The Planning & Toning Commission of the City of Fairhope met
July 6, 1981 at 5:00 p.m. at the City Administration Building
387 Fairhope Avenue
Those present: Pierce Frederick, Chairman; Roy White
James P. Nix, Cecil Pitman, Harrel Holder, Dick Sander-
son, John Parker(arrived late)
Mr. Nix introduced Mr. Sanderson to the members of the Commission
The minutes of the June 1, 1981 meeting were approved as written.
Don Pruitt at this time made a report to the Commission members
on the meeting he and Bob Lunsford had with the County Engineer
on the County accepting roads in subdivisions outside the corpora.

He remarked that they had reviewed the State law, specifically
streets, and street improvements. They both agreed there should
be a better way of handling it, so that the subdivision plans
could be reviewed by both the city and county prior to the
Planning & Zoning meeting and coordinated. This could be accom-
plished by holding final approval of subdivision until we have
acceptance from the County. As a result of his meeting, he
handed out suggested amendments to the subdivision regulations
for them to study. Further discussion led to J.P. Nix putting in
the form of a motion having Bob L. and Don P. get with the
County Engineer before the next meeting so we could take some
definite action at that time. Harrel Holder seconded and motion
carried unanimously.
The Commission members considered at this time the preliminary
subdivision application of Seth Moore and C.B.Godwin on the
Fairhope Single Tax Corp. leasehold between Morphy & Fleming Rd.
A division of one lot into two, Mr. Frederick questioned whether
or not he had FSTC approval and septic tank approval. He remarke(
that he had tentative approval from FSTC(pending Comm. approval)
and he had septic tank approval. Mr. Parker questioned the con-
dition of Fleming Rd. He was apprised of Mr. Pruitt's comments
prior to his arrival, and that the road had been graded to at
least 50 ft pass the S.E. corner of this property. Ack Moore
interjected that there was a bond posted when the Fleming propert,
was approved. J.P. Nix moved for preliminary approval subject
to approval from the County Engineer accepting the road for
maintenance. Roy White seconded and motion carried unanimously.
Under old business Roy White discussed that several commission
members had gone down to the Town & Country Estate site at Parker
Road with Mr. Pope and as a result he indicated to them he
would go back to an original plan of thirteen lots with a holding
pond and change the entrance to the east end of the property.
Mr. Pope has not presented any plans at this time, so there was
no action taken.
Bob Lunsford brought to the Commission's attention that Rosa Acre:
Unit II had received final approval March of 1977 pending City
Council approval of the rezone application. This had been granted
approval but the original plat was not brought back for signing
and recording. Mr. Nix remarked that everything was in order
this had just been an oversight. John Parker moved to approve the
plat as presented, Harrel Holder seconded and motion carried unan-
imously.
In Mrs. McBrearty's absence, it was decided to wait to take actio
on her changes recommended for the ordinance. Bob Lunsford men-
tioned he had some proposed changes but suggested the two ought
to be discussed together. No action was required.

Carlton Niemeyer came before the Commission at this time to discuss
the proposed land use of the property north of town. Roy White
told Mr. Niemeyer that he, John Parker and Bob Lunsford had gone
up that way and discussed at length the proposal he had made on the
zoning for the area. Don Pruitt said he had not had the time
to make a study of the area. John Parker remarked that we owed
Mr. Niemeyer an answer as well as putting input into the City
Council if and when this comes up for annexation. Mr. White
questioned Carlton about his having permission of all the people
to annex, and also about some of his proposed zoning as most
all of the property around this area was zoned R-1. Also he had no
shown a designated zone for the bypass area on the curve at Hwy 104
Mr. Niemeyer remarked that he did not have a problem in getting
septic tanks for this land and also for using the property as he
is proposing it to be used. At this point Mr. Niemeyer told the
Commission he wished to withdraw his proposal and left.
Bob Lunsford brought to the Commission's attention that the Rosa
Acres Unit II site plan showed a common driveway between two units
and this did not conform with the Ordinance. Discussion led to
Mr. Moore remarking that he was only trying to save three driveways
but he sees that if he ever sells the property that he can see
where it would be a problem. He said he would take the site plan
back and redraw with the correct drives shown.
At this time the Commission voted to elect a Vice -Chairman. Cecil
Pitman nominated Roy White, Harrel Holder moved the nominations
be closed. Cecil Pitman seconded. The Chairman called for a vote,
and Mr. White was unanimously elected.
A discussion was held on section 809-Article VIII subdivision
regulations. It was pointed out that if we require developers
to install "oversize" improvements that the City has a responsi-
bility to participate in the cost. That the Commission members
should be aware of this provision in the Subdivision Regulations.
Also along this line, and discussion held at today's meeting,
John Parker moved that the Commission adopt the objective of
completing a recommended zoning map for the police jurisdiction
(3 miles outside city limits) for the City of Fairhope by the
end of October. Roy White seconded and motion carried unanimousl
