HomeMy WebLinkAbout06-02-1980 Regular MeetingI II III IV The Planning & Zoning Commission of the City of Fairhope held their regular monthly meeting on Monday, June 2, 1980 at 500 p.m. at the City Administration Building, 387 Fairhope Avenue, Fairhope Alabama Those members present: Jack Kirk, J.P. Nix, Roy White, Jack Stipes, Ted Bennett, Pierce Frederick, John Parker Leona Newman and Don Pruitt Planning Consultant The minutes of,the May 5,1980 meeting were considered and amended as follows: Add to paragraph VI: That the developer agreed to install two drainage culverts on Nelson Road running North to South and install a concrete drainage swale 180 ft. long west of the southeast corner, and establish a grassed swale for the remainder of the property along Nelson Road. The application of Mr. Amos Wagner for a change in zone from R-5 High Density Multi -Family Residential District to B-4 Business and Professional Offices District for the property identified as the east 250 feet of the Amos Wagner leasehold, located on the west side of Greeno Road 300 ft. north of Fairhope Avenue was considered. Mr. Wagner spoke on his behalf. lie remarked that he had been in contact with all his neighbors and that no one was opposed. Mr. Pruitt's comments were considered. He recommended denial because the change would not be in accord with the Comprehensive Plan and there is already plenty of land zoned for commercial use. Mr. Parker moved that this rezone request be denied. The motion died for a lack of a second. Jack Kirk moved to recommend to the City Council approval of this zone change. Roy White seconded. and the vote was For: White, Frederick, Bennett, Nix, Kirk . Against: Newman -Parker and Abstain-Stipes,motion carried. Final plat approval of Town & Country Estates was considered. Ack Moore presented the final plans and a discussion led to what drainage provisions would be. Mr. Stipes asked Mr. Sam Dyson how this would affect his property. Mr. Dyson remarked that he had definite drainage problems and that the whole area down there needed to be studied before any further development was made. The Commission on motion by Ted Bennett voted to carry this over until next month with the understanding that Mayor Nix, Mr. Pope and an official from the State Highway Department get together and discuss an overall drainage plan for the area. Roy White seconded and motion carried. Larry Chason and Art Rigas came forth to discuss the construction plans for a Mobile Home Park on the site where the disaster housing is located on Greeno Road. Mr. Pruitt read the requirements for mobile housing parks. The one thing they lacked was a lighting plan in accordance with the regulations. No action was taken but Mr. Parker pointed out that the three things Mr. Chason needed to keep in mind were landscaping, recreation facilities, and the utility functions. Mr. Robert Green showed the Commission a drawing for a proposed shade house that he wishes to construct at his Nursery on Greeno Road - It was noted that the hurricane destroyed all his shade trees and this building is necessary for his business. Mr. Nix moved to grant the permit, Jack Stipes seconded and motion carried unanimously. V VI VII VIII IX X XI XII XIII Page two - Planning & Zoning Commission meeting June 2, 1980 Robert Mitchell presented to the Commission revised plans on the building he wishes to relocate on Morphy Avenue across from Fairhope Health Care Center. The drawing showed he met the 9 parking space requirement, but did not allow for a loading/unloading zone. Discussion led to Mr. Parker making a motion to grant the permit subject to the revision of the plan being the designated loading and unloading be at the South end(rear) on the building,which Mr. Mitchell agreed to. Ted Bennett seconded and motion carried unanimously. Betty Jo Wulff of the Page & Pallette came before the Commission with a drawing of how she wished to rennovate her building on the corner of Section and Delamare Streets. The Commission noted that her structure would extend over the sidewalk and would require Council approval thereby voted to recommend approval of her plans. Barbara Manders came before the Commission with her resubdivision of the Lee leasehold property located between Morphy and Bellangee. She had redrawn the plat and only lacked 21-,ft. in meeting the requirement for the second lot. Mr. Parker moved we grant the resubdivision subject to the variance being granted by the Board of Adjustments, and recommending to them approval of same. Mr. Nix seconded and motion carried unanimously. Bob Young of Thomas Hospital spoke to the Commission remarking that the FHA required that the Planning Commission relate to them that the expdnsion plan was consistant with the City of Fairhope's planned development. He had provided a resolution for this purpose. Mr. Parker moved for the adoption of said resolution, Pierce Frederick seconded and motion carried unanimously. Mr. Parker moved as a result of the work study meeting that the Central Business District be defined per the Zoning Ordinance as the areas from the centerline of Morphy Ave, Bancroft St, Oak St, and Church Street. The businesses on the opposite side of the street have to provide off-street parking. Pierce Frederick seconded and motion carried. Along this line it was moved by Mr. Parker that a large map be displayed for the public showing the Fire District, Zoning District map, and Central Business area and have the Building Inspector secure this map. Jack Stipes seconded and motion carried unanimously. John Parker moved to obtain a stamp for building permits and subdivision applications and to apply at each meeting with the chairmans signature. Jack Stipes seconded and motion carried unanimously. John Parker moved as part of the procedure for rezoning that applicants be required to submit a list of adjacent property owners within a 300ft radius. This list to be certified as to its accuracy and completeness by a registered1land surveyor/engineer or licensed realtor from the area. Roy White seconded and motion carried. John Parker moved to require certification for notification of adjacent property owners in subdivision application procedure, Roy White seconded and motion carried. The Board also requested that a legal opinion be sought from the City Attorney as to passing on the costs of the certifications to the appli- cants, and whether or not the Commission has the authority to do so.
