August 2, 2021 Planning Commission Minutes 1 The Planning Commission met Monday, August 2, 2021, at 5:00 PM at the City Municipal Complex, 161 N. Section Street in the Council Chambers. Present: Lee Turner, Chairperson; Rebecca Bryant; Clarice Hall; Jason Langley, Water and Sewer Director; Art Dyas; Hollie MacKellar; Jimmy Conyers; Harry Kohler; John Worsham; Hunter Simmons, Planning and Zoning Manager; Mike Jeffries, Planner; Allie Knutson, Secretary; and Chris Williams, City Attorney. Absent: Samara Walley, Planner. Chairman Turner called the meeting to order at 5:02 PM. Minutes from July 8, 2021, meeting: Jimmy Conyers made a motion to approve the minutes as submitted. NAY: None. UR 21.01 Request of Mediacom for an 11.52.11 Utility Review and approval of the proposed underground installation. Property Owner/Applicant: Mediacom General Location: Firethorne Subdivision and Stone Creek Villas Project: 29,300 Linear Feet Pneumatic and Directional Bore for Communication Cable Zoning District: PUD School District: Fairhope Elementary, Middle, and High Schools Report prepared by: Chris Ambron, City Planner Recommendation: Approval with Conditions Summary: Planning and Zoning Manager, Hunter Simmons, presented case summary: This will be a combination of work through the Right of Way (ROW) and Utility Easements and is phased out in 750-foot phases like our utilities had requested for location purposes. Utility crossings will be potholed and verified by City ROW Inspector before crossing. All contractors will need a Business License as well as ROW Permit. Hangtags shall be put on resident’s doors with contact information for a Mediacom Representative. The applicant shall provide as-builts of the installed lines to show exact depth. Mr. Simmons stated that he would like to add a condition of approval that was not listed in the staff report, that pneumatic boring under road surfaces is not recommended. August 2, 2021 Planning Commission Minutes 2 Recommendation: Staff recommends APPROVAL of UR 21.01, subject to the following conditions: 1. Consultation with the City’s horticulturalist, to determine if the required depth of bore must be increased so that no trees are impacted by the project. The contractor is responsible for any damaged trees. 2. At all street crossing locations, conduct potholing to determine exact location and elevation of existing utilities. Reflect the exact elevation of utilities and GPS coordinates of the pothole locations on a set of as-built drawings. a. An additional right-of-way permit may be required for the potholing procedures. 3. Follow-up activities below required by staff and the applicant: a. Upon satisfactory review and approval by ROW Construction Inspector, as-builts will be submitted to the mapping technician for inclusion in GIS utility maps. 4. Provide draft door hanger for approval at time of pre-construction meeting. 5. Provide a Traffic Control Plan to ROW Inspector prior to commencement of any work. 6. No pneumatic boring under paved road surfaces. No Mediacom Representative was present. No further questions or comments from Commissioners. ZC 21.10 Public hearing to consider the request of Silverhill Enterprises, LLC to establish initial zoning of Harvest Green PUD concurrent with conditional annexation into the City of Fairhope. Hunter Simmons, Planning and Zoning Manager, presented case summary: August 2, 2021 Planning Commission Minutes 3 The project is described as a mixed-use residential community comprised of 375 Single Family Lots. For clarification, since mixed-use in Fairhope parlance implies commercial use, there is no commercial uses proposed within this PUD. The applicant plans to have all lots ready to build by November 2023. Six years is projected for complete build out. Harvest Green is divided by Highway 181. The two portions are referenced as Harvest Green West and Harvest Green East. Harvest Green West consists of 148 lots. These are larger lots than those proposed in Harvest Green East. The largest lots are located along the southern boundary adjacent to existing single-family homes. Home plans for Harvest Green West are from Truland Homes. Harvest Green East consists of 227 total lots. The largest lots are located along the southern boundary adjacent to existing single-family homes. Home plans for Harvest Green East are from D.R. Horton and Express by D.R. Horton. The project proposes 49.93 acres of greenspace, or 25.87% of the total site, (15% greenspace is required). Amenities include two swimming pools, two playgrounds, a multi-purpose court, an