HomeMy WebLinkAbout04-19-1984 Special MeetingThe Planning & Zoning Commission of the City of Fairhope, Alabama,
met in special session at 5:00 o'clock, P.M., Fairhope Municipal
Complex Council Chamber, 161 North Section. Street, Fairhope,
Alabama, on Thursday, 19 April 1984.
Present: Chairman Roy C. White, members James P. Nix, Robert
Mason, Mary D. Foreman, Harrell Holder, and E. J. Kirk.
Absent: John Parker, Cindy McBrearty, and Cecil Pitman.
City Building Official Bob Lunsford was also present.
A quorum being present, Chairman White called the meeting to order
and asked Mr. Lunsford for comments on the Curtis Gordan Sans
Souci subdivision application for preliminary approval.
Mr. Lunsford stated everything was in order for approval, there
were several small items to be corrected, such as grade and
horizontal curve*
Mayor Nix commented he felt approval of Sans Souci as is would
forever place a maintenance (of the streets) problem on the backs
of the taxpayers of Baldwin County. Mr. Holder said he felt
approval of the subdivision as an experimental private subdivision
with private streets, which are in conformity with reg-
ulations, would be feasible as long as property owner deeds each
carried a covenant to the effect that the streets are and forever
will be private and are to be maintained by the property owners.
After some discussion, Mayor Nix moved to grant preliminary
approval as an experimental project with private streets, which
also meet sub -division regulations. Seconded by Mr. Holder.
Discussion: Mr. Mason asked if all adjacent property owners had
been advised of this special meeting. Mr. Lunsford said all
were duly advised. Mr. Lunsford also said if the subdivision was
to be granted preliminary approval on an experimental basis, if
developers agreed to the following stipulations; final approval
on this basis could be granted.
Mayor Nix said he would amend his motion to make it"preliminary
and Final"approval. Mr. Holder said he would amend his second.
Motion, as amended, passed unanimously.
Mr. Walter Wilson and Mr. Jim Reid, adjacent property owners, were
present and expressed approval of the experimental subdivision wit
private streets.
Meeting was duly adjourned.
*Stipulations attached to these minutes as Exhibit A. Mr. Lunsford
read them and explained during the above discussion before the vote.

EXHIBIT A
Recommendations for Conditional Approval -Experimental Subdivision
"SANS SOUCI"
I. Establishment of a covenant, approved by the City Attorney,
running with the land to provide the following:
1. continuing maintenance of the common access way by
an owner's association or other entity.
2. right of ingress and egress for emergency vehicles
and for maintenance of utilities.
3. save harmless agreement for the governing body for dam-
ages where such damages arise out of the existance of
the common access way, as such.
4. make every owner abutting upon the private access way
a party to said covenant.
II. Reference on plat to recording of covenant.
III.All streets and utilities to substantially conform to
subdivision regulations.
IV. Irrevocable letter of credit to City as a guarantee of
installation of streets/utilities or actual installation
prior to recording of plat.
