January 11, 1983 at 5:00 p.m. at the Council Chambers of the
new Civic Center Complex.
Present: Richard Sanderson, Chairman; members James P. Nix,
Cindy McBrearty, Robert Mason, Cecil Pitman, Harrell Holder,
Roy White. John Parker arrived later as he was delayed by
airline connections. Also present were Bob Lunsford, Building
Official and Don Pruitt, South Alabama Regional Planning Com-
mission consultant.
The minutes of December 6, 1982 meeting were duly approved
on motion by Harrell Holder, seconded by Cecil Pitman and
unanimously carried.
The first item on the agenda being the public hearing on
the rezone application of Charles Dyas for a piece of property
located in the triangle area at the north entrance of town.
Mr. Don Bolton, an attorney from Foley addressed the Commission
and public outlining briefly what Mr. Dyas' proposal was. That
he had some 18 acres located in the triangle area that he wishe
to develop into a shopping mall. Ack Moore engineer for the
project said some 10 acres would be used for the mall and that
he had made a 45 minute rainfall study�,the r4sults being it
would increase the water flow from 16 to 33 not really adding
that much water. He said Mr. Dyas' options were to build a
detention pond or a trench with pipe to aid in run-off. Mr.
Bolton spoke again saying the difference in the rezone applica-
tion being made this time being that they only wished to
develop 18 acres and a substantial buffer zone would be
created between this project and the residential area. The
Chairman asked for comments from the public and at least a
dozen people from that area spoke and all were against the
project. Statements ranged from it would encourage more traffic
noise, to property devaluation, the extra run-off in Fly Creek
that couldn't be handled, spot zoning, and aesthetics. Also
that it would encourage this whole area becoming commercial.
Mr. Pruitt's comments were noted,he had remarked that denial
should be because it is not consistent with the City's com-
prehensive plan. After all had voice their comments Mr.
Sanderson said he would entertain a motion to deny, to approve
or to take under advisement. Harrell Holder moved to take
it under advisement, Roy White seconded but after further
discussion, withdrew his motion. Mr. Sanderson said he
would abstain from voting as he owned property in this area
and felt it would be a conflict. Harrell Holder then moved
to recommend to the City Council denial of this rezone request.
Cindy McBrearty seconded and the vote to deny carried by the
following vote: Nix; Mason, McBrearty, Pitman, Holder and
Parker. Against motion, White and abstain Sanderson.
The Commission after a five minute recess resumed the meeting.
The Commission accepted for advertising for a public hearing
at the February 7, 1983 meeting a rezone application of
Robert Van Iderstine from R-2 to R-3, the property located
on the corner of Nichols and Oswalt Street. John Parker
moved to accept this, Harrell Holder seconded and motion
carried.
Bob Lunsford brought before the Commission at this time a
preliminary and final subdivision application of Anacker Sub-
division. A further re -subdivision which was first presented
February 1982. This subdivision results in Lot D-2 measuring
145 X 300 feet with the remaining property retained in the
Anacker leasehold. Cindy McBrearty moved for approval, Cecil
Pitman seconded and motion carried unanimously.
Faye L'Orange's site plan for a 7-unit apartment complex
at 207 Magnolia Avenue that was continued from the last
meeting in order to get a drainage study prepared was
considered again. Dick Sanderson mentioned that zoning
was not an issue that this property was zoned correctly
for what is being planned that we were only considering
the drainage question. Buddy Richmond addressed the Com-
mission members and told them thatthey had planned
to install drywells and they had rerouted the driveway to
conform to natural site contours. That there would be
a 13.2% laid coverage as opposed to 30% allowable. That the
drywells should handle any water that did not soak in and
it would be run to Magnolia Avenue not Church Street. The
Commission felt that some assurance should be given that
the drywells would be maintained. It was mentioned that
the restrictive covenants should contain a clause as to
maintenance.t�ilsb, the drywells would be designed by a certified
engineer, butkfelt his clients would be agreeable to having
an independent engineer review the plans. Further discussion
led to Harrell Holder moving that we have Mr. Lunsford receive
the engineering data and have it reviewed at developer's
expense by a registered engineer. Cindy McBrearty seconded
Mr. Richmond said he saw no problem with that, and motion
carried by the following vote, Sanderson, Nix, McBrearty,
Kirk, Mason, Pitman, Holder, Parker, with Roy White abstaining
to vote.
The Commission accepted for advertisement for public hearing
at the next meeting a rezone request from Bill Pipkin
from R-2 to B-4 the property located at the Southwest corner
of Fairhope and Pleasant Avenues. Motion was made by Roy
White, seconded by Jack Kirk and unanimously carried.
There being no further business, meeting was duly adjourned.