exercise area, and other areas listed as “park”. A pedestrian circulation plan was provided that includes 5-foot sidewalks and crushed asphalt walkways. Sidewalk access along Highway 181 is difficult due to wetland crossings, however, the applicant has provided a combination of crushed asphalt walkways and sidewalks to provide pedestrian connectivity along Highway 181. A public easement will be required at preliminary plat to ensure public access to those portions outside of ROWs. Staff would like the applicant to consider providing public easements through stream buffers in the hopes of provided a future trail system (alternate condition of approval). The landscape plans will need to be further reviewed. Traffic, drainage plans, electrical, and sewer services will be reviewed during preliminary plat review. All internal streets will be dedicated to the City of Fairhope and a lot on the eastern side of Highway 181 will be dedicated to the City of Fairhope for a future fire station Recommendation: Staff recommends APPROVAL of ZC 21.10 Harvest Green PUD, subject to the following conditions: 1. A traffic study shall be provided that includes all traffic generated by Harvest Green with the first application for preliminary plat. Please begin communications with ALDOT ASAP. 2. Fairhope utilities provided availability letters, but final plans and aid to construction costs will need to be coordinated with the respective supervisors. 3. Landscape plans shall be revised to include traffic calming islands. 4. If approved by the City Council, two (2) printed and bound copies of the Master Development Plan for the Harvest Green PUD shall be provided to the City. Alternate Condition: 5. Pedestrian easements will be provided on plats within stream and wetland buffers. Chairman Turner asked about lot sizes. August 2, 2021 Planning Commission Minutes 4 Larry Smith, S.E. Civil, stated that the lots in Harvest Green East are 52-100-foot lots while the lots in Harvest Green West are 56-100-foot lots. Chairman Turner opened the public hearing. Gary Gover, 300 Lincoln Street, stated that he was concerned about connectivity and new developments aligning with the City’s Comprehensive Plan. He thought that connectivity looked weak for non-motor vehicles. Hunter Simmons, Planning and Zoning Manager, stated that they looked at connectivity for walking, bicycling, and for low-speed vehicles. Staff is asking for more in the wetlands for potential development. Chairman Turner closed the public hearing. Rebecca Bryant suggested having a stub-out at The Waters Subdivision for connectivity in the future. Chairman Turner agreed and said that it would help keep traffic off of Highway 181. Rebecca Bryant asked how to make connectivity through a neighborhood feel welcoming. Hunter Simmons, Planning and Zoning Manager, stated that landscaping details would be done during preliminary. Motion: Art Dyas made a motion to approve Case ZC 21.10 Harvest Green PUD, subject to staff recommendations with an added condition that a stub out be added between lots 15 and 16. NAY: None. SD 21.34 Public hearing to consider the request of FST Corte Family Trust for preliminary approval of Rockwell Apartments. Property Owner/Applicant: FST Corte Family Trust General Location: East side of Highway 181 across from The Waters Subdivision Project Type: 206-Unit Multiple Occupancy Project Project Acreage: 36 acres Zoning District: Unzoned PPIN Number: 14535 Engineer/Surveyor of record: Sawgrass Consulting, LLC School District: Fairhope East Elementary, Middle and High Schools Report prepared by: Mike Jeffries (City Planner) Recommendation: Denial August 2, 2021 Planning Commission Minutes 5 Summary: City Planner, Mike Jeffries presented the case summary: All utilities are labeled to remain private inside the development. All connections and work in ALDOT ROW will require permitting from ALDOT. A traffic study was completed and recommended a north bound right turn lane to be installed. This would not include median access; all residents would be required to exit right onto Highway 181 and make a U-turn. The drainage travels west to east across the site and is collected in underground pipes. The storm water is then collected in two retention ponds. The greenspace does not confirm to Fairhope’s Subdivision Regulations. 