The Planning Commission of the City of Fairhope met for their monthly
meeting on July 10, 1980 at 5:00 p.m. at the City Administration Build-
ing, 387 Fairhope Avenue, Fairhope, Alabama
Those present: Chairman Leona Newman; members John Parker
Cecil Pitman, Pierce Frederick, Jack Kirk, James P. Nix,
Jack Stipes, and Planning Consultant Don Pruitt
The minutes of the June 2, and June 18 meetings were approved
with the amendment to the June 2 meeting regarding the rezone
application of'Amos Wagner, adding that Mrs. Newman voted against
the rezoning. John Parker made the motion to approve the minutes,
seconded by Pierce Frederick and unanimously carried.
The application of Jack Pope for final plat approval of Town and
Country Estates located on Nelson Road off Hwy 98 South of town
was considered. Ack Moore showed the Commission an updated set
of plans, Bob Lunsford's memo as to the meeting on the site was
discussed. The opinion was expressed that the State had done all
they had planned to do, although they did state they intended to
grass the shoulders on Nelson Road, but it wasn't said when.
Mrs. Newman asked for comments from the audience. Red Wilkins
addressed the Commission and commented he had been asked to come
and represent Dr. Fellers and Sam Dyson. That they felt the dev-
elopment would divert drainage to their property. In like manner,
Mr. Stapleton, Mr. Dyson, 'Dr. Fellars, Mr. Silvernail, Mrs. Horne
and Claude Arnold spoke to the Commission voicing concern that
problems would arise from this development. After lengthy discussion
Stipes made a motion to deny the application until such time
the City Council and Planning Commission could meet jointly and
then get with the County Commission and the State highway department
to study alternatives in removing the excess drainage water, motion
seconded by Cecil Pitman, and unanimously carried. (letters attached
pertaining to this subject). John Parker made a motion requesting
a meeting jointly with the City Council, at an agreeable time, solely
to discuss the long delayed addressing of storm drainage problems
in Fairhope and its jurisdictional areas. Jack Stipes seconded and
motion carried unanimously. Mr. Stipes said he would set up the time.
Mr. Moore was questioned as to whether or not we were working on any
drainage problems now. He said they had started working on them and
planned to address each problem area.
The application of Albert Mixson for preliminary and final approval
of Mixon subdivision, a resubdivision of one piece of land into two
was considered. Claude Arnold spoke on Mixson's behalf. The property
is located on the South side of Third Avenue in Paddock Estates.
Mr. Arnold told the Commission that Mr. Mixson wished to give his
children a lot to build on. Everything being in order and their
being no objections, Pierce Frederick moved to grant approval, Cecil
Pitman seconded and motion carried unanimously.

Larry Chason came before the Commission on his plans for the construction
of a mobilehcme;park on Autumn Drive off_ Greeno Road. He had a letter
fxom the Electrical Department stating that the wiring met the specifica-
tions of the City. He still did not have plans on his landscaping
Pierce Frederick moved to accept the construction plans, Jack Kirk
seconded and motion carried unanimously.
The Commission was shown.: a sketch on Mr. H.D. Higginbotham's request
for a building permit for a covered boat stall on Fly Creek. He had
received a special permit from the Corps of Engineers. Mr Parker
moved we grant the building permit , Jack Kirk seconded and motion
carried unanimously.

Mr. Glen Boone of Delta Oil Co. came before the Commission on a request
for a building permit on the property located at the corner of
Section Street and Morphy Avenue. fie explained that they are converting
the former service station to a convenience store and he wished to build
a canopy out to'the island and shorten the island, thereby making it
more presentable. There was a question that arose as to whether Mr.
Boome falls under the grandfather clause since lie is not meeting setback
requirements as set out in the ordinance. Mr. Parker moved that the
application be continued as he felt he did not meet the landscaping
requirements and setback requirements under the zoning ordinance.
Pierce Frederick seconded and notion carried unanimously.
Larry Chason came before the Commission with a building permit request
for mini -warehouses to be built on Autumn Drive in the Greeno Park
subdivision. Mr. Parker questioned the drawing presented as to the
area needed for parking, and the landscaping. Mr. Chason contended
he was not aware that he needed any more parking. After discussion
Mr. Parker moved to deny the application because it did not meet
landscaping and parking requirements under the ordinance. Cecil Pitman
seconded and motion carried unanimously.
Carson Rockett's application is to be continued at 5:00 p.m. on July 21
as the City Council was to meet at 7:00 and we would not have
a quorum for a continued meeting at this time. Also Louis Girdler discus
Meeting was duly adjourned.
