjourned.