25% of greenspace is required, 32% is indicated, however, much of the greenspace being counted is areas between buildings and driveways or areas that could be conceived as rear yards. The pool amenity is the only common area with community access without walking in the side yard of another building. All internal drainage, streets, and utilities are to remain private and maintained by the owner, HOA, and POA. A wetland report or determination letter was not submitted, and future subdivision of the property will be restricted. The applicant requested two waivers from the Subdivision Regulations; a waiver request to not provide access to adjacent property and a waiver request to allow for private streets to control access and utilities. Recommendation: Staff recommends DENIAL of SD 21.34, Rockwell Apartments. Doug Chaffin with Sawgrass stated that they have done an updated plan since their last submittal. The Developer is willing to do a stub street for connectivity, but there has been a conflict between the City of Fairhope and Baldwin County, and they have been sending their plans to both entities. He also mentioned that this subdivision is similar to Old Battles Village. Chairman Turner disagreed due to the location of Rockwell Apartments and traffic concerns on Highway 181. Art Dyas was concerned about having only one ingress/egress, only being able to make a right turn, and then having to make a U-turn on Highway 181. Rebecca Bryant stated the Commission would like to see more landscaping and usable greenspace. Chris Williams, City Attorney, asked if Doug Chaffin with Sawgrass, was willing to table this case. Doug Chaffin replied that he wanted to table. August 2, 2021 Planning Commission Minutes 6 SD 21.35 Public hearing to consider the request of Craig Homes, Inc. for plat approval of Point Clear Creek Estates. Property Owner/Applicant: Craig Homes, Inc. General Location: South of the intersection of Polo Ridge Boulevard and Willow Bridge Drive Project Type: 3-Lot Minor Subdivision Project Acreage: 3.09 acres Zoning District: Unzoned PPIN Number: 46610 Surveyor of record: Seth Moore School District: Fairhope Elementary School, Fairhope Middle and High Schools Report prepared by: Samara Walley, City Planner Recommendation: Approval with Conditions Summary: City Planner, Mike Jeffries presented case summary: The proposed subdivision does not include installation of infrastructure or any improvements therefore, a street, landscape, and tree plan are not required. Existing drainage flow patterns are not changing. A traffic study was not required, but a variance from installing sidewalks was requested. Staff recommends including a sidewalk easement on the plat. Recommendation: Staff recommends APPROVAL SD 21.35, Point Clear Creek Estates, subject to the following conditions: 1. Revision of the plat to illustrate a sidewalk easement along Polo Ridge Boulevard. Hunter Simmons, Planning and Zoning Manager, stated that they did not want to require three sidewalks to be put in that are not going to go anywhere because the area around the lots is not developed. Chairman Turner stated that an easement was a great idea. Seth Moore with Moore Surveying stated that he would be glad to put an easement in. Chairman Turner opened the public hearing, no one spoke, the public hearing was closed. Motion: Jimmy Conyers made a motion to approve Case SD 21.35, Point Clear Creek Estates, subject to staff recommendations. August 2, 2021 Planning Commission Minutes 7 SD 21.37 Public hearing to consider the request of Dominion Senior Living of Fairhope, LLC for Preliminary plat approval of The Reserve at Fairhope. Property Owner/Applicant: Dominion Senior Living of Fairhope, LLC General Location: West side of Highway 98 between Volanta Avenue and Dyer Road. Project Type: 169-Unit Multiple Occupancy Project Project Acreage: 16.6 acres Zoning District: PUD PPIN Number: 386193 and 386197 Engineer of record: Jade Consulting, Inc. School District: Fairhope West Elementary School, Fairhope Middle and High Schools Report prepared by: Hunter Simmons, Planning and Zoning Manager Recommendation: Approval with Conditions Summary: Hunter Simmons, Planning and Zoning Manager, presented case summary: The project includes 169 units, consisting of 84 Independent Living, 33 Assisted Living, 32 Memory Care, and 20 Independent Living Cottages. The site will feature amenities that include, but are not limited to, a golf putting green, pool, clubhouse, and walking trails/sidewalks. All connections and work in ALDOT ROW will require permitting from ALDOT. Utilities within Fairhope ROW will require permitting from The City of Fairhope Building Department. Water, Sewer, Power, and Gas will be provided by Fairhope. No wetlands were found on site. The drainage travels generally north to south. Most of the storm water will be collected in two dry detention ponds with sand filters. Post-development run-off is shown to be less than pre-development runoff. 