a public hearing January 28, 1986 at 5:00 p.m. in the City
Council Chamber at the City Administration Building, 161 N.
Section Street, Fairhope, Al.
Present: Cindy �McBrearty, Mary Doug Foreman, Cecil Pitman
James P. Nix, Tim Kant, Maxwell Killoch, Barney_ Shull
Bob Lunsford and Tommie Werneth, Consultant
Mayor Nix opened the meeting, welcoming everyone to the public
hearing he then asked all to join with him in a minute of silent
prayer in remembrance of the Challenger crew that was lost
due to the explosion this morning. After this he announced
that Mr. White had resigned and the floor was open for nominations
for the position of Chairman. Cindy McBrearty moved to nominate
Maxwell Killoch, Cecil Pitman seconded, Mavor Nix asked for any
other nomination's, Cecil Pitman moved they be closed, and motion
to appoint Mr. Killoch passed unanimously.
Mr. Killoch addressed the public, introducing the members, Bob
Lunsford, Betty Rivenbark the Secretary. He stated the reason
of the meeting tonight being concern for zoning modifications of
the fundamental plan of
,,,the City of Fairhope, and to solicit public
input; comments; and suggestions from citizens. . He pointed out
that no decisions would be made by the Commission tonight. He
noted that recommendations for change are the result of the studies
done by Community Consultants, who was represented by Tommie
Werneth tonight and by Phillip Roth and Associates. Overall that
Fairhope is well planned community, and changes suggested are
relatively few yet incorporate some modern viewpoints. He pointed
out the map prepared by Bob Lunsford showing proposed changes
in red for commercial and yellow for residential, and central
business district being redefined. He introduced Tommie who
explained how she had taken results of the survey and compiled
what she believed to be changes the community wanted, most of
all the concept, was remaining same there were a few changes
as explained by the red for commercial and yellow for residential
areas. She also stated that a request was made for the Commission
to consider in the future patio or garden homes and a provision
for these has been incorporated into the zoning ordinance(7.4).
Mrs. Werneth read the new provisions to the audience. At this
time Mr. Killoch called on audience members who had signed in
as wishing to address the Commission members. The first to
speak were Craig an_s d Art D as repre� entice 37 acres at the North
b end of town etter known as"triangle area". Basically wanted to get
on record as asking for consideration in re -zoning this area
to commercial rather than R-IA it is now zoned. Said they would like
to sit down and negotiate a PUD in area possibly change. Next
Claire Gray who thanked the Mayor for the survey and asking for
citizen input as to how we wantedtgrow. She also said she felt
Magnolia should remain single family residences, with light industry
on the East of town. Azzile Anderson had asked to speak but said
she felt Claire had covered all she wished to say. Joyce Bishop
Joan Hoffman, Ruth Morrison, and Fred Hayek were also present
and said they felt Ms. Gray had made comments they wish -to make.
Ms. Hoffman asked that her property on the corner of Summit 8
Magnolia be exempt from Single family status as she is surrounded
by commercial and that she feels it would be hard for her to sell
her property as anything else.
Paul Smith, James Darrow, Dave Beaudoin, George Weems, Sarah and
E.J. Fenton all of Colonial Acres had some strong words for the
Dyas property, all against development of commercial at this area,
mostly keeping it like it is. James Darrow also said he was opposed
to commercial development on Greeno Road. He felt it would be
another Airport Blvd if allowed to go commercial. That one of the
things that drew him to Fairhope was the beautiful approach to area
by Scenic 98 and 4-lane. Wayne Kahlbau, a general contractor spoke
saying he wished to encourage patio home designation consideration.
That he had a piece of property he would like to develop. 'The
commission reminded him that no area had been set aside as of yet
for this type of development.
Hank Brady addressed Commission against triangle area development,
he presented pictures showing a great deal of erosion from Fly Creek
and he felt they could not handle any more run-off that would come
from development.
Larry Chason came forward saying he represented some 20-25
property owners who are trying to get together a plan to present
to Commission on Greeno Road property. That they would like
to change the thinking on Greeno Road development, especially
from single family as is now zoned. Possibly develop some: R-2,
R-3, R-4, R-5, some B-4 and B-I and B-2 in a gradual process. That
he is not prepared to present anything tonight. He further stated
that he felt the quality of developments lie in the developer. That
these property owners feel they can't get fair market value for this
property as zoned now, he wants an opportunity to present tasteful
multi family developments in a higher density than now provided
and adjoin commercial districts with additional commercial property.

The last speaker was Mike Arnold, a land surveyor who questioned
where we were headed. That we have limited development to small
industry and every indication is we want a bedroom community.
He is for planned growth, doesn't want Airport Blvd but he also
wonders how miserable people on Greeno Rd are trying to use property.
Other than service community what do we have and where are we
going? That young people will have to move away and maybe come
back to retire. He said he just felt compelled to ask this.
No one else wished to address Commission, and there being no
further business, Mary Doug moved to adjourn meeting, seconded
by Barney Shull, meeting was duly adjourned.
