April 7, 1986 at 5:00 p.m. at the City Municipal Complex.
Present: Maxwell Killoch, Chairman; members Mary Doug
Foreman, Cindy McBrearty, Cecil Pitman, T'im Kant, James P. Nix,
William Lucey, Barney Shull '
The minutes of the March 5, 1986 meeting were considered and
approved as written on motion by William Lucey, seconded by
Barney Shull and unanimously carried.
The Board considered an application for re -zoning from Chester
Hunt for his property located at 415 Young St. from R-I Single
Family to R-5 High Density Multi -Family Residential. Bob Lunsford
recommended acceptance for public hearing at next regular meeting.
James P. Nix moved, seconded by Barney Shull to hear at next meeting.
Motion carried unanimously.
The Commission accepted for public hearing at the next regular
meeting a request for zoning R-2 Medium Density Single Family
zoning of property at Bishop and Dyer Roads known as South
Rolling Oaks S/D concurrent with annexation of property in
its entirety. Cindy McBrearty moved, with Tim Kant second,
motion carried unanimoulsy.
Ecor Rouge S/D was discussed. This is a 9 lot subdivision,
owners Richard Vaianzano(lots 1-6) and W.B. LaNicca(lots 7-9) .
Bob had commented even with privately maintained streets(Sec.
405.1 of S/D regulations) lot 9 required additional area
to meet health department requirements, requiring reduction
of area in lots 7 8 8 to 24,000 sq ft, which required a variance.
Other variance needed was on grade where it exceeded 7% on topo.
They needed approval of covenants for street maintenance by City
Attorney and notation on plat that the streets will be privately
maintained and indication of the recording index for covenants.
Mr. McCrory addressed commission stating that drainage would
be handled with storm water detention on Lot 4, where the
gulley normally runs thru, that it would have to be filled and
that they could retain the water by installing 18" pipe. The
road would be paved w/inverted crown. At this time several
property owners from Ecor Rouge spoke. Dr. Ingersoll asking
why not notified. (only contiguous property owners are required
to be notified) That they were under the impression that there
were restrictive covenants for this area although they have not had
time to find them. Jack Thomas spoke saying his biggest concern
was drainage. That in the 18" rain in '78 he had spent $25,000.
Dr. Hamilton re -iterated this concern. A Mrs. Wallace spoke saying
she wished we could postpone it until the people in the area had time
to take a better look and see how the drainage was going to be handled
Cindy also said she thought it would be better to hold this over. Tim
Kant put in the form of a motion holding this over so we could study
drainage and have property owners do same. Barney Shull seconded
and motion carried unanimously. Mr. McCrory asked if there was
anything else the commission wished him to submit and said he would
be glad to do so.
Shore Village S/D/ was brought before the Commission for discussion.
This is a 12 lot s/d located off Nelson Rd East of Hwy. 98 at Battles
Wharf.Ack Moore spoke to the Commission'on behalf of the owners.
He said lot I -A on the map was to be used as a detention pond
with lot 1-6 emptying into I -A. R-3 zoning was to be used in subdivsion
but it is outside City Limits.

Mr. Beard of Paddock Estates addressed the Commission. He
said that the water when it rained real hard ran across the
SW corner of his lot and could really be a big problem for
this subdivision unless it is designed right. He said he
would be derelict in his duty if he did not point this out.
Ack said he designed for an 8" rainfall. Bob's recommendations
were recommend preliminary approval subject to owner's
certificate, lienholders certificate, endorsement of health dept. 8 cty. engir
Mr. Thomas also spoke to Commission. He is adjacent property
owner and asked if the development will increase runoff on
his property, if not he can live with it as it is now. Bob asked
if we should ask the developer to design to deal with water from
Summit Street running all the way to Paddock Estates to site. This
is issue. Barney said that they could build a house and raise the
site which would run water back to Mr. Thomas. Cindy said
that this could be covered in the restrictive covenants, that it
should state that land could not be built up to run back to the
North. Bob stated Mr. Moore had designed to handle the run-off
from the site. Mr. Moore said he had actually overdesigned with
the detention pond. Bob recommended preliminary approval
based on the four points mentioned above. Barney Shull
moved for preliminary approval, Tim Kant seconded and motion
carried unanimously.
The item on the agenda regarding G.R. Irvine/Julio Corte, Jr.
was withdrawn this time.
The question was raised as to when was final action initiated on
a zoning application, when the 12 month period began.- All
agreed final action was when acted on by Council or application'
withdrawn. William Lucey put this in the form of a motion, Tim
Kant seconded and motion passed unanimously.
The Commission set a public hearing date of April 28, 1986, 4:30 p.m.
to hold a public hearing on motion by James P. Nix, seconded by
William Lucey, hearing to establish zoning concurrent with annexation
on the golf course property and surrounding area.
There being no further business, meeting was duly adjourned.
