HomeMy WebLinkAbout09-10-1979 Regular MeetingI On Monday, September 10, 1979 at 5:00 p.m. the Planning & Zoning Commiss of the City of rairhope met for their monthly meeting at the City Admin- istration Building, 387 Fairhope Avenue, Fairhope, Alabama with Chairman John Parker presiding Those members present: Jack Stipes, Leona Newman, Pierce Frederick, Ted Bennett, Cecil Pitman and Don Pruitt of the South Alabama Regional Planning Commission The Commission gave unanimous approval to the minutes of the June 4, 1979 meeting, July 2, 1979 meeting, the amended July 12th minutes and August 6 minutes with the following changes made iri', the August 6 minutes: III Add the motion by Mrs. Newman to accept the application for advertising for public hearing to be held on Septem- ber ld, 1979. Motion carried unanimously. IV Change Mr. Parkers reply to read ... Mr. Parker explained why the Commission has in the past tried to avoid strip commercial zoning in this area facing Section Street with the existing residential zoning. V Add the sentence.... The church was encouraged to seek a solution with the neighbors prior to the next meeting. I The public hearing on the re -zone application of Olympia Corte Dyas for a change in zone from R-1 Low Density Single Family Residential District to B-1 Local Shopping District for the parcel located in the "triangle area" - junction of U.S. Highway 98 four lane and U.S. Highway 98 Business Pbute was considered. Carlton Niemeyer addressed the Commission and general public representing Mr. Dyas' application, He remarked that the applica- tion had been modified and only contained approximately 9 acres. He showed a sketch of the proposed area and said that the proposal was for a neighborhood shopping village and that they would keep as many trees as possible in the development of this village. He further stated that he thought that Eastern Shore Shopping Center had brought business to Fairhope rather than drawing from it and he was sure this would do the same. That this should bring in $9,000-$10,000 in property taxes for the City. Several people in the audience asked Mr. Niemeyer questions re- garding the surrounding property and future plans for same. Mr. Parker read what the Commission's recommendation to the Council had been at the June 1978 meeting. The Planning Consultant had not stated an opinion on this application. Mr. Parker called for a vote of property owners within 300 ft of property who were for or against this zone change; there wasn't anyone present to vote. He called for a vote of the - roperty owners in Fairhope who had an interest in1this parcel and who were for zone change - 5 For, and E4: ainst - 38 against!,. Mr. Pitman remarked that the City now had an abundance of unused commercial land. That Mr. Dyas should con- sider developing a nice residential development. That he had prev- iously requested and been granted office spaces on other property and they were not being utilized. That we did not need anything else to draw the crowd away from the downtown shopping district. Mr. Dyas remarked that he had tried to comply with every suggestion the Planning Commission had made in the past but he could not see how we could deny his request after we just granted approval to the Baldwin Square Shopping Center. He was informed that this area was already zonied for this type of development and they had met all requirements.That a great emphasis had been put on landscaping and drainage and the developer had willingly complied with every reccomd- ation before he had received approval. Mr. Parker remarked that the application was incongruous with the overall nlanning of the Cit7. Mrs. Newman moved to recommend denial of this zoning request to the City Council, Jack Stipes seconded and motion carried unanimOusly. III IV V Page t7wo - 9/10/79 Planning & Zonis-ig Commission meeting The application of Russell Kilgore for preliminary and final approval of Oak Ridge subdivision located off Pecan Street right behind the local radio station WABF was considered. Questions from neighbors and commission members were satisfactorily answered and on motion by Mfrs. Newman,lseconded by Pierce Frederick preliminary and final approval was granted subject to the building being as designed on drawing and Mr.,Kilgore posting bond. Motion carried unanimously. Bruce Knodel brought to the Commission's attention that a re -study of the plans for the addition to the Trinity Presbyterian Church revealed that they could work out their parking problems without having to use the dedicated public alleyway that runs along the side of the church's property. Mr. Newberry remarked that this plan was acceptable to the church. Mr. Parker thanked them for keeping us advised. Mrs. Potts and Harford Field came before the Commission to discuss further the Community Appearance Committee's revisions to the Planning and Zoning Ordinance. It was their hope to answer the questions of the Planning Commission and have their backing. Mr. Pitman was most concerned that the Chamber of Commerce did not feel this committee necessary. He expressed a desire to have the Chamber as a whole express an opinion, as he felt that the Chamber represented the business comnmity"s feelings. The only objection that he found was with section 7.6 on Penalties. He was advised that this was already existing and was not ed by the Comrnnity Appearance Committee. He suggested a revision on this section. Other than that he would go along with what had been presented. The other members of the Planning Commission expressed that they would support the revisions presented. There being no further business, meeting was duly adjourned. Secretary/ Approved; f / �irman