4.86 acres of greenspace are provided. The applicant plans to install all site work and infrastructure first, followed by the construction of the main building on the north side of the property, and finally the cottages located to the south. As part of the PUD, the applicant agreed to provide a signalized crosswalk south of the property at the existing street crossing of Volanta Ave. The specs will be approved by Richard Johnson prior to issuing construction documents. Internal roads will be private Recommendation: Staff recommends APPROVAL SD 21.37, The Reserve at Fairhope, subject to the following conditions: 1. Traffic improvements recommended by the Traffic Study and/or ALDOT will be installed by the Developer, or under an aide to construction/MOU with the City of Fairhope and/or ALDOT prior to C.O. 2. Road names shall be approved by Baldwin County E9-1-1. Addressing will be provided by the City of Fairhope and shall be complete prior to submittal of building permits for vertical construction. 3. Final location of the culvert under Hoyle Ave shall be approved by Richard Johnson, with the City of Fairhope Public Works. Hoyle Ave is an existing ROW. The signalized crosswalk shall be approved by Richard Johnson, with the City of Fairhope Public Works. 5. Final placement and aid to construction costs for all utilities shall be approved by the respective superintendent. Aid to construction costs shall be determined prior to application of building permit. 6. Stormwater Maintenance Agreement shall be signed and provided to the City by final plan approval. After final plan approval the Stormwater Maintenance Agreement shall be recorded with Baldwin County Probate. Commissioners had concerns regarding the traffic study that was provided. Trey Jinright with Jade Consulting stated that this project will add minimal traffic. He also mentioned that the site plan that was submitted was identical to the PUD plan and there is a pond that will catch water and they can provide an additional detention pond at the end of Hoyle Ave. if allowed. This water will enter the gully and drain into the bay. The ponds are big to avoid gully erosion. Rebecca Bryant asked if there would be a buffer between this project and residentially zoned properties to which landscaping buffers will be provided. Considering future development, she suggested that the buffer be more than cypress trees to possibly include a fence as well. Chairman Turner opened the public hearing, no one spoke, the public hearing was closed. Motion: John Worsham made a motion to approve Case SD 21.37, The Reserve at Fairhope, subject to staff recommendations. Small Cell Antenna – September 9, 2021 Summary of Request: Request of AT&T for an 11.52.11 Utility Review and approval of the proposed installation of a metered small cell antenna in the City of Fairhope’s ROW. The installation will be one location indicated on the map in Fairhope. This small cell antenna will be co-located on an existing utility pole. Comments: The proposed utility construction is consistent with a previously approved AT&T Mini Cell Approved Project (October 7, 2019). The comments below are typical general comments for City of Fairhope right-of-way projects. Any portions of the project affecting public right-of-way (ROW) maintained by Baldwin County or the Alabama Department of Transportation (ALDOT) shall require permits through the Baldwin County Highway Department or ALDOT. AT&T has been very cooperative, they have co-located small cell antennas when possible, and have been very receptive to all of staff’s comments. Site descriptions and locations (Please refer to the map on cover page): 1. Co-location on existing AT&T utility pole on the south side of Volanta Ave. Across from the Fairhope Yacht Club. a. Equipment/antenna to be brown in color to blend with surroundings. GENERAL COMMENTS No open trenches shall be allowed. Directional boring shall be used in sensitive areas, such as under roads, in proximity to trees, on finished lots, etc. All information provided have been reviewed with the Small Cell Ordinance No. 1679 SUPERINTENDENT AND DEPARTMENT HEAD COMMENTS The applicant shall contact Alabama One Call to locate all existing utilities. Public Works Standard Comments: • Handholes shall not be located within driplines of Heritage Trees (as defined by the Tree Ordinance). • Any proposed trenching shall not be within