met December 18, 1980 at 5:00 p.m. at the City Administration
Building, 387 Fairhope Avenue, Fairhope, Alabama
Those present: Ted Bennett, James P. Nix, Harrel
Holder, Roy White, Pierce Frederick and Jack Kirk
The special called meeting was to discuss the subdivision
application/building permit application of Marshall T.
Nelson for the property located on Bon Secour Avenue
It was an application to subdivide one lot into two located
at the Northeast corner of the De Ferriet Grant Section 37.
There was no one present who objected to the planned re -
subdivision. Mr. Bennett asked Mr. Lunsford if everything
was in order or did he have any comments to make regarding
this application. Mr. Lunsford remarked they had health
department approval and that the footage requirements were
met, everything was in order. Harrel Holder moved we
grant approval, Pierce Frederick seconded and motion carried
unanimously.
Roy White moved for adjournment, Harrel Holder seconded and
by unanimous approval meeting was duly adjourned.

Dear Chairman and Members of the Board,
According to the Planning and Zoning Ordinances, off-
street parking is required for all new construction
except in the downtown business district. Please clearly
define that area of the downtown district that does not
require off-street parking.
Also, it would be helpful to clearly define the "Fire
District or Districts" and indicate these areas on a
map available to public view.

Dear Ms. Newman:
In reading the March 24 issue of the Courier, I noticed in the Legal
Advertising Section that Mr. Kilgore has applied for rezoning of lots
11, 12, 13, 14, 15, 16, 17, and 18 in Block 6, Volonta, A Subdivision
in Fairhope, located in Map Book I, Page 34 from R-2 to B-4. This
application greatly concerns my wife and I as our property faces
Miller Ave and borders on the West side of his property. Our property,
which has been in my wife's family since the late 19301s, is located
in a quiet secluded area and we would like for it to remain this way.
Since we presently live in Warner Robins, Georgia, and will be unable
to return home at this time to attend the meeting, we present the
following evaluations and comments.
Rezoning the property and building business and professional offices in
that location will cause both traffic and drainage problems and most
probably will devalue the surrounding property. With the grade of
Volonta Ave, it is very difficult to see whether it is safe to enter
onto Section Street without first running your automobile almost to the
crest of the hill. Eveh then your view is limited because Section Street
slopes both ways from the crest. Trying to enter Section Street from
Miller Avenue is also difficult and sometimes dangerous because Miller
Avenue is only approximately 200 feet from the crest of the hill and
the traffic very often exceeds 40 miles per hour in that region. Suggest
the Commission Members contact the City Police Department to verify this
evaluation.
Since the slope of thelland is toward our property, any clearing and
paving of the lots to the East of us will only increase the water flow
over our property and down Miller Avenue. The drainage problem is
already bad to severe during heavy rains; therefore, we cannot tolerate
any construction that will increase the problem.
Our property has already suffered damage and devaluation because of
Hurricane Frederick and any construction of offices will no doubt further
devalue our property. In addition traffic in and out of the area will
increase the noise pollution problem already caused by traffic on Section
Street.
We strongly urge the Planning and Zoning Commission Members to seriously
consider all the problems that will be created by allowing offices to be
constructed on the lots mentioned previously and the adverse impact it will
have on the surrounding residential area before voting on the rezoning
application.
In view of the above mentioned problems including property devaluation and
our desire to have this area remain zoned for residential purposes, we
object to the rezoning application. We also desire to have this letter
read during the meeting and the content entered into the minutes of the
meeting scheduled for April 7, 1980.
I would also like to bring to your attention that the Public Hearing
Notice was dated March 19, 1980; but was not mailed to us until March 31, 1980.
It appears that such notices should be mailed to all concerned persons,
including Commission Members, in time to allow each one to review and evaluate
the contents a minimum of 10 days prior to such an important meeting.
