HomeMy WebLinkAbout08-03-1981 Regular MeetingI IIl IV The Planning & Zoning Monday, August 3, 1981 Building, 387 Fairhope Present: Pierce Cindy McBrearty, John Parker Commission of the City of Fairhope met at 5:00 p.m. at the City Administration Avenue. Fairhope. Alabama. Frederick, Cecil Pitman, Jack Kirk, Roy White, Harrel Holder, James P. Nix, The minutes of the July 6 1981 meeting were approved as written. The Adalade Malone rezone recommendation was brought up. The Chairman expressed surprise, as he thought that after Council consideration the matter would be settled. He read the portion that recommended it back to the Commission page 87 of the Zoning Ordinance Section 7.54. Harrell Holder remarked that he thought everyone was in agreement when the recommendation to deny was submitted to the Council, and he could not see where anything had changed. Don Pruitt's recommendation had not changed, it was still spot zoning. Mr. Parker remarked that this was a matter of courtesy since the Council action was going to be different than what recommended by the Commission. Harrell Holder again mentioned that in the.future this might be pointed out as a precedence. Roy White gave an analogy of how the cir- cumstances came about leading up to case coming up. After all had given their opinions, the Chairman said he would entertain a motion, and Harrell Holder made a motion to deny the rezone application request and so inform the City Council of Commission' recommendation. Cindy McBrearty seconded and motion carried with the following vote: Aye -Parker, Holder, McBrearty, Pitman. Nay - Kirk, White . Don Pruitt remarked that he had talked to the County Engineer and Development Director for the County but they had not respond- ed as to whether or not we could coordinate subdivisions being developed outside the City Limits with County acceptance of roads. Mr. Pruitt in the absence of any response suggested that in the future the Commission require all subdivisions to contain and be developed a street network built by City specifi- cations and to notify the developers of this requirement. It was suggested sending applications for subdivisions on to the County as soon as they are submitted in hopes of getting County approval before Commission gives final approval. Mr. Parker re- marked it would be ludicrous to approve subdivisions without County approval of maintenance. it was asked how it is working now, and remarked that the County is suppose to supply us with any transfer of land within a'five mile radius of the City. Roy White made the observation that this is not being followed close: as he could name a number of cases of violation. No decision wa: made as to how to better work it. The Commission voted to hold a study session Thursday August 20th at 6:00 p.m. to consider zoning ordinance changes suggested and land use determination. At this time, Louis Girdler came before the Commission with a site plan for multi -family units. Property located between Miller, Volanta Street and fronting on Section Street, and is zoned B-4(Russ Kilgore property). All eight lots of Mr. Kilgore's are involved in this development to contain some sixteen townhouse units. John Parker commended Mr. Girdler on planning not to have any egress/ingress on Section Street. Mr. Girdler mentioned that the developer had every intention of trying to hide the development from public view on Section St. IV cont Planning & Zoning Commission-8/Z/81-page two probably having.a privacy fence if there was not enough density from the foliage. That they planned to use only sixteen percent of the area for buildings. The outside of the buildings to be b- and siding, of different shapes/sizes. Mr. Parker asked if this was a building permit application, and it was determined it was. The drainage was discussed, with note that Mr. Girdler remarked that he would like to keep it natural, that he wished to carry part to Miller Avenue and the rest to Volanta. Discuss ion led to the Commission conveying to Mr. Girdler that they wished the drainage to run to Volanta. Mr. Parker put in the form of a motion that the Commission communicate approval to the Building Inspector regarding the review of the permit subjec to the preliminary plan presented 8/2/81 indicating Volanta access only, and natural visual barrier on the East, South and West side of parcel and a 6 ft. fence on South and West side to control ingress/egress; and further that the northern 3/4 of the land area be drained to Volanta with a catch -basin and culvert established along the West property line from the indicated point North, and a natural visual barrier on Section Street. Mr. Girdler questioned whether fencing and screening came under the Commission's direction, and was told that it did. Harrell Holder seconded the motion and it carried unanimously.