the dripline of trees. • If within a tree dripline, consult with the City of Fairhope Horticulturist before proceeding with earth work. • Trees shall not be negatively impacted. The applicant shall provide profile drawings with existing utilities, and proposed utilities. Hand holes/boxes shall not be allowed to be installed in sidewalks. Any boxes/handholes cannot be placed in the sidewalk. The applicant shall review the sidewalk plan to determine if there are any conflicts. The applicant shall coordinate work with John Thomas ROW Inspector to resolve any potential conflicts. All conduit/cable shall be placed at depth from existing grade per industry and/or County Standards. A minimum horizontal and/or vertical clearance (separation) of 36” must be maintained from stormwater and utility infrastructures. No handholes, boxes, or other above ground infrast ructure shall be installed within drainage easements. Pedestals shall be placed in a manner as to avoid obstructing visibility of motorists and to allow vehicles to exit the roadway during an emergency. No grade change shall result from the utility installation. The applicant is to avoid any tree drip lines with handholes and equipment. 3 UR 21.0. Small Cell Antenna – September 9, 2021 If sidewalk panels need to be removed, the subgrade must be compacted to the satisfaction of the ROW inspector. Sidewalk panels shall be a minimum of 4000 psi and be inspected within 24 hours of pouring concrete. Anything over one sidewalk panel shall be poured via concrete truck (no bag mix allowed). Code Enforcement Officer’s Standard Comments: • The applicant, or subcontractor, shall obtain a ROW permit from the City of Fairhope Building Department prior to beginning work. • Subcontractors shall have a current business license with the City of Fairhope and shall always have a copy of the ROW permit available for review onsite. The permit shall be always posted on site or in the window of contractor’s vehicles. • Any ROW cuts shall be stabilized (covered) at the end of each day and disturbed areas sh all be re- vegetated with sod within ten (10) days of completion of the project. • Mulch / seed shall only be acceptable as temporary cover. • Sod shall be watered as needed to ensure survival. • Inlets shall be protected. (BMP’s shall be placed at all affected storm inlets.) • If site is within 100' of a critical area (wetland, etc.), red soils/clay shall not be allowed as fill material, per the City’s Red Clay/Soil Ordinance. Building Official’s Standard Comments: • BMP’s shall be installed at boring sites and trench locations. • Ground conditions in the ROW’s shall be returned to original preconstruction condition(s) or better. • All plans and permits shall be available for review at all times along with the City of Fairhope permit application. • If required, appropriate ALDOT or Baldwin County Highway Department permits shall be obtained prior to the issuance of a right-of-way (ROW) permit. • Contractor is advised to review and comply with the Building Official’s best practices flyer. Water and Sewer Standard Comments: • All existing utilities must be located, and proper separation shall be maintained between utilities. • All mechanical equipment shall be screened by painting the equipment Munsell Green. • No blue lined conduit is to be used for communication lines to prevent possible confusion with water service lines. Materials colors shall match APWA uniform color code. • Water and sewer mains/services must be potholed prior to bore crossings. If street cuts are necessary for potholes, please contact Right of Way inspector for restoration. Natural Gas Standard Comments: • Contractor shall provide proper separation from the gas main and all other utilities. The applicant is advised of the following: • No work shall begin until a ROW permit is issued by the City of Fairhope Building Department or other applicable jurisdiction. Permit not valid until approved and paid for on Citizen Serve online portal. • The ROW permit shall be kept with the contractor or subcontractor at all times during site work. The ROW permit shall be posted on the job site or in the window of contractor(s) vehicle. • All contractors/subcontractors are subject to City of Fairhope Business License procedures. 4 UR 21.0. Small Cell Antenna – September 9, 2021 This site shall comply with all State, Federal and local requirements, including, but not limited to the following City of Fairhope Ordinances: 1. City of Fairhope Small Cell Ordinance (#1679). City of Fairhope Wetland Ordinance (#1370), which regulates activity within 20' of wetlands. 