HomeMy WebLinkAbout05-03-1982 Regular MeetingThe Planning & Zoning Commission of the City of Fairhope met at 5:00 p.m. at the City Administration Building, 387 Fairhope Avenue on May 3, 1982. Those present: Chairman Pierce Frederick; members, Dick Sanderson, J.P. Nix, Roy White, Cindy McBrearty, John Parker, Cecil Pitman Harrell Holder, E.J. Kirk. The minutes of Ithe April 5, 1982 meeting were considered and approved on motion by Jack Kirk, seconded by Harrell Holder and unanimously carried. The Public Hearing on the property bound by Young Street and Middle Street abutting B-1 property, involving some 2.5 acres, for a zone change from R-2 medium density single fami dwelling to B-1 local shopping district was held. This came about as a result of a rezoning effort of Mr. Louis Agee who owns a parcel at the corner of Young Street and Middle Street and wished to change to B-l(parcel was previously zoned R-2) and construct a building housing several businesses. Mr. Agee's rezone request had been before the Planning & Zoning Commission and a recommendation sent to Council. When Council reviewed it, discussion led to a recommendation to rezone the whole block(Nichols to Middle) B-1. This Council sent back to P & Z Commission and the public hearing to be held this date. At this time, the Council asked for comments. Mr. Agee came as spokesman and presented to the Commission a petition of 31 names(all property owners) that are for the change. There were only 3 other people present regarding the matter and they were for it. Harrell Holder moved to recommend zone change to the City Council, seconded by Cecil Pitman and unanimously carried. Ack Moore came before the Commission at this time to discuss reducing a 20 foot utility easement to 72-8 ft in Wild Oaks subdivision. He told the members that Carlton Niemeyer and Malcolm McLean had dedicated a 20 ft. utility easement at the back of Sibley Square(backs up to Wild Oaks) when they developed it. Therefore, a reduction at this time would not be hurting anyone. Discussion led to John Parker moving to revise the plat to eliminate the utility easement on Wild Oaks South boundary. Further discussion brought out that an easement of some kind might be needed in the future. Roy men- tioned he would like to take a look at it before the Commission acted, therefore it was decided to carry this over a month. Mr. Parker's motion was withdrawn and a decision given at the June meeting. J.P. Nix asked the Commission to consider again the request from the FSTC to extend the CBD to include blocks 8 & 11 FSTC land Fairhope Avenue and Summit St. He went over circum- stances leading to this request. After all discussion, the Commission felt that they had covered this request thoroughly at the last meeting, and they did not wish to change their minds. No further action was taken. Under old business, John Parker asked what had been done recently as far as getting the land use plan going. Don had nothing new to report. He said Bob was reviewing some maps and when he was able to get them back to him we could get together for a study session and act further. Planning & Zoning Commission May 3, 1982, Page Two Roy White reported to the Commission at this time about some seminars he attended at the National League of Cities Convention on Planning Zoning and Development: Antitrust Risks for Cities and How to Guard Against Them. He said he thought it would be very interesting for each Commission member to read this material furnished him and would get a copy to each member. All seemed eager to read up on this and the role the City P & Z Commission would play. Mayor Nix's recent election as President of the Alabama League of Municipalities was mentioned, and what an honor this was for him as well as for Fairhope. There being no further business, meeting was duly adjourned.
