of October, 1980 at the Police Department at 5:00 p.m,
Those present: ,Ted Bennett, Acting Vice -Chairman; John Parker
Pierce Frederick, Roy White, Jack Kirk, Cecil Pitman
The minutes of the September 8, 1980 meeting were considered and approved
on motion by E.J. Kirk, seconded by Pierce Frederick and unanimously carried.
Seth Moore addressed,the Commission on behalf of Moore Engineering who is
the representative for Mattie CLmbie's subdivision request. Property located
on South Section Street close to Fairhope Corporate limits. Ms. Cuambie
wished to subdivide an acreage parcel into four lots. As presented, the
proposal did not comply with footage requirements of the Zoning Ordinance.
Mr. Pruitt had recommended denial as presented, combining lot 3 and 2 into
one lot and sell loth. Mr. Parker moved to deny the application as submittedc
and offer guidance as per Mr.Pruitt's comments. Cecil Pitman seconded and
motion carried unanimously,
Mr. Tracey Girdler came before the Commission seeking a building permit to
build an apartment on top of a one story building at the Chateau Royal
Apartments located on South Mobile Street. Discussion brought out that the
Planning Commission did not have the right to grant waiver on the density
requirement therefore he would have to go before the Adjustment Board.
Mr. Parker directed him to the Adjustment Board, without a recommendation
for approval, Pierce Frederick seconded and motion carried unanimously.
Mr. Mack Water's rezone application was discussed. He wished to build a
C.P.A. office on piece of property on the East side of Section Street
between Miller and Frederick Streets, property now zoned R-2 wishes to
change to B-4. Mr. Pruitt said he could not comment until he had observed
the site. It was recommended that Mr. Waters apply through regular charnels
by making a rezone application formally with the Planning & Zoning Commission.
Mr. Steve Dunham came forward representing Jack Pope and his subdivision
Twin Echo Estates. This had been carried over from the last meeting as a
result of the Planning Commission seeking guidance from the City on an
overall drainage plan for the City and Big Head Gulley drainage problems.
A meeting between the Cannission and the City Council had been held but
there were no definite answers given other than Ack Moore is making study
for the City . John Parker recommended that this be carried over once again
with the agreement of Mr. Pope's representative, Mr. Dumnam. Jack Kirk seconded
and motion carried tmaninKxmly.
Bob Pope came before the Commission in regards to the building permit he
is seeking to add on to the restaurant on the municipal pier. Mr. Pope
was told that the Planning Commission is solely interested in zoning
ordinance requirements, that all else lies in the hands of the City Council
this being a Flood Hazard Zone, and what he is proposing might jeopardize
the Flood Insurance Program. Mr. Pitman recommended that the City Council
look in favor on his,plans subject to him getting the proper response on
the Flood Insurance Program. Jack Kirk seconded and motion carried.
Mr. George Stejskal came before the Commission for discussion of the building
of an auto parts shop on the vacant lot next to Carey & Mike's Car Lot on
East Fairhope Avenue. A discussion followed on the parking requirements.
It was decided that 12 spaces were needed and Mr. Stejskal was directed to
come back with a drawing that comtplys with the ordinance and there would be
no problem.
Mr. Paul Roh, and Monsgr. Stuardi came before the Commission to discuss
a parking lot the Catholic Church wishes to construct on their property
off of Section Street. Mr. Parker remarked that he had gone to look
at the property and that they had a good layout. The Board recommended
that retain their laridscaping ideas, eliminate extra 4 spaces shown on N. side
the drawing, shift the middle parking line over, and move a little further
west on the parking spaces shown. A question arose about the drainage that
might occur on Kirfmm and Boone Lane'. This led to the consideration of
shelling the area to prevent runoff on these two streets. Roy White moved
to approve the layout provided they use shelling instead of asphalt, John
Parker seconded and motion carried unanimously.
Robert Bacon came before the Commission to discuss a development being planned
at the Loyola Villa "site in Battles Wharf. This beigg, 86 units, 2 units to
a structure, 12 stories. It was remarked that he had assurance he could get
water and sewer service from the City. Mr. Parker suggested that Mr. Bacon
should plan along a R-4 zoning guideline and get the City Council to agree
with the sewer acceptance, Jack Kirk seconded and motion carried.