2. City of Fairhope Red Soil & Clay Ordinance (#1423), which prohibits the use of red soil / clay within 100' of critical areas. 3. City of Fairhope Erosion and Sediment Control Ordinance (#1398). State and Federal permits shall be on file with the City of Fairhope Building Department, prior to the issuance of City of Fairhope permits. The applicant shall provide as-built drawings of all installed lines depicting exact depths. Recommendation: Staff recommends approval of UR 21.03 conditional upon the following: 1) The applicant shall follow the general comments related to utility work, as stated above. 2) Applicant and applicant’s contractor shall follow the Right of Way Installation Permitting and Work Procedures document provided by the Building Official. 3) The applicant shall follow the design/color for each site as dictated by staff per the “Site description and locations” section of staff report. 4) The applicant is responsible for any Aid to Construction costs for new utility poles or work needed to accommodate a co-locate. 5) The City of Fairhope reserves the right to modify or add requirements such as but not limited to cut sheets of proposed poles/fixtures, additional drawings, site locations, design/colors, etc. 5 UR 21.0. Also included is the request for approxim ately 149,636 linear foot of residential fiber generally located south of North Ave, north of Echo Ln, and west of Section St; on Volanta Ave east of Section St; and within the Plantation Pines Subdivision. Comments: The proposed utility construction falls within the corporate limits of the City of Fairhope. The comments below are typical general comments for City of Fairhope right-of-way projects. Any portions of the project affecting public right-of-way (ROW) maintained by Baldwin County or the Alabama Department of Transportation (ALDOT) shall require permits through the Baldwin County Highway Department or ALDOT. GENERAL COMMENTS No open trenches shall be allowed. Directional boring shall be used in sensitive areas, such as under roads, in proximity to trees, on finished lots, etc. SUPERINTENDENT AND DEPARTMENT HEAD COMMENTS • The applicant shall contact Alabama One Call to locat e all existing utilities. • Line locates are to be called in no less than 72 hours prior to commencing work. • Project is to be broken into phases, maximum of 750’ linear foot per phase. • A pre-construction meeting shall be held prior to commencing work. • Provide draft door hanger for approval at time of pre-construction. • All sewer crossings to be videoed or potholed for review by Water Department. • No new road cuts. Any road cuts allowed could require additional permit costs and shall be coordinated with Public Works. • No pneumatic boring under road surfaces. Public Works Standard Comments: • Handholes shall not be located within driplines of Heritage Trees (as defined by the Tree Ordinance). • Any proposed trenching shall not be within the dripline of trees. • If within a tree dripline, consult with the City of Fairhope Horticulturist before proceeding with earth work. • Trees shall not be negatively impacted. • The applicant shall provide drawings locating their utilities with other utilities and the sidewalks. Any boxes/handholes cannot be placed in sidewalks. The applicant shall review the sidewalk plan to determine if there are any conflicts. The applicant shall coordinate work with Richard D. Johnson, PE, Public Works Director, to resolve any potential conflicts. • All conduit/cable shall be placed at a depth from existing grade per industry and/or County Standards. A minimum horizontal and/or vertical clearance (separation) of 36” must be maintained from stormwater and utility infrastructures. No handholes, boxes, or other above ground infrastructure shall be installed within drainage easements. Pedestals shall be placed in a manner as to avoid obstructing visibility of motorists and to allow vehicles to exit the roadway during an emergency. No grade change shall result from the utility installation. 