HomeMy WebLinkAbout09-08-1980 Regular MeetingI II III The Planning & Zoning Commission of the City of Fairhope met oil September 8, 1980 at the City Administration Building 387 Fairhope Avenue, Fairhope, Alabama at 5:00 p.m. Those present: Chairman Leona Newman, members Jack Kirk, Jack Stipes, Cecil Pitman, Pierce Frederick, Roy White, John Parker The minutes of the July 10, July 22, and August 18 meetings were considered and on motion by Jack Kirk, seconded by Pierce Frederick were duly approved. The first item considered was the application of Moore Engineering, agent for Charlie Earle for final plat approval of a resubdivision of Lot 19, Greeno Park sub- division, located at the southeast corner of Greeno Road and Spring Run Road. Ack Moore showed the Commission a plat of the area. Discussion led to there not being on this plat several necessary items, a vicinity map, a title block, owners certificate of acceptance, graphic scale, and a certificate for secretary of the Planning Commission to sign. The Commission indicated to Mr. Moore that the map needed to come into compliance with the regulations. Cecil Pitman moved to grant preliminary and final approval subject to all the above items being furnished. Roy White seconded and motion carried. Ack Moore spoke to the Commission on the preliminary plat approval of Meadowbrook Unit II a subdivision located on the East side of Bishop Road containing ten lots. Discussion led to Mr. Pitman moving that preliminary approval be given and holding final approval until the requirements of the resolution passed by the City Council on 8/27/79 regarding a s-ewer conneetion policy for citizens outside the corporate limits of the City of Fairhope are met. Further discussion including opinions from the property owners resulted in Mr. Pitman withdrawing his motion after it seemed the developer wished to have this designated as an R-5 zone when it comes into the City limits, and Mr. Parker brought out the point do we want to allow multi -family, whether this is consistant with our overall planning, or designate land use more like the R-3 it is adjacent to, Meadowbrook I. He suggested R-4 might be more appropriate. George Roberds addressed the Commission remarking that R-4 would be agreeable with their plans. Mr. Pitman moved that preliminary approval be given subject to a written agreement being presented showing that Mr. Moore agrees. to meet the requirements of the 8/27/79 resolution passed by the City Council, agrees to build no more than one building, no more than 4 units per structure, per 1ot(R-4 zoning requirement), Jack Stipes seconded and motion carried unanimously. Ack Moore showed' the Commission the subdivision layout on Twin Echo Estates. Mr. Parker remarked that it was a good subdivision 1ayolut. But the key points we needed to remember were the same as the restrictive covenants of the Covered Bridge Estates(m�inutes of 10/2/78). and were as follows: 1. natural greenery not distrubed, 2. that the building setback line start at the edge of the sluffing easement 3. 10 ft. utility easement. These to be shown on the drawings. The question of drainage into Big Head Gulley was brought up. Mr. Parker 'remarked that we need to address overall drainage plans i'n the City. The meeting with the City�Council was discussed, and when it might be held. Cecil Pitman moved to defer action on these plans for 60 days or until such time as the meeting with the City,whichever occurs first. Jack Stipes seconded and motion carried unanimously. Newman,,Chairman Fairhope Planning & Zoning Commission Fairhope, Alabama 36532 Dear Mrs. Newman: Mr. Sam Dyson submitted to me a copy of your letter of September 9, 1980, to Mayor James Nix and the Fairhope City Council referring to a motion unanimously adopted by the Planning and Zoning Commission at its meeting on July 10, 1980. Having been present at this meeting along with many long term residents of the area who would be affected by the development and drainage of this proposed subdivision, it was their impression as well as mine, that the Planning and Zoning Commission unanimouslyadopted a motion made by Mr. Jack Stipes to deny the application. It wasn't our impression or understanding of the motion that the application was conditionally denied con- tingent on a future meeting of the Fairhope City Council and Planning Commission. To the contrary, it was our distinct im- pression the motion was to adopt a resolution denying the appli- cation in toto. I would respectfully ask that you kindly have the Secretary of the Planning and Zoning Commission forward me a copy of this resolution and that I be notified of any proposed joint meeting of the Fairhope City Council and Fairhope Planning and Zoning Commission concerning this matter. Newman -2- September 18, 1980 cc: Mayor James Nix Fairhope City Council Members IV V VI VII VIII IX X Page two -Planning $ Zoning Commission meeting September 8, 1980 John Parker moved at this time for the Chairman to appeal in writing to the Mayor for an immediate meeting to discuss the overall drainage policy, Big Head Gulley specifically, the City at large. Jack Stipes seconded, motion carried with Roy White opposed to the motion. The application of Eastern Shore Builders for a building permit for an addition to Dr. Fellers office at the doctor's complex on Morphy Avenue was considered. This request being in order, John Parker moved based on the Building Inspector's recommenda- tion that we grant the Building permit as requested, Pierce Frederick seconded and motion carried unanimously. A question arose on the replacement of the Baptist Church steeple and repair. Mr. Parker moved to defer this to the Building Inspector's judgement, Roy White seconded and motion carried unanimously. I Mr. Louis Girdler came before the Board seeking a building permit for the property located on South Mobile Avenue where he wishes to construct condominiums. Mr. Parker asked Mr. Girdler how things came out with the variances he was seeking with the Adjustment Board. He replied that everything had been worked out. Mr. Lunsford was asked if he saw any problems and he replied no. Mr. Parker moved to grant the building permit subject to him meeting all the City requirements, Cecil Pitman seconded and motion passed unanimously. Art Regis and Craig Dyas came before the Commission to discuss the Triangle Area preliminary drainage and traffic layout for development. The Board discussed with them what their plans might be and thanked them for trying to work with them on developing this area. Lorene McCants came before the Commission to get a classifica- tion of the zoning in the Bradford Estates area. The zoning map did not clearly reflect that this was intended to be R-4 John Parker moved that this area be designated R-4 on the City Map. Cecil Pitman seconded and motion carried Bob Pope came before the Commission and showed them some plans on how he wishes to build a second story on the restau- rant at the pier". Bob Lunsford showed Commission letters he had from FEMA regarding this matter. Mr. Pope now has a 25 year lease with 5 year options. Discussion led to it being suggested Bob Lunsford get with Don Pruitt and report back at the next meeting. There being no further business meeting was duly adjourned. ,/ 0/,��yo
