HomeMy WebLinkAbout03-05-1984 Regular MeetingI II III IV The Planning & Zoning Commission of the City of Fairhope met March 5, 1984 at 5:00 p.m. at the City Municipal Complex, 161 N. Section Street Present: Chairman Roy White; members John Parker Robert Mason, Cindy McBrearty, Mary Doug Foreman, Harrell Holder and Cecil Pitman The minutes of the February 6, 1984 meeting were duly approved as written on motion by John Parker, seconded by Harrell Holder and unanimously carried. The Board accepted a re -zone request for public hearing at the next regular meeting from B-4 to B-2 from M.J. Mastin property fronting on Greeno Rd. and containing some 4 lots. Motion made by Robert Mason, seconded by Harrell Holder, and unanimously carried. A request for zoning on property owned by Walter Wilson located on Troyer Road -some 2.73 acres was accepted for public hearing to be held at May regular meeting. Motion by John Parker, seconded by Cindy McBrearty, and unanimously carried.(Annexation request being made through State as this land is not contiguous to City Limits, hopefully some answer from them by this time) At this time the Commission held a public hearing on a re -zone request from Baldwin County Savings & Loan Assoc. for a change in zone from R-2 to B-4, property located on the corner of Greeno Road and Morphy Avenue. Jim Cummings spoke for BCS & L saying that what they propose will blend in with the neighbor- hood that they had no intention of stripping the area. Mr. White read Mr. Lunsford's recommendations: 1. That no building, now or future, be permitted on lots, 1,2,11, or 12 of said block 12 area to be used only for parking and drive -up access. 2. That screening along Pleasant Street and Michigan Avenue be provided and maintained -either as a 6 ft. solid evergreen hedge or a 6 ft wall or fence, enhanced with planting. 3. That all vehicular traffic exit only to Morphy Ave; traffic may enter from Greeno Rd but not exit thereon; there be neither ingress or egress of vehicles to or from Pleasant St. Mr. Parker remarked that no ingress/egress should be added on Michigan St. and further explained that this is in keeping with the comprehensive plan having the B-4 buffer/ no further roadway into this neighborhood He further went on to say that he thought that ingress/egress should be totally on Morphy. Mr. Cummings remarked that he cer- tainly had the community's interest, but would not like to have their hands tied this way. Several spoke from the audience also remarking that they would like no ingress/egress from neighbor- hood, and a-asthetics. Further discussion led to a motion by John Parker to recommend approval of zoning change request to the City Council, with the stipulations on this being: 1. no building, now or future, be permitted on lots, 1,2, 11 or 12 of said block 12-area to be used only for parking and drive-up(except portion of drive -up understood to be partially on this area) 2. screening on Pleasant & Michigan be provided and maintained 3. There be neither ingress nor egress of vehicles to or from Michigan or Pleasant Streets 4. No ingress/egress from Greeno Rd. Cindy McBrearty seconded and motion carried unanimously. The re -zone request of Gene Fuqua from B-4 to B-2 for his property located on 451 Pine St was discussed at this time. �r In VI Mr. Tim Jackson spoke on behalf of his business that he is running with Lonnie Swoboda Marine & Auto on the corner of Bancroft and Pine. That he is interested in buying this proper- ty and move the marine facility to this location and erect a building to help alleviate congestion that they now have. Several of the property owners spoke, saying they were against changing this zone, that they had agreed to the B-4 as a buffer for their residences. John Parker remarked that the questionowe needed to address was by expanding the business zone gradually are we impacting on the residential area. Craig Sheldon spoke saying that they were already under pressure that we do not nee( this expansion in the residential area: Mr. White remarked that he had a call from Mr. J.L. Hughes who wished to go on record as opposed to the change. Further discussion led to a motion being put on the floor by Mary Doug Foreman to recommend denial of re -zone request to the City Council, John Parker seconded and vote was as follows: denial, Mary Doug Foreman, John Parker, Cindy McBrearty, for re -zone Robert Mason and abstain, Cecil Pitman and Harrell Holder. Matt Dial's 18 lot subdivision located South of Fairhope on County Road 27, called Huntlee was discussed. Ack Moore represented Mr. Dial and said they were seeking preliminary approval subject to getting health department approval, highway department approval and paving the temporary turn -a -round shown on the drawing. At this time several of the property owners spoke asking what the Commission could require in a case like this, and the purpose of notifying the property owners. Mr. Dial also stated the restrictions he was requiring in the subdivision. Mr/Mrs Bishop, Mr. Ennis, Mr. Luckie addressed Commission expressing feelings that they had moved away from the City to get away from all the problems associated with subdivision living to get space. Mr. White answered that the Commission did not have the right to keep a land owner from developing his land, only that we had the right to see that he develops according to the law. Further discussion led to a motion by John Parker to grant preliminary sudivision approval subject to the construction of the required improve- ments, the County Health Officer's signature on the plat, the required engineering specs on the storm drainage being presente• and the signature of the County Engineer on the plat. Harrell Holder seconded and motion carried unanimously, with clarifica- tion being made that at the temporary cul-de-sac, it being agreed that the dedicated right-of-way will remain until further devel oped. Preliminary and final subdivision approval was given to Charles Davison who is dividing one lot into two. He is keeping 1.4 acres and using the remaining 3.58 for a trailer park. Bob remarked that he was for this approval subject to getting the County Engineer's signature on the original plat. Cecil Pitman so moved, John Parker seconded and motion carried unanimously. VII Curtis Gordon introduced Pete Garsed of McCrory & Williams to Commission and wished to discuss tonight a proposed plan for the Fritz Crane property, presently zoned R-5. He had a drawing showing multi -unit residential and said this would be phase I The main discussion dwelled on drainage and how they would handl f it. Mr. Garsed showed a plan whereby they intercept the water at the NW corner of the property carry along N edge thru double pipe under Greeno Rd to other drainage pipe. The Commission addressed the wisdom of loading up the West side, what about others down the road. Mr. Garsed said they couldn't design for others. Discussion did not lead to any decision, only that the Commission did not wish to load up W. side with E. side develop- ment. There being no further business, meeting was duly adjourned.
