met November 5, 1985 at 5:00 p.m. at the City Administration
Building, 161 N. Section Street, Fairhope, Al.
Present: Chairman Roy White, members Jim Nix, Robert Mason
Cindy McBrearty, Mary Doug Foreman, Cecil Pitman, Dick
Sanderson, Max Killoch, Tim Kant
The minutes of the October 7, 1985 meeting were approved
as written.
A public hearing was held on the application of John C. Glover
for a re -zone of his property from B-3b ( Tourist Resort Commercial
Services) to B-2 ( General Business) . Property located at corner of
Volanta Street and Section St. Mr. Ken Gibson spoke for Mr.
Glover showing the Commission a drawing of the property concerned.
Mr. GI over told the Commission members he had a request
from two different people in the last month one to have a church
there and one to have a teen club there. He knew that these
would involve activities that would last into the night and he
did not want this for the neighborhood. He did have an electrical
supply outlet interested in this building and he thought this
would be a good tenant. Bill Patton spoke saying he didn't
see anything wrong with re -zone request. Jim Starnes, Sonny
Nichols and Art Verhoestra also said they did not see anything
wrong with re -zone request. Hop Allen and Pierce Frederick
spoke against this. Mr. Allen said he thought that this would
be detrimental to the neighborhood that there are several families
with young children that the big trucks backing in there could
not see them or be looking out for them. Mr. Mason asked Mr.
Lunsford to tell where the B-3b zone falls. He replied from Miller
to Forrester on the East side of the road and from Miller to Marina
Dr. on the West side of the road. Bob's comments were asked for
and he read... "he was of the opinion that B-2 zoning requested
was not sufficiently restrictive to adequately protect the neighborhood
to the south and east or west. Further, he found no history of
land use or prior zoning to justify B-2 district for this property."
He went on to say that B-1 use would serve the owner's interest
and protect the neighborhood, on condition that the commercial
use be screened from the residential use. Mr. Sanderson asked
Mr. Glover if B-1 would be acceptable. He replied he would rather
have B-2. Mr. Sanderson moved to grant B-2 rezone request.
Motion died for a lack of a second. Further discussion led to
a motion by Robert Mason to recommend approval of re -zone request
from B-3b to BI to City Council subject to Bob's recommendations
being adhered to. Cindy McBrearty seconded and motion carried
unanimously.
The Commission accepted for public hearing at the December meeting
re -zone request of Bill Leavitt from R-1 to B-2 property located
at N.E. corner of Greeno Road and Gayfer Ave.
The Commission accepted for public hearing at the December meeting
re -zone request of Fritz Crane for R-5 to B-4 property located
at 101 N. Greeno Rd.
The schedule of next year's meeting dates was adopted.
There being no further business, meeting was duly adjourned.
