monthly meeting April 4, 1983, at 5:00 p.m. at the Civic Center
Complex, 161 N. Section Street.
Present: Roy White, Cecil Pitman, John Parker, Harrell Holder,
James P. Nix, Jack Kirk, Cindy McBrearty, and Robert Mason.
Building Inspector Bob Lunsford and Consultant Don Pruitt
The minutes of the March 7, 1983 meeting were duly approved.
The public hearing on the re -zone application of Jerry Boyington
from R-2 to B-4 property located at 2 Pleasant Avenue was held.
Comments were called for from the audience. Mr. W.K. Hughes
addressed the members stating he and his wife were against this
as it seemed an encroachment on an established neighborhood.
Mrs. R.H. Johnson was also opposed. Harrell Holder mentioned
that we had a case less than a year ago on Berglin and Morphy
and it was turned down, one of the reasons being that we were usi
the streets as a boundary, and that his position was pretty much
the same as he feels that we hashed it out at that time.
Mrs. Pitman, a next door property owner spoke, relating the con-
ditions at the house at this time, stating that she felt they
were very inadequate. It was pointed out that several people
who had appeared at the last meeting spoke for the change. The
Commission mentioned to the residents present that they were
citing problems with the renter, not anything that the Commission
had perusal over. That these problems needed to be solved by
the Police or the owner, the Planning Commission was not the
answer. At this time Mr. Boyington spoke saying that there was
now business and professional offices located across the street,
that B-4 was the most restrictive, he named all for it, and that
he did not feel it was spot zoning but a logical buffer for this
area. He mentioned that there was 4-5 rental houses in this
block and maybe they should all be rezoned for business. Harrell
Holder remarked that -this was a good point, maybe the owners could
be contacted. Jack Kirk pointed out that Don Pruitt had mentionel
this should be handled on a case by case basis to have control
over what goes in there. Mr. White called for a show of hands
from those present who were for, or against the vote: for -10
against - 2. Harrell Holder moved to deny this rezone for the
reason that we have been using streets as a buffer. Cecil Pitman
seconded, and Commission voted unanimously to recommend denial
of rezone request to City Council.
The public hearing on the rezone request of Clyde Morris propert
from R-2 to B3b for the property located at 55 S. Bayview was
withdrawn. Lorena Gregorius addressed the Commission and men-
tioned that she had gotten some adverse comments about rezoning
to B3b and that Mrs. Morris dediced to withdraw and come back
later with a different request. The question was asked could we
accept this now for advertising for a public meeting at the next
meeting to R-4. John Parker remarked that it ought to be done
in proper order, that she should come back at the next meeting
with a new application, further discussion led to him making
a motion to adhere to procedure for zoning applications, Cindy
McBrearty seconded and motion carried unanimously.
Mike Wesley's subdivision request for two lots on the east end
of Equality Street(preliminary and final being sought)was dis-
cussed. Bob went over the memo he had prepared pointing out
three things that should be considered before approval given:
1. presentation of signed plat 2. revision of plat to provide
dedication & 3.note regarding lift system to sewer for access
to public main. Since this memo he has taken care of 3 points.

the sluffing that might take place on the property. That if
he wants to tackle this problem okey. J.P. Nix moved that if
the owner would sign a note that this problem of erosion existed
before the building permit was issued and the City will not
be held responsible in any way, that he recommended approval.
Harrell Holder seconded and motion carried unanimously.
At this time the Commission discussed having a study session
to express points on Bob's proposed changes to the ordinance
and subdivision regulations. A date of 4/20/83 at 6:30 p.m.
was suggested.
Bob brought to the Commission's attention at this time that it
had been reported that Windmere subdivision located in Montrose
has not been developed as plans submitted and approved, and
never recorded. Discussion led to Commission directing him to
further investigate to see what the situation is.
Walter Wilson approached the Commission with a rezone request
he was handling for Adrian Johnson from R-1 to R-4 for a piece of
property located on Edwards Avenue. He said Mr. Johnson could
not get ready by 10 day cutoff required for submittal of material
to be reviewed before meeting. He was wondering if Commission
might accept this application for advertising at the next meeting
Once again members got into discussion about doing things by
proper procedure and making exceptions to rules. J.P. Nix re-
marked that since we could not take any action at this time
he did not see anything wrong with going ahead and accepting
this and also Mrs. Morris' application and so moved to suspend
the rules to take action, further moving to accept the two
applications, Morris and Young for advertising for public hearing
at next regularly scheduled meeting. Harrell Holder seconded
and vote was for acceptance: Nix, Mason, White, Holder and Kirk
Against acceptance: McBrearty and Parker. Motion passed.
