HomeMy WebLinkAbout03-16-2020 Board of Adjustments MinutesMarch 16, 2020 Board of Adjustment Minutes 1 The City of Fairhope Board of Adjustments and Appeals met on Monday, March 16, 2020 at 5:00 PM in the City Council Chambers at the City Administration Building, located at 161 N. Section Street. Members Present: Anil Vira, Chairman; Christina Stankoski; Dick Schneider; Cathy Slagle; Hunter Simmons, Planning and Zoning Manager; and Emily Boyett, Secretary. Absent: John Avent, Vice-Chair; and Troy Strunk The meeting was called to order at 5:00 PM. BOA 20.02 Public hearing to consider the request of Robin and Susan Comstock for a variance to the side yard and separation setback requirements for accessory structures at 114 N. Bayview Avenue. Mr. Simmons gave the staff report saying the property at 114 N. Bayview Avenue is zoned R-2 Medium Density Single Family Residential District and is located on a corner lot with the required setbacks for principle structure being front – 35’, rear – 35’, side street – 20’, and side – 10’. Accessory structures shall not extend further than the principle structure while maintaining a 10’separation requirement. The site is a non- conforming lot with a somewhat irregular shape with an existing dwelling, shed, covered carport and pool. The applicant proposes to demolish all the existing structures and build a new residence. The applicant is requesting a 9’street side setback and an 8’separation for accessory structures. Mr. Simmons explained the road along the north property line encroaches the property and it will be hard to push the structures to the front. Staff recommendation is approval of the 1’ side setback variance for a principal structure and a 2’separation setback variance between the principal structure and accessory structures; request resulting in a 9’side setback for the principal structure and an 8’separation between the principal structure and accessory structures. Mr. Vira opened the public hearing. Mrs. Boyett stated she received a letter in favor of the request from Lynn McCready at 104 Oak Avenue. Having no one present to speak, Mr. Vira closed the public hearing. Mr. Schneider stated the request seems appropriate. Cathy Slagle made a motion to accept the staff recommendation to approve the 1’ side setback variance for a principal structure and a 2’ separation setback variance between the principal structure and accessory structures; request resulting in a 9’ side setback for the principal structure and an 8’separation between the principal structure and accessory structures. Christina Stankoski 2nd the motion and the motion carried unanimously with the following vote: AYE – Dick Schneider, Christina Stankoski, Anil Vira, and Cathy Slagle. NAY – none. Having no further business, the meeting was adjourned at 5:10 PM.
