a public hearing to consider property of the Corte family for annexation
land surrounding the golf course development. at 4:30 p.m.
Present: James P. Nix, Cindy McBrearty, Mary Doug Foreman
Cecil Pitman, Tim Kant, Jack Lucey and Barney Shull
Mayor Nix opened the meeting explaining that Mr. Killoch the Chairman
was sick and the purpose of the meeting was to consider some 500 acres
of land for zoning around the proposed golf course development. He
asked Bob Lunsford to explain to the audience what the Corte family
was requesting . Bob pointed out that they had requested R3 High Density
Single Family, R-4 Low Density Multi -Family Residential, and R-5 High -
Density Multi -Family Residential. There was a large map at the front
of the room showing the areas delineated with each zone requested.
Mr. Bill Moore, an attorney for the Corte family, spoke saying that
the reason this zoning was requested was for a matter of flexibility.
That they hoped to end up with more zoning single-family than shown
but it is easier to ask for these zones up front than make a re -zone
request down the line. Mr. Nix asked for questions from the audience.
Mr. Darrow asked about the area on the map not marked. Mr. Nix
remarked that this area is outside the City Limits and the Corte family
is not requesting annexation nor zoning for this area. 'Tom Simonsis
spoke saying that if it is not being annexed into the city, in his opinion
this could be bad. David. Beaudoin spoke asking if we didn't have subdivision
control 5 miles outside the city limits. Mr. Nix responded subdivision
control, yes. Not zoning. Ed Avery asked Bob to explain where the
City Limits came to on map. He did. The Mayor explained the annexation
process(where property is contiguous or request made through the legislature) .
That other than the area proposed to be in City we had no control over
what they put there. Mr. Beaudoin said he was worried about disordered
growth. Like what had happened in the Lake Forest area along the highway.
Dr. H.C. Mullins addressed the Commission and asked that his letter be
read and the 15 names on his petition be noted as asking for single family i
residences adjacent to their land off Parker Road(letter in file) . He
remarked he was afraid of the traffic volume and people resulting in multi-
family development. That all have single family residents there now.
He said that this was changed in the last six weeks. That the original
concept he had seen showed zoning in this area. Mr. Moore explained
the original concept was done by another qoup of developers and not
the Corte family. The Mayor said the Planning & Zoning Commission
was also concerned about this area. Dr. Mullins said he thought the City
should decide what he is giving up not give pup a key part of zoning
in Fairhope. Ed Fenton spoke saying knowing the Corte family that they
would develop the best possible that could be afforded. Jim Tull spoke
saying that he subscribed to the golf course and what shown now is
a fundamental change from the original plan he was shown, that it is
a lot more multi -family. Dick Vanderwood spoke saying he had looked
at the new Malbis golf course and that he hoped that the Cortes realized
that if the golf course wasn't built the development wouldn't fly. Mrs.
Greenbury asked why the Corte family would not annex this land.
Mr. Moore responded that historically surveys over the country show that
land along highways is not good for single family residence. That they
would develop professional offices along this land, Mrs. McBreary questioned
how we would have a guarantee that this is what developed. Mr. Moom said this
controlled by a written agreement between the Corte's and the City of Fairhope.
If they do first class subdivision, why would they want to mess it up along
the highway. Mr. Bonnell asked how many access roads planned(l) .
Jerry Schaff spoke saying it was inconceivable they would allow anything
junky when they would be trying to sell subdivision right behind it.
Dorothy Williams spoke saying that we certainly should not spoil the beautiful
entrance to Fairhope. Dan Hamilton pointed out that it is not zoned now and
they could do anything they wanted to with land. No one else wished to spea',k.
At this time Jack Lucey moved to approve proposal as presented and forward
on to City Council with recommendation of approval. Motion carried unanimous
