HomeMy WebLinkAbout05-14-1979 Special MeetingThe Planning & Toning Commission of the City of Fairhope met for a special meeting May 14, 1979 at 5:00 p.m. at the City Administration Building 387 Fairhope Avenue, Fairhope, Alabama with Chairman John Parker presiding. Those present: Leona Newman, Sam Box, Sr., Cecil Pitman, E. Jack Kirk, Bill Workman, Pierce Frederick,..Ted Bennett, and Don Pruitt Planning Consultant The purpose of the meeting being to act on the request of Eastern Shore Builders for preliminary plat approval on Meadowbrook subdivision. Action had been delayed in order for Dr. Workman 'to accompany Mr. Ack Moore(Eastern Shore Builders engineer) and City Superintendent Phil Rutherford to the proposed 'subdivision site to run tests on the soil to see if it would drain properly if Mr. Byrd Moore used grass swales in 'the subdivision as opposed to curb and guttering(zoning ordinance requirement in subdivision develop- ments). Dr. Workman reported to the Commission the tests he had made and the results., He remarked that the tests showed it should not pond for a significant amount of time, that the grass swale concept would work satisfactorily if he wished to use it. Larry Stejskal(adjoining property owner) addressed the Commission stating that he disagreed with Dr. Workman's diagnosis. Dr. Workman said that there were a number of tests that could be run and possibly. it would not work if he had used what Mr. Stejskal had mentioned, but the tests he had made showed satis- factory results., George Stejskal addressed the Commission and asked why Mr. Moore was not being asked to install a catch basin as the street he,proposed to build was longer than Mr. Stejskal built and he was required to install said basin. Don Pruitt remarked that the design showed that adequate provision was made for run-off, that he had met the standards set by the City. Ack Moore remarked that the plat had been redrawn and that the decision was to have curb and gutter. Dr. Workman said since this change was made the Commission ought to have time to study the new plat. He asked Mr. Pruitt to comment on this. Mr. Pruitt said he did not have any objection to new plat. His only question would be about the proposed stilling box. It was determined by discussion that it was adequate. Mr. Rutherford stated that the City would accept maintenance if it met require- ments. Mr. Box moved to grant preliminary approval on new plat submitted, Mr. Frederick seconded, motion carried with Mrs. Newman voting no, Wesley Stapleton came before the Commission with a request for a building permit to build a new Masonic Lodge on the property located at 62 South Section Street(present site of Masonic Lodge) Mr. Pruitt had prepared a review based on the application. He remarked that, the off-street parking requirements were not adequate, and the landscaping was not clearly indicated for more than a loft. X 20ft. fronting. His recommendation was either turning it down or referring it to the Board of Adjustment for a variance request. Mr. Box put in the form of a motion granting approval subject to variance being granted by Bd of .Adjust. Mrs. Newman seconded and iz was unanimously carried.