2 UR 21.04 C-Spire – Fiber Communication Installation – September 9, 2021 • The material under the sidewalk shall be compacted and the repair work shall be to the satisfaction of the Building Official or his designated representative. The applicant shall contact the Building Department for inspection prior to placing concrete. Code Enforcement Officer’s Standard Comments: • The applicant, or subcontractor, shall obtain a ROW permit from the City of Fairhope Building Department prior to beginning work. • Subcontractors shall have a current business license with the City of Fairhope and shall have a copy of the ROW permit available for review at all times, and shall be posted on site or in the window of contractor’s vehicles. • Any ROW cuts shall be stabilized (covered) at the end of each day and disturbed areas shall be re-vegetated with sod within ten (10) days of completion of the project. • Mulch / seed shall only be acceptable as temporary cover. • Sod shall be watered as needed to ensure survival. • Inlets shall be protected. • If site is within 100' of a critical area (wetland, etc.), no red soils/clay are allowed as fill material, per the City’s Red Clay/Soil Ordinance. Building Official’s Standard Comments: • BMP’s shall be installed at boring sites and trench locations. • Ground conditions in the ROW’s shall be returned to original preconstruction condition(s) or better. • All plans and permits shall be available for review at all times along with the City of Fairhope permit application. • If required, appropriate ALDOT or Baldwin County Highway Department permits shall be obtained prior to the issuance of a right-of-way (ROW) permit. • Contractor is advised to review and comply with the Building Official’s best practices flyer. Water and Sewer Standard Comments: • All existing utilities must be located, and proper separation shall be maintained between utilities. • All mechanical equipment shall be screened by painting the equipment Munsell Green. Natural Gas Standard Comments: • Contractor shall provide proper separation from the gas main and all other utilities. Additional Review Comments: The applicant is advised of the following: • Provide a Traffic Control Plan. • All utility markers shall not exceed 24” in height. • Provide Erosion Control Plan for large area disturbances. • Project shall be white lined, or white flagged for locators. • Contractor shall provide a point of contact for citizen questions/comments. • Dimensional drawings and specification sheets for all proposed handholes and boxes. • All contractors/subcontractors are subject to City of Fairhope Business License procedures. • The ROW permit shall be always kept with the contractor or subcontractor during site work. The ROW permit shall be posted on the job site or in the window of contractor(s) vehicle. 3 UR 21.04 C-Spire – Fiber Communication Installation – September 9, 2021 • No work shall begin until a ROW permit is issued by the City of Fairhope Building Department or other applicable jurisdiction (permit not valid until paid for and obtained by contractor). • A written notice (door hangers) must be distributed to each occupant affected by the proposed construction 5 days prior to any work commencing. • Contractor shall schedule post construction inspection upon completion to ensure restoration standards have been met. • No open trenches or pits allowed overnight without proper use of barricades, lighting, and fencing. This site shall comply with all State, Federal and local requirements, including, but not limited to the following City of Fairhope Ordinances: 1. City of Fairhope Wetland Ordinance (#1370), which regulates activity within 20' of wetlands. 2. City of Fairhope Red Soil & Clay Ordinance (#1423), which prohibits the use of red soil / clay within 100' of critical areas. 3. City of Fairhope Erosion and Sediment Control Ordinance (#1398). State and Federal permits shall be on file with the City of Fairhope Building Department, prior to the issuance of City of Fairhope permits. The applicant shall provide as-built profiles of the installed lines, showing the exact depth. The applicant shall provide full size plans (24”X36” or 11”x17” to correct scale) for this application and for future applications. Recommendation: Staff recommends approval of UR 21.04 subject to the following conditions: 1. Consultation with the City’s horticulturalist, to determine if the required depth of bore must be increased so that no trees are impacted by the project. The contractor is responsible for any damaged trees. 2. At all street crossing locations, conduct potholing to determine exact location and elevation of existing utilities. Reflect the exact elevation of utilities and GPS coordinates of the pothole locations on a set of as-built drawings. a. An additional right-of-way permit may be required for the potholing procedures. 