HomeMy WebLinkAbout12-02-1985 Regular MeetingThe Planning & Zoning Commission of the City of Fairhope met December 2, 1985 at the City Administration Building, 161 N. Section St, Fairhope Alabama at 5:00 p.m. Present: Roy White, Chairman; members James P. Nix, Cindy McBreart Robert Mason, Cecil Pitman, Tim Kant, Mary Doug Foreman, Richard Sanderson, Maxwell Killoch The minutes of the November meeting were approved as written on motion by Robert Mason, seconded by Maxwell Killoch and unanimously carried. The public hearing on the rezone request of Mr. Fritz Crane was held. Mr. Crane was present representing the rezone request. He stated that this leasehold p,rrperty was re -zoned at his request last in September 1982 from B-4 to R-5. After a plan for development in that area fell thru- he didn't pursue anything else. He now has a use for the area, mainly a real estate office in the existing building on the property and would like to re -zone back to the B-4. Bob's comments included that the east 250 ft. of property abutting was previously zoned B-4 therefore it would be contiguous and the property to the South abuts a B-2 district so it would not be considered spot zoning. it was brought up whether or not a 50 ft. strip unopened at present reserved for road would be utilized. Mr. Crane said he wished to reserve that strip, that he would open it eventually. Further comments led to a motion by Robert Mason to recommend approval of rezone request to the City Council on the west side of the property as requested , Richard Sanderson seconded and motion carried unanimously. Mr. Bill Leavitt was present to discuss with the Commission his re -zone request from RI to B2 the property located at the Northeast corner of Greeno Road and Gayfer Avenue. Mr. Leavitt explained that he is having to move out of the building where his business is presently located and that he was having to consider building in Daphne and he did not want to do that. He was born and raised in Fairhope and wanted to keep his business here. Several people spoke for the re -zone, Tom Brown, Amos Wagner, Ben Barnhill, and Robert Jansen, all property owners in the area! Bob Bung, part owner in the land also mentioned that he was for it. Cindy McBrearty mentioned that even though all present were for it that the results of the survey sent out showed that the citizens did not want any more business developing out this way. Mr. Leavitt mentioned he was trying to wait for the finish of the comprehensiv plan but do to the fact that he had to get out of this building he went ahead with the re -zone request. Bob had commented that this would constitute spot -zoning all surrounding property is zoned R-I. Mr. Leavitt maintained that he was sure he could get the rest of the joint property owners to go with B-2 zoning(his wife's brothers) making a 12 acre tract. He also asked if all 12 acres couldn't be considered .including his at this time. There followed some discussion on whether or not 2 or 12 acres was being considered. Cecil Pitman said he would be in favor of having a special meeting to look at property from Edwards all the way to Dyer Rd. The Commission agreed there just wouldn't be time between now and Christmas James P. Nix moved to put this off until the next regular meeting to determine just what is being requested in re -zone. Richard Sanderson seconded and motion carried unanimously. The Board discussed a memo from Max Killoch questioining the possibility of pursuing a request for zoning control in the Police Jurisdiction. Mr. Nix informed him that this is something that has been pursued by the Leaque of Municipalities for years and so far has been unsuccessful That it would take a State bill to pass this and that the County has the authority to request it. Cindy asked if we couldn't co-sponsor with the County, that it would not hurt to let them know we are interested. Mr. Nix said he would seek advice from the League attorney and hopefully have an answer by the next meeting. There being no further business meeting was duly adjourned.
