HomeMy WebLinkAbout05-07-1979 Regular MeetingI II III IV u The Planning & Zoning Commission of the City of Fairhope, Alahmc u met for their ;regular monthly meeting on May 7, 1979 at 5:00 p.m. at the City Administration Building, 337 Fairhope Avenue, with Vice -Chairman Leona. Newman presiding. Those members present: Cecil Pitman, E. Jack Kirk, Sam E. Box, Sr. James P. Nix, Bill Workman, Ted Bennett, Pierce Frederick, and Don Pruitt, Planning Consultant The minutes of, the April 2, 1979 and April 9, 1979 meetings were approved on motion by Cecil Pitman, this being unanimously carried. i The application of Eastern Shore Builders for preliminary plat approval was considered'at this time. Byrd Moore addressed the Commission on the plat(Meadowbrook) being located on the north side of Gayfer Street Extension east of Bishop Road consisting of 21.81 acres. Mr. Moore had mailed to each Commission member material relevent to his request to use grass swales in lieu of curb and guttering. Bill Workman thanked Mr. Moore for providing this useful information in helping the Commission to understand his reasons for trying some- thing different in his approach to the development of this subdivision. He further remarked that it seemed like a very good idea, but did Mr. Moore know for sure that it would work drainage wise in the Meadowbrock subdivision, that the water would run-off and not pond. Mr. Moore said that he and Ack Moore had been over the land after a heavy rainfall and then again the next day and the water had drained off. Mr. Workman asked if any tests for permeability had been made not just surface perk tests. Mr. Moore said he was unaware that the Commission wished him to have this much information to present at this time. Mr. Workman reminded Mr. Moore that he had asked for this) same information at the •1-ast g. Several adjoin- ing property owners spoke to the Conmission as to the drainage on their land, with a Mr. Stejskal stating that he felt this idea would not work as his own land did not drain. After lengthly dis- cussion Mr. Workman volunteered to go out with the City Engineer and Mr. Rutherford and run the tests necessary to determine if in fact it would drain properly. Mr. Moore was also questioned about his intent to annex this land. He stated that he had been before the City Council with a request to annex as soon as the City was next to his land, and intended to have it written in the deeds about annexation. Mr. Pitman moved to have a special meeting May 14th at 5:00 p.m. to discuss the findings of the tests Mr. Workman intended to make, and for the Commiss to give a decision at that time, Ted Bennett seconded, and it carried unanimously. The request for a building permit for )Cut & )�url Beauty Salon was discussed. Mr. Stearns spoke on their behalf since no one was present to make any remarks. He stated that everything was in order and he recommended permit. Mr. Nix moved, Mr. Kirk seconded and motion for granting permit was unanimously carried. Mr. Ray Benson, Administrator of Fairhope Health Care Center showed the Commission some preliminary plans on the planned rennovation of the Health 'Care Center.' After discussion it was determined that Mr. Benson needed to appear before the Board of Adjustment & Appeals for the variances on part of the rennovation. Mr. Workman moved for approval of his plans subject to the approval of the Board of Adjustments & Appeals on the off-street parking, and setback requirements. Ted Bennett seiconded and motion passed unanimously. P1r. Larry Chas on of Earle McMillan & Niemeyer asked for an interpretation of the Zoning Ordinance from the Commission in regards to a Mobilehome park he plans to develop in a B-2 area.located on Greeno Road. The Commission told him this would be allowable. Ile thanked all for their comments. A building permit for the installation of a drive -up window at Hardee's on Greeno Road -was granted on motion by Cecil Pitman, seconded by Ted Bennett. VI Page two - Planning & Zoning Conrnission May 7, 1979 meeting The Conmission had carried over action on Windmere Place in order for the adjacent property owners to study the planned subdivision. Mr. Moore asked that preliminary and final approval be given at this time. As objections had,been made, and a letter received gave no indication of non -approval, Mr. Workman moved granting Mr. Moore's request subject to the posting of performance bond, and all the required improvements suggested at April 2, 1979 meeting being met. Mr. Kirk seconded, and motion carried unanimously. There being no further business to discuss, meeting was duly adjourned. Approved: % 7 Betty Ylvenbark Chairman
