met October 1, 1984 at 5:00 p.m. at the Municipal Complex,
161 N. Section Street
Present: Roy C. White, Chairman; members John Parker
Cindy McBrearty, Mary Doug Foreman, Robert Mason,
Jack Kirk, Cecil Pitman, and Harrell Holder
The minutes of the September 4, 1984 meeting were considered
and approved on motion by Robert Mason, seconded by Mary
Doug Foreman and unanimously carried.
A public hearing was held on a re -zone request by Rufus
Brock for a change in zone from R-2 to R-4 for the property
located at 58 N. Bayview Street. Mr. Brock spoke to the
Commission saying he had what he considered a mother-in-law
house, adjoining the house on this property. That now it
was in one building but in the future if he wanted to rent
the apartment he would have to have R-4 zoning. That he
felt this would be an improvement to the area and that the
houses close to his are already zoned this way. Mrs. Brey
spoke saying that she felt the zoning change was a creeping
thing that she thought we ought to be firm about keeping
the bay area single family. Mr. Parker spoke saying that
the Commission had attempted to respond to tourist -resort
zoning when they changed Magnolia Avenue. Bob offered that
Bayview to the South was zoned B-3b, to the East on Atkinson
was R-2, and to the North on Atkinson was R-2. Mr. Parker
further said that the Commission attempted to offer good
healthy single-family in this area not be advocating multi-
family. Harrell Holder offered that it might set a precedent
down the road. Mr Parker pointed out that the subdivision
regulations did allow for an efficiency apartment in a
single-family residence, just not rent it out, that basically
what Mr. Brock had in mind could be achieved. Further discussic
led to a motion by Cindy McBrearty to recommend denial of
this re -zone request to the City Council as it is inconsistant
with the City's Comprehensive Plan. Harrell Holder seconded,
and motion carried unanimously.
Art Rigas came before the Commission to discuss a 20 lot
subdivision proposed by Jack Glover known as Rolling Oaks
South. He had a sketch plan and noted that the smallest
lot was 15,000 ft. The sketch showed a cul-de-sac at the
end of the street w/planted island, they planned to excavate
the drainage pond to handle water flow, have curb & gutter,
and have city water and sewer. A lenghty discussion was held
on planted vs. paved in the cul-de-sac area. It was brought
out that unless there were restrictive covenants covering
this that usually these islands are not taken care of.
They had also showed 54right of way on road and Art mentioned
they were going to ask for a variance on this. Bob's comments
were noted in that he had recommended 60 ft. width on streets,
continuation of East property line for future access to
adjacent properties, and not less than 60 ft right of way
for the extension of Dyer Road east of Bishop Road to point
where map shows the new street turning 5-50 36'39"E. He was
to cdnsult with Bob to check on land beings,landlocked". The
Board told him that if he would take care of the pond, consider
reducing 7 & 8(yield 25 ft) and see if the drainage is adequate
and the pipe in the culvert adequate plus get the County's
input they saw no problem with subdivision as shown on plat.
Marshall Fischrupp came before the Commission to discuss
The Birches. This was up for preliminary discussion.
He said that they were only using three -fourths of the property
that all utilities were available, no problem with drainage,
There was a discussion held on why he planned for the sidewalk
all the way around, that it was not required. He said that
he drew it the way they wanted, that the developers wanted
a sidewalk. All in all the plan looked good and Cecil Pitman
moved to accept site plan as presented, John Parker seconded
and motion carried unanimously.
Mr. Fischrupp also presented a site plan for Baldwin County
Mental Health Center. The site is on Greeno Road south of
Poser's. Mr. Fischrupp mentioned that they were going to follow
the natural drainage flow, that there were natural contours
to E,N & S. Bob had reviewed the parking and it was adequate.
There are no side yard requirements in this district. He was
asked about moving the parking back and what if any widening
of Greeno Rd would affect him. He answered that they might
want to add on to the building later and that was why the
parking arranged where it was, that widening of Greeno Rd
would not be a problem. All questions answered satisfactorily,
Harrell Holder moved that Bob go ahead with the issuance of
a building permit, Cecil Pitman seconded and motion carried
unanimously.
Bob reported that he and Phil had met with Mr. Crane about
his property on Greeno Road and suggested to him what would
be an acceptable plan for drainage in this area. A question
of whether or not a committee needed to be formed to study
this was raised. It was decided that this needed to be
studied by the City and a plan come up with and options
available, all agreed this was right way to approach it.
There being no further business, meeting was duly adjourned.
