HomeMy WebLinkAbout05-04-1981 Regular MeetingThe Planning & Zoning Commission of the City of Fairhope met May 4, 1981 at 5:00 p.m. at the City Administration Building 387 Fairhope Avenue. Present: Chairman Pierce Frederick; members Jack Kirk Roy White, Cecil Pitman, John Parker, Cindy McBrearty Harrel Holder. The minutes of the April 6, 1981 meeting were approved on motion by E.J. Kirk, seconded by Harrel Holder and unanimously carried. The Board considered the rezone application of Mrs. Adalade Malone from R-2 to R-3 the property located on Bergundy Lane between Church Street and Boone Lane. Roy White moved to advertise for a public hearing to be held the first of June, 1981. Jack Kirk seconded the motion and it was unanimously carried. The continued application of Mike Ponder for preliminary plat approval on Battles Landing was discussed., Mr.. Ponder addressed the Commission remarking that if he was required to conform to the restrictions set out in Mr. Pruitt's comments, which were 1. submit revised subdivision plans reflecting lot sizes recommended by those members present at the 4/23/81 meeting. (9500 sq ft, min lot width of 70 ft at building setback line; minimum side yards of 10 ft on ea side and that the required front and rear yards should be a minimum of 35 ft.) 2. submit copy of deed restrictions or restrictive covenants. 3. Have a letter from the City of Fairhope granting permission to connect to the existing sewer.line in Carmel Square. that it would kill his project. He remarked that he is in compliance with the zoning ordinance and asking that he be granted preliminary approval. Roy White related to the Commissio members what the Council had felt, in that they had to serve the Ci�zy- tax payers first they had reached a point they had to stop and consider the capacity of the present system. Mr. Parker remarked that we needed to act on the subdivision as presented. Mr. Lloyd Taylor representing Mr. Ponder remarked that since Mr. Ponder was in compliance with the zoning ordinance that he did not see how the Commission could do anything but grant him preliminary approval. Mr. Pruitt remarked that since the Council had put a moratorium on outside sewer connections that Mr. Ponder would have to conform to lots with septic tanks which requires 15,000 sq. ft. and this was not depicted on the plans we had. He was asked what was the result of the area survey he and Mr. Lunsford had done. He said that they did not come up with any clear cut recommendations. Just what was set out above as a result of the 4/23/81 meeting. Mr. Taylor said that the Commission did not have the authority to set lot size out of the City'Limits. This being true, but if a developer wishes to tie in with City Sewer, he must make known his zone intention and develop as if already in the City Limits, and agree to annex as the City Limits becomes contiguous to this property. John Parker remarked that the City Council expected input from the Commission, and since it had put a moratorium on outside tie-ins we would have to assume that the sewer would be handled on the spot. He therefore made the motion to deny the application as tendered, as the necessary square footage was not available as per subdivision regulations nor plans showing this, nor certification from the County Health Office showing approval. Harrel Holder seconded and motion carried by the following vote: Jack Kirk, Roy White, John Parker, Cindy McBrearty, Harrel Holder. ABSTAIN'- Cecil Pitman. Page two Planning & Zoning Commission Meeting May 4, 1981 At this time the Commission members considered a proposed drawing of the map of the Fire District No. 1 for the City of Fairhope prepared by Bob Lunsford. All thought this is a good change and John Parker put in the form of a motion recommending to the City Council redefining the boundaries of Fire District No. 1 as depicted by the en- closed map with the amendments of Oak & Bancroft(already drawn in). Harrel Holder seconded and motion carried unanimous Carlton Niemeyer showed the Commission members a sketch map of an area North of town with different zone classifications drawn. He was seeking input from the Commission as to whether or not they were in agreement with his zoning plans. The Commission members agreed that this would take more than a few minutes to discuss, therefore Harrel Holder moved to take this under advisement, Cindy McBrearty seconded and motion carried unanimously. As a result of Mr. Niemeyer's sketch presentation, a study session will be held sometime in May as a result of a land use study done by Mr. Pruitt and Mr. Lunsford in this area.
