HomeMy WebLinkAbout03-03-1980 Regular MeetingI II III IV V VI The Planning & Zoning Commission of the City of Fairhope met for their regular monthly meeting on Monday, March 3, 1980 at the City Administration Building 387 Fairhope Avenue at 5:00 p.m. Those members present: Mrs. Leona. Newman, Chairman; Jack Kirk, Ted Bennett, Jack Stipes, Cecil Pitman, John Parker, Pierce Frederick The minutes of the February 4, 1980 meeting were considered and Mrs. Newman asked that they be corrected to show lam. Nix making a motion to give tenta- tive approval on the street layout presented by Mike Arnold. Also on Earl Malone's request forla building permit adding that Roy White made the motion to grant same. Other ,than those two corrections they were approved as presented. Mr. Pate of Ace Electric Signs, Montgomery, Alabama came before the Commission to discuss a building permit for a sign that the Bonanza Restaurant wished to erect at the Baldwin Square Shopping Center. He had a sketch o' what he wished to construct. Mr. Parker told Mr. Pate of the meet- ings previously held regarding the shopping center and that the Planning Comm- ission had requested that the tenants be asked if they would go with something other than huge pylon signs. He asked if the sign could be flush with the building. Mr. Pate remarked that it would be difficult as there would be an overhang on the side of the building. Further discussion led to Mr. Stipes making a motion that"they take the proposal back and rework it and bring it back next month. Mr.' Parker seconded and motion carried unanimously. Earl Malone came before the Commission on his request to change the driveway design of his caxwa.sh that had been granted a building permit at the last meeting. His original design had a circular driveway but when they started to lay out the pipe they realized that the property owner next door went all the way to Greeno Road and they would be creating a catch basin, the water would not rum off. The only change would be a drive in the center of the property. John Parker moved that we grant this change, Ted Bennett seconded and motion carried unanimously. Mrs. Newman told the Commission members that Carson Rockett had asked to be carried over until the next meeting. There was discussion among the members over what Mr. Rockett is proposing to construct. Mr. Stipes quoted the Ordinanc regarding seeking building permits and said he thought he had passed the stage where a permit should have been sought in his excavation. The Building Inspector was questioned as to whether or not Mr. Rockett had sought a building permit. This matter had been discussed at length at the special meeting held January 22, 1979. The conclusion of the meeting was that Mr. Rockett was working under a Corps of Engineers permit and there was no excavation for buildings. Mr. Bennett asked if we knew what the Corps permit allowed. It was suggested that we ask a person from the Corps to be present when Mr. Rockett comes before the Commission. Mr Pruitt remarked that Mr. Rockett's seeking a variance from the Adjustment Board was out of order. That he should have come before the Planning Commission and sought his building permit before seeking a variance. Mr. Stipes asked that this statement by Mr. Pruitt be conveyed to the Adjust- ment Board. I Russell Kilgore came before the Commission with his application for a zoning change from R-2 Single Family Residential District to B-4 Business and Profess- ional District for the property on the corner of Section Street between Volanta and Miller streets. He told the Commission that the egress/ingress was planned on Volanta St. That these would be daytim offices, and had 10 shown on the drawing.'Cecil Pitman moved that we accept the application for advertising and public hearing to be held at the April meeting on the basis of the plans Mr. Kilgore presented at this meeting. I.k. Stipes seconded and motion carried unanimously. Ron and Gary Mitchell discussed with the Commmission some plans they had for a piece of property they had made an offer on. The members discussed at length where the egress/ingress would be, landscaping, whether or not to have a fence, the parking arrangement and number of offices planned. Mr. Mitchell thanked the Commission for their guidance and said they would be back next month with some concrete plans. After discussion mostly about the parking situation, John Parker moved, Cecil Pitman seconded that the plans be accepted. Motion passed unanimously.
