HomeMy WebLinkAbout05-06-1985 Regular MeetingThe Planning & Zoning Commission of the City of Fairhope met May 6, 1985 at the City Administration Building 161 N. Section Street, Fairhope, Alabama at 5:00 p.m. Present: Chairman Roy White; members Robert Mason Cindy McBrearty, Mary Doug Foreman, John Parker, Harrell Holder, Jack Kirk and Cecil Pitman. Robert Lunsford, Zoning Enforcement Officer The minutes of the April meeting were duly approved. I The public hearing on the Corte property zoning and annexation request was held. Mr. White recognized the Cortes and asked if they had comments. Bob explained the different zones requested as follows: Extension of B-2 northward along Greeno Rd and eastward along Fairhope Avenue, buffered to the north by- R-5 and R-2/R-3 and to the east by the courthouse annex propertl and an existing R-5 use outside the proposed annexation. Rosa Acres (R-3) and Rosa Acres, Unit 2(R-4) will be buffered by Edwards Avenue and R-2 south of Edwards. Mr. Parker noted Bob's further comments that had been presented to Comm. members, "The zoning requested is an extension of General Business from the present community development plan, buffered by resi- dential use and does not constitute "spot zoning". Further "since a substantial development plan was submitted as a basis for consideration of the zoning changes, it is recommended that a specific agreement(to run with the land) containing elements of the development plan be drawn between the owners ana the Cltj as a condition precedent to zoning/annexation, with concurrence of the City Attorney". Mr. Parker said he thought this a very worthwhile statement and ought to be noted. Mr. White asked from comments from the audience and Mrs. Roubik asked how this would affect her property if the street ran through. She was told that it would have to be negotiated with her, that now all that was being asked for was zoning Mrs. Lucassen asked who will decide if a road will go through there. That she wanted to go on record as voicing opposition to Edwards being a thoroughfare. She was answered that the traffic on Edwards Avenue would be resolved when a subdivision application was presented. Several others spoke voicing concerr for development next to Rosa Acres. Mr. Parker said he was opposed to any commercial development access running to Edwards Avenue. Further discussion and comments by Commission members and audience led to Mr. Parker comment about plan that it ought to be noted that there was a need for road right of way at Fairhope and Greeno Rd. On Greeno Rd frontage expanded 40 ft and on the north side of Fairhope Avenue 20 ft. That the drawing showing traffic being sent to Edwards a mistake that the 160 ft park shown be in the annexation and zoning agreement, r't the 250 ft. land running north/south on Greeno Road remain as is now(R-5), and that the storm drainage be run to the collecting pond at the Baldwin Square Shopping Center and not to Greeno Rd. He further commented that there was potential for a really first class development and it would be a tremendous asset. Cecil Pitman moved to recommend approval to City Council on re -zone and annexation/zoning request as presented. The Board members said they could not go with R-3 strip along Edwards Ave. Mr. Pitman withdrew his motion. Further discussion was held and Mr. Parker presented a motion recommending approval to the City Council with following stipulations: 1. The 250 x 150 ft frontage on Greeno Road remain R-5 2. There would be no street access from the commercial property to Edwards Avenue 3. Storm drainage would be responsibility of developer, he would have to develop adequate system to handle II III IV u Planning & Zoning COmmission - page two May 6, 1985 meeting 4. There be road right of way from Edwards dedicated to City as well as additional right of way(40 ft on Greeno Road) and 20 ft on Fairhope Avenue) be dedicated to City. 5. The 160 ft. East-West park area be established on Edwards Avenue and Fairhope Avenue 6. That an R-2 strip be established on Edwards Avenue all the way to the East. Cindy McBrearty seconded the motion. Mr. Arthur Corte spoke on the request for R-2 on the Edwards all the way to the East. He brought up the recent Walter Wilson property that was zoned R-3 and that there was R-4 development now outside the City Limits next to his property. Mr. Parker agreed to modify his motion to read east portion be R-3 opposite Wilson tract and the west be R-2, Mrs. McBrearty seconded. Mr. Parker further modified his motion to be that a single point of access be allowed on Greeno Road North of Fairhope Avenue to be at north edge of B-2 zoning, Mrs. McBrearty seconded and motion carried with all voting for approval except Robert Mason abstaining. motion carried. There was a preliminary application by LeaBrook for a 4th addition. No one was present to discuss it. Robert Mason moved to hold over until next meeting. John Parker seconded and motion carried unanimously. A Discussion was held on Windmere Condominiums annexation Art Rigas was present and asked the Commission's feeling on R-4 zoning for this area. That two 4-plexes had been built and 2 more planned. This is property opposite Middle School. Mr. Rigas explained he was representing Adrian Johnson who wished the Commission's comments on annexing into the City and R-4 zoning. Mr. Parker offered to Mr. Rigas that in discussing zoning for this area previously it was pointed out that R-3 was desirable for this area to conform to City's comprehensive plan. That there is R-3 to the West side of this land, R-3 to North and school across road. He really did not feel that the Commission should accomodate the builder after he bucked the input from before. The other Commission members said they also felt this way. Mr. Rigas said that he felt people in the neighborhood might have been opposed because they did not know what planned, that now they know what the place looks like that they have changed their minds and might be in favor of this zoning. Mr. Rigas was told he could put in for zoning application and have a public hearing. Mr. Rigas thanked the Commission for their input. Bob brought to the Commission's attention a situation that now exists in Commercial Park, whereby Mr. George Roberds who has sold the East side wants to know if he is bound to still provide parking for the West side tenants if he wants to expand. This was discussed at September 9, 1983 meeting where the parking lot was a means to solve an existing problem at that time. Bob said he had talked to Byrd Moore(the owner of the West side) and he indicated he had "no claim" to east side parking lot. John Parker moved to record a release of the parking claim subject to Mr. Moore tendering an affidavit stating same. Robert Mason seconded and motion carried unanimous- ly. The Board voted unanimously to hear Mr. Victor Altamarino from the floor asking for input from the Commission on five acres of land he owns on Gayfer Extension which he wishes to develop as a subdivision. He remarked that he wished to put duplexes and annex when conti quous. John offered that we needed to look at the future of Greeno Road from Edwards Ave. that now zoned R-2, R-1 and Meadowbrook R-3, Unit II there is some R-4. and Mr. Glover's subdivision R-1, just what extent did we wish to develop multi -family. Cecil and Cindy commented that they would like to look at whole quadr t, all said they would too. Roy told Mr. Altamarino that he& resent this for preliminary discussion at the next meeting. VI Planning & Zoning Commission - Page three - 5/6/85 Mr. Lunsford reported to the Commission that there was a change in the configuration of the lot as reported at the last Commission meeting on David Stapleton re-subdivision(1 lot into 2) Blueberry orchard. The commission asked if Mr. Lunsford saw any problem with change and he replied no, they said they saw no reason to change action of last meeting. There being no further business meeting was duly adjourned.
