HomeMy WebLinkAbout11-02-1981 Regular MeetingI II III IV The Planning & Zoning Commission of the City of Fairhope met November 2, 1981 at the City Administration Building 387 Fairhope Avenue, Fairhope Alabama at 5:00 p.m. Present: Chairman Pierce Frederick; members Roy White James P. Nix, Cindy McBrearty, Harrell Holder, Cecil Pitman, Jack Kirk and John Parker The Commission considered the minutes of the September 8, 1981 meeting and on motion by John Parker moved that they be amended to show that a committee was appointed to study the Town & Country subdivision. Committee being Bob Lunsford, Roy White and John Parker. Harrel Holder seconded and motion carried unanimously. Cecil Pitman moved and Roy White seconded they be approved as amended , motion carried unanimously. The Commission members considered at this time a name change request from Mr. Robert P. Janssen who owns some property at the end'of Nichols Street where a three unit warehouse has been constructed. He asked that it be named Janssen Way or Janssen Street. At the time the letter was received we could not find where this road had been named. Since then, we found a plat with the name Grand Blvd on it. Cecil Pitman moved that the Secretary write Mr. Janssen a letter stating that the street is already named and his request is denied. John Parker seconded and motion carried unanimously. Cumbie's Corners subdivision application was discussed. Mrs. Cumbie was present to tell the Commission that this is a resubdivision of one lot into three. This had come before the Commission at the October 1980 meeting and had been denied. Mrs. Cumbie remarked that this had been redrawn to fit requirements. Mr. Pruitt's comments were noted, and James P. Nix moved to grant preliminary approval and final approval subject to the 75 feet setback line being drawn on the final plat to be signed by the secretary. John Parker seconded the motion. Roy White asked if this shouldn't be held up until the Section Street project is completed. Don Pruitt said he did not think this would be a problem as there are already two existing houses there. Mr. Joe Miller was present and was the person planning to build there but said he thought it would be a year before he could. The project should be completed by then. A vote was called for and the motion passed unanimously. The subdivision of Mike McDowell, Mike's Acres was brought to the Commission at this time. Mr. McDowell was present and told the Commission that this was a subdivision of some 4 acres located on the west side of Bal.dwin Cty Hwy 27 FSTC property that use to be the Rudy Rezner leasehold. He wishes to divide it into two lots. He had approval from the Baldwin County Health Dept. and the FSTC. Roy White moved that he be granted preliminary and final approval subject to the engineer showing a vicinity sketch on the final plat as required, John Parker seconded and motion carried unanimously. W A discussion on the Zoning Ordinance amendments was held at this time. James P. Nix referred to his letter of September 10 where he asked that the Planning Commission reconsider the two amendments; one regarding curbings, and two the issuance of building permits being the respon- sibility of the Building Inspector(this for commercial property) if development meets the requirements as set o-ut in the zoning ordinance. He went on to say that curbs should be 'required in parking lots because 2f this is an option with the developer, he will not put them in. That in looking around, that every well kept landscaped area had solid curbing around it. Mr. Parker remarked that he thought the Commission had gone into his recommendations at the September meeting and worked this out. Mr. Parker read the portion on curbings as proposed and said that the water being returned to the ground had merit too. Further discussion led to Commission agreeing to go with the following revision: 6.946 Curbings: Solid, raised curbs shall be installed for protection of landscaped areas and along parking stalls to control traffic flow within the parking lot. Where necessary for control of surface drainage, pipe through the curbing at grade level shall be provided as needed to water landscaping. John Parker also answered having the Building Inspector issue the building permits for commercial development without Commission review. He expressed that it would be beneficial to the City for the Commission to review these plans and give input to the City Council, that by not reviewing them it put a great deal of pressure on the Building Inspector. That the time element was not a problem, as the Commission would be glad to accomodate developers, that this had been voted on in the referendum and he felt that it should stand as it is, that nine heads were better than one. Mr. Nix responded that it is the Commission's duty to set up rules and regulations, that he had complaints that the developers had been browbeaten, that they felt they had to go along with suggestions in order to get their development approved Roy White asked if there was some way we could keep the Commission involved and give the Building Inspector authori. to issue permits. Several more comments were made, one being that the Commission offered more than what was down in blacl and white, that they would feel completely left out if some. one was to ask what was being developed in a certain place and they had not reviewed the plans. It was suggested, afte- much discussion, that a statement could be made to the deve oper that he only had to follow the requirements set out in the ordinance, that all else was a review to see that everything was in order and suggestions. At this time Mr. Parker moved that the amendments as discussed 6.946 and 7.232 Issuance of Permits,plus 6.5151 and 60.312 be adopted and forwarded on to Council with our recommendation. The Commission stated a desire to vote on these one at a time. Mr. Parker withdrew his motion. Mr. Parker then moved to adopt 6.946 Curbings, J.P. Nix seconded motion carried unanimously. Roy White moved that Section 6.5151 adding Provided, however, that a covered walkway, open along the sides, may be used to connect a detached accessory to the main building for protection from inclement weather, be adopted, JPNix seconded, motion carried unanimously. Also Roy White moved, seconded by J P Nix to revise 60.312 to read: No travel trailer, hauling trailer, utility trailer boat or boat trailer, motor home or commercial vehicle more than 24 feet in length shall be parked or stored in the froi yard(or, on corner lots, in a side yard abutting a public street) of any lot nor upon the street right-of-way. motion carried unanimously. it John Parker then moved to add to the proposed 7.232 Issuance of Permits, the sentence- The chairman will ci e� the applicant thtr�evit� „by the Commission is o an advisory nature, an etpurpse is or t e Commission to provide input and have an exchange so as to recommend a more functional development. But, final approval rests with the Building Inspector and the only provisions that the applicant has to comply with are those provisions in the Zoning Ordinance. Harrell Holder seconded and motion carried unanimously. All of the above amendments being approved and forwarded on to the City Council for further action. Mr Lunsford questioned the Chairman as to what action the Commission wished him to take regarding Louis Girdler's issuing a building permit, as the last time it was discussed he was asked to come back before the Commission. There was not a definite answer given, just the impression that he was to handle it. Meeting was duly adjourned.
