HomeMy WebLinkAbout06-01-1983 Special MeetingThe Planning & Zoning Commission of the City of Fairhope met for a special meeting on Wednesday, June 1, 1983 at 5:00 p.m. PRESENT: Roy White, Vice -Chairman; members John Parker, Robert Mason, James P. Nix, Mary Doug Foreman, Harrell Holder, Cecil Pitman and Jack Kirk The purpose of the meeting to discuss the Planned Unit Develop- ment by Bay Breeze Developers, Inc. , THE HARBOR. Mr. White read a letter from Mr. Hodges setting out the intentio of constructing 160 private condominium dwelling units housed in twenty-two Villa type structures at their site located on the Northwest corner of Section Street and Volanta Avenue and is properly zoned B3b. Letter attached to minutes. Buddy Richmond said he was representing Mr. Hodges and would answer any questions, he showed the Commission members pictures & a drawing related to the project. Roy asked Bob Lunsford if he had studied the plans presented. Bob had written a commentar to the Commission and read same pointing out the five recommenda tions he noted. Harrell Holder asked if the previous variance granted by the Board of Adjustments did apply to new owners and Bob said yes. He also asked about the completion time projected Mr. Hodges responded that he hoped within a 36 month period and anything before that would be better. Mr. Pitman asked about how they were going to handle drainage during the construction. Mr. Patterson with Perry Hand Engineers, commented that there would be a provision in their contract that they would not cause any erosion or siltation into the Bay during construction. John Parker asked what warranted wanting to waive two story requirement to three story. He was answered that the site ideal for 3 story on area near street, that they would not have a view problem if 3 stories used and slope ideally suited for this type it leaves more area for common landscaping. It was also pointed out that they were not over the density requirements. All questions satisfactorially answered, Cecil Pitman moved to recommend approval of plans submitted with Bob's five points noted: 1) Ord. Sec. 5.31 it being presumed that review as a planned Unit Development as per Sec. 5.1 supercedes Zoning requirements as to district. 2) Ord. Sec. 5.33 Provision of this section as to condominiums is diametrically opposed to condominiul concept and should be deemed inapplicable. 3) Ord. Sec. 5.62 Commission is authorized by Sec. 4.744(c) to permit 3 stories. 4) Incorporation of 3 unit model into PUD will require acceptance by Commission per Sec. 5.63. 5) Definite time for completion should be agreed and set forth in written agreement. This will go on to City Council for their consideration. Harrell Holder seconded and motion carried unanimously. Meeting was duly adjourned.
