Special Meeting on July 18, 1983 at 5:00 p.m.
Present: Roy White, Chairman; members James Nix, Cecil Pitman
Robert Mason, Jack Kirk, Mary Doug Foreman and Robert
Lunsford, Zoning Official
Major Bashinsky came forward to speak. He told the Board that he
and Robert Fields owned Lake Forest Travel, presently located in
the Market Place in Daphne. That he would prefer to move it to
Fairhope and Mr. Brown being a friend offered his piece of property
for this use. He came before the Commiission today asking that the
front setback requirement be changed from 20 feet to 10 feet for
the property located next door to the post office awned by Mr.Brown.
He said he wished to build two 1200 ft. buildings facing Section
Street(he may not build both at first). Bob was asked what the
setback requirement is now on side. He replied none unless
abutting residential neighborhood. Mr. Bashinsky said his architect
was Derry Hargett. That he had a natural right of way with the alley
along the Masonic Lodge already there. Mr. Pitman asked how this would
line up with the other buildings there. Mr. Mason answered that
they would not be any closer to the line than any other buildings in
this block, and so moved to allow 10 ft. setback as requested. Cecil
Pitman seconded . Bob was asked if he had any comments and replied
that this is average with buildings there now. Motion carried unanimously.
At this time Mr. George Huddleston came forward addressing the Commission
for Mr. Matt Dial. He related the events leading up to Mr. Dial',s
present ooiplaint that the Seafood business being operated out at
Commercial Park Drive where he owns property is in violation of the
ordinance and he is seeking interpretation from the Planning & Zoning
Commission regarding what the Zoning Enforcement Officer has done to
rectify the situation. He is not satisfied that all that can be done
has been done. Mr. Huddleston showed pictures and map showing location
of building. He remarked that they have 3 refrigeration trucks that are
hooked up to outlets in the building that have been brought in because
the inside of the building is not large enough to operate the seafood
business he is trying to operate. Mr. White asked Mr. Huddleston why
they were before the Planning & Zoning Commission with this request,
that they were not sure that the Planning & Zoning Commission had any
say so in the matter at all. Mr. Dial said that he thought that the
people were in violation, that Mr. Lunsford was zoning enforcement
officer and in turn answered to the Commission. Mr. White said that
the land use is established by the Planning & Zoning Commission then
turned over to the Enforcement Officer for supervision of this use.
Further discussion led to Mr. White suggesting Mr. Huddleston filing
a brief with the Commission, Mr. Lunsford filing a brief with the Commiss
and they could study both presented and discuss further at next regularly
scheduled meeting of Planning & Zoning which is 1st week in August, the
lst at 5:00 p.m. that the Commission needed to study this before they
could respond and that they would seek an opinion from the City Attorney
as to whether or not this was something the Planning & Zoning Commission
could answer at all.
Jack Kirk moved that meeting be adjourned, Robert Mason seconded and
motion carried unanimously.
