The Planning & Zoning Commission meeting of the City of
Fairhope met May 10, 1984 at 5:00 p.m. at the City Admin-
istration Building, 161 N. Section Street, Fairhope, Al.
Present: Roy C.White, Chairman; members James P. Nix,
Cindy McBrearty, John Parker, Mary Doug Foreman, Harrell
Holder, Jack Kirk, Bob Lunsford, Zoning Enf. Officer
The minutes of the April 2, and April 19, 1984 were approved
as written on motion by Harrell Holder seconded by Jack Kirk
and unanimously carried.
The public hearing on Walter Wilson's request for R-4 zoning
for the property located fronting on Troyer Road was held.
Mr. Wilson addressed the Commission and said he had two parcels
one containing 10.27 acres and one 2.73 acres. That he applied
before the State for annexation since he is not contiguous
to the City Limits. He further stated that he did not have
a use for the larger piece of property that after discussing
with the neighbors in the area that he would be willing to
go with zoning the small piece R-4 and the large piece R-3.
He wished to keep the small R-4 and build four units to a
structure on this property. He showed a floor plan he wished
to use, stating that he wished to build for retirees and
cost should run between $60-$65,000 dollars keeping the caliber!
of the neighborhood nice. Mr. White asked if there were any
questions from the audience. Tommy Springer spoke saying that
he wished he would consider all R-3 that he had envisioned a
nice uniform subdivision in this area. A Mr. and Mrs. Hill and

After discussion, J.P. Nix moved to recommend to City Council
R-4 zoning for small piece of property and R-3 for large 10
acre tract, E.J. Kirk seconded. Tommy Springer spoke again
saying that this property is already sold if the zoning is R-4
that he doesn't think this is right. John Parker said he
thought we should consider the land use plan for this whole
area, that he feels that to be consistant we should keep single
family as is now. The question was called for and the vote
was for having R-4 small portion and R-3 large portion- JP Nix
Kirk. Against this Parker, Holder, McBrearty, Foreman. Motion
did not pass. Mr. White asked Mr. Wilson if he would consider
anything else. Mr. Wilson said he would consider R-3 zoning
for both parcels. John Parker moved to recommend to City Counc
R-3 zoning for both parcels when annexed into City, Harrell
Holder seconded and motion carried unanimously.
Thomas Davis came before the commission with a request to
subdivide 1 lot into 3 property being in Montrose
located on Chapman and Second Streets. He stated that he
wished to build a residence on 1 of the lots. Bob's comments
were noted in that the lot sizes are above minimum required
and have Health Dept. approval, the plat is in conformity
with the regulations, therefore he is recommending preliminary
and final approval. John Parker moved to approve subdivision
as requested, Mary Doug Foreman seconded and motion carried
unanimously.
Mrs. Gunnison came before the Commission representing their
request to re -subdivide one lot into two. Leasehold held
by John Gunnison property located on Belforest Rd Z mi. N.
of Twin Beech Rd. F.S.T.C. has approved this, the Health Dept
and Cty Engineer also and there are no restrictive covenants.
J.P. Nix moved to approve on Zon. Enf. recommendation, Harrell
Holder seconded and motion carried unanimously.

John Parker brought up under old business the approval of
Sans Souci subdivision and subsequently that the City ought
to set a policy, and make amendments to the subdivision tegula.
to cover private drives in subdivisions. Roy White appointed
John Parker, Cindy McBrearty and Cecil Pitman as a committee
of three to get with Bob Lunsford and come up with terminology
appropriate to cover these requests.
Bob brought to the Commission's attention a letter he had
written as requested bY. George Roberds setting out policy
regarding property & parking, and enlargement of present
buildings at Commercial Park site, which in part stated
"No permit shall be issued for enlargement of any existing
building or for construction of any additional building upon
subject property until the applicant has complied with the
following: 1) submission to the City of a scaled and dimension-
ed site plan of existing and proposed improvements and the re-
lationship to boundary lines, said site plan to be fully in
conformity with the landscaping, setback and parking require-
ments of the zoning ordinance and the agreement set out with
and before the Fairhope Planning Commission of 9/9/83(copy
in official minute book) Any proposed reduction of the number
of parking spaces required under said agreement may be sub-
mitted for approval of the Planning Commission. 2) Compliance
with the technical codes and general ordinance of the City.
No building shall be used or occupied until required certifi-
cates of occupancy have been issued and the business properly
licensed." James P. Nix moved to accept letter as policy,
Harrell Holder seconded and motion carried unanimously.
