The Planning Commission of the City of Fairhope met
January 3, 198i" at 5:00 p.m. at the Civic Center
Complex, 161 N. Section Street.
Present: Chairman Roy White; members Robert Mason
John Parker, Cindy McBrearty, Jack Kirk, Harrell Holder
Don Pruitt of So. Al. Reg. P1an.Comm. and ZEO Bob Lunsford.
The minutes of the December 5, 1983 meeting were unanimously
approved as written.
At this time the Chairman announced we would discuss the
continuation of the public hearing concerning a request
for rezone R-5 to B-2 for the property located
300 ft. N.W. corner of Greeno Rd. and Fairhope Avenue.
Mr. Ernest Bailey spoke to the Commission going over
all the points he had made at the last meeting for
the benefit of Mr. Parker who was not able to attend.
Mr. Maisel then spoke showing an artist's rendering
of what proposed, pointing out that this was going to
be screened from residential area and landscaped and
that the drainage plan they had would allow no more
water than now runs off or less if they so desire.
The Chairman asked for questions from the audience.
Mrs. Barksdale came forward and said her concerns
were the same as when the property was rezoned be-
fore, the traffic flow, the buffer that would be
placed there and hopefully fencing and greenery
to cut down on the foot traffic as well as the trash
they have to pick up now. Don Pruitt remarked that
he had been there to observe the traffic and that he
would guess a minimum of 1600 vehicles would be added
to what now egresses/ingresses the area, that the problem
would definitely be compounded. Bob also remarked that
he agreed with Mr. Pruitt and Mrs. Barksdale about
increased traffic. Mr. Parker remarked that he is
opposed to this rezone, further that we have a plan
for Fairhope, that it is not wise to allow strip zoning
in this area, it is not consistant with the City's plan.
That we need to address the traffic problem, but noting
land N.E. and W. of this is residential, and that the
volume of past comments about this area from residents
is that they would rather we stick to comprehensive plan.
That if we allow this after turning down similar request
in this area we would blow credibility of Planning Comm-
ission. At this time Mr. Bailey asked about withdrawing
and coming back next month with a different request, Mr.
White told him that the Commission was bound to act as
public hearing already held and input given. He called
for a motion and John Parker moved to recommend denial
of rezone request to City Council, for reason it is not
consistant with City's zoning plan. Cindy McBrearty seconded
and motion carried unanimously.
The Commission considered a sketch plan review of a proposed
subdivision of Matt Dial for property located in the SW4
of NE4 of Section 34, TGS, R2E and contains some 40 acres
being on the west side of County Rd. 27(Belforest Rd) and
is 4 to z mile south of intersection with Cty Rd 34(Battles
Road) and County Rd 27(Bradley's Corner). Mr. Dial told
members he was thinking of dividing into about one acre lots,
He mentioned that most of the lots would perk, may have
to fill in west and south corner lots. He mentioned that
in looking over old records, there was a dedicated 40
ft right of way from previous developments, Bob said he
had not studied this but a title search would reveal same.
John Parker said what trying to accomplish would be fitting
in logical plan with adjacent land development.

Mr. Dial asked if we require curb and gutter in the
country, and was answered that we kicked around
different criteria, Don Pruitt remarked that the
Planning & Zoning Commission could waive this re-
quirement without having to get a variance. Mr.
Dial asked about right of way requirement and was
told that the county required 60 ft. right of way
with open ditches, and also that he should solve
the drainage question on this land, run his road
to property edge on the southern street for future
development, fire plugs, water lines and septic tanks.
He thanked the Commission for their input.
John Parker brought up at this time what was being done
on the comprehensive plan, whether or not we have a
schedule. Don Pruitt remarked that he could have something
ready in about 22-3 months and also working on the land use
in this area. Roy White appoint John Parker to make schedul(
and report back to Commission at February meeting.
There being no further business, meeting was duly adjourned