3. Follow-up activities below required by staff and the applicant: a. Section Street – September 9, 2021 Summary of Request: The applicant, Craig Dyas, is requesting to rezone the subject property from R-4 Low Density Multi-Family Residential District to R-3 TH High Density Single-Family Townhouse Residential District. The property is approximately 0.40 acres and is located at the east terminus of Gaston Ave nue and on the east side of South Section Street, at 211 S. Section Street. The applicant has provided a narrative to justify their request. They state the following: “It is the desire of the petitioner/developer to rezone the referenced property from R-4, Low Density Multi- Family Residential District to R-3TH High Density Single Family Townhouse Residential District for the just reason as the title portrays; single family v. multi- family. Petitioner produced the same product adjacent to the east of the subject property with a ‘rezoning’ petition from R-2 to R3-TH in approximately 2003/4, the subsequent development having made a nice compliment to the neighborhood for it was much like the current neighborhood re: zoning and use. Petitioner wishes to restore the existing original ‘Fairhope’ townhome to current market conditions and construct two (2) additional townhomes of approximately 2000sq. ft – 2500 sq. ft. with elevations drawn to complement the existing ‘Fairhope’ architecture on the adjacent structure. The proposed site plan is included in this package and will be very close to the site plan developed in the 2003/4 at 204 Oswalt. The footprint of each new structure will be approximately 25’ x 50’ with ancillary appendages as a front porch and rear car shelter with the structure will likely being two (2) stories. The benefit of changing the zoning as requested is primarily the reduced front setback from 30 feet to 20 f eet. This will not only allow for the structures to set closer to the sidewalk (which developer intends to construct) but will allow for a comfortable placement of the car shelters onto the two (2) new townhomes. Further, this will allow for the keeping of a rapidly vanishing indigenous architecture (old Fairhope) in addition to placing two (2) new families to support the church district as well as the central business district, very probably by foot. Lastly, to retain the space as developer agrees to dev elop it, developer proposes to deed restrict the proposed zoning perpetually via deed restriction so that no future real estate philosopher will have the ability to change use or density. We appreciate the consideration of the both the Planning and Zoning Commission as well as the Fairhope City Council.” The above narrative was submitted by the applicant explaining the plans for future development if the subject property is rezoned. Comments: The subject property is bounded to the North by B-1, Local Shopping District, to the West (across South Section Street), East and South by R-2, Medium Density Single Family Residential District and to the Northeast by R- 3TH High Density Single-Family Townhouse Residential District. The Zoning Ordinance defines R-3 TH High Density Single-Family Townhouse Residential District as follows: 2 ZC 21.11 211 S. Section Street – September 9, 2021 “R-3 TH High Density Single-Family Townhouse Residential District: This district is intended to provide areas exclusively for the development of town houses on a high-density basis where no side yards are required.” The applicant submitted a site plan along with the application. It should be noted that this is not a site plan review, and a potential approval of the rezoning case does not constitute the approval of the site plan submitted with this application. Staff has, however, reviewed the site plan and has determined that the plan does not meet R-3 TH standards and would therefore require revisions prior to the issuance of a building permit. An administrative replat will be required to create one lot. Additionally, a Multiple Occupancy Project (MOP) approval will be required for 3 units on one lot. The MOP process takes in consideration greenspace requirements and design standards. Criteria – The application shall be reviewed based on the following criteria: (1) Compliance with the Comprehensive Plan; Response: It appears that the appears that the applicant has considered the overall density in the neighborhood, as addressed in the Comprehensive Plan. The applicant has also considered the overall character of the neighborhood. Buffers and landscaping may be required per the Zoning Ordinance. It is also important to note that if the property is recommended for approval by Planning Commission and approved by City Council, it is possible that there will not be another public hearing.
