HomeMy WebLinkAbout04-02-1979 Regular MeetingI II III IV V 171 The Planning & Zoning Commission of the City of Fairhope met for their regular monthly meeting at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama on 1onday, April 2, 1979 at 5:00 p.m. with chairman John Parker presiding. Those present: E. Jack Kirk, James P. Nix, Leona Newman, Cecil Pitman., Bill Workman, Ted Bennett, Pierce Fred- erick, and Don Pruitt as Planning Consultant The minutes of the "'larch 6, 1979 meeting were approved unanimously on motion by Jack Kirk, seconded by Cecil Pitman. Mr. Parker asked if there was anyone present who wished to address the Com- mission on the matter of the public hearing scheduled for this evening. on the Amended Subdivision Regulations of January 1972,adopted January 8,1979 and now being changed to provide a clearer definition of terms stated therein. No one present wished to address the Commission on this matter, and on motion by Bill jorkman, seconded by Leona Newman, the amended subdivision regulations were unanimously adopted(copy attached). The preliminary and final approval of the subdivision application of James Shores for Windmere Place was presented again by Ack lbore, as agent. This was brought before the Commission in March and carried over due to incomplete plans and suggestions the Commission made to Mr. Moore at that tismme. Thomas Davis came before the Commission stating "that his father was an adjacent property owner, and he was also representing Dr. Johnson on the other side of subject property. He requested that his father and Dr. Johnson be given time to study the proposed plans on this subdivision and the Commission holding off action on same, until he at least had a chance to do this", as they were completely unaware that this was what was being suggested for this niece of land. And he was most concerned as to hcxe drainage was going to be handled as it had been a problem in the past. Mr. Nix put in the form of a motion holding this over as requested, Bill Workman seconded and it was unanimously carried. Ken Pritchard addressed the Commission on the building permit he had received at the March 19, special meeting. This was on the property located at the corner of Grand Avenue and Section Street. He wished to submit an amended set of plans, which he wished approval on. The Commission reviewed the plans and agreed that this was a better idea, but that because he did not meet the backyard setback requirement on the rear of the property he would have to go before the Board of Adjustment to seeKa variance on the new proposal. Mr. Nix moved to accept the amended set of plans and grant the building nermnIt subject to the Adjustment Board granting approval of the backyard variance needed. Mr. Pitman seconded and motion was unanimously carried. The Commission considered the matter of zoning for the 100 acres of FSTC lessee, Wayne Hoffren, who had requested annexation of this same property. Mr. Pruitt gave to Commission members a memorandum he had worked up on the property which set out his recommendations . Ilike Ford told Commission members he had been working uvrith Mr. Hof fren and that he would like to make a recommendation on his behalf. There were opinions expressed by all, but no solution reached after lengthy discussion. Mr. Parker stressed that we had to be extremely careful in handling this request, that we had recently been requested to re -zone for business other property and to take all this into consideration and not act hastily. It was decided that a work study meeting should be held at a date set Wednesday, April 4,1979(later changed to Ibnday, April 9, at 5:00 p.m.) This wa.s put in the form of a motion by Ted Bennett, seconded by Pierce Frederick, and unanimously carried. The owners of the E.Z.Pik convenience store came before the Commission stating they had received a letter from the Building Inspector citing them for violation, and they wished to discuss the problem with the Com u- ssion. It was brought out that they had tried to maintain the island out front with plants and shrubbery but to no avail. The rain and customers backing over the island had kept anything from staying there. They requested permission to cement over the island and plant along the side of the building to solve the problem. The Commission agreed they had tried to comply, and this was exceptional case, and their request should be granted. Mr. Nix pointed out that we continued to make exceptions, and that the public being unaware of this action continuously attacked the City for not enforcing the Ordinances now, which is not the case. That we needed to change the Ordinancesnot grant exceptions. All agreed but in this case, Bill WorlQ pan moved to grant permission to pave, seconded by Cecil Pitman, and motion passed with Mr. Nix voting against it. VII VIII Planning & Zoning Commission meeting April 2, 1979, page twm Ack Moore presented to the Commission a topo on the proposed Meadowbrook subdivision that Byrd1lbore wished to develop on the property located on Gayfer Avenue and '?Toyer Road(Bishop Rd). Mr. Parker referred to Article III -Variances (Page 27) in the Subdivision Regulations where it answers the question of whether or not Mr. T-bore can plan and use grass swales as opposed to the curb and guttering required. He can be called a hardship case under this Article. Mr. Pruitt offered to Mr. Moore the suggestion that he stub -out and plan for another street leading into/out of the subdivision. Mr. Moore remarked that all his new material showed just one entrance/exit and small streets with cul-de-sacs. He thanked the Commission for their guidance and said he would present later the completed plans. Jack Pope asked to discuss the plans for the Covered Bridge he wishes to have in the Covered Bridge Estates development. The question of maintenance of the superstructure was discussed with Mr. Nix pointing out that the City should not be responsible for this as it would only serve the residents of this development. That possibly the developer would bear the maintenance for a certain period of time and then it would revert to subdivision residents this being stated in the legal documents w-hen the land sold. The size pro- posed would meet all requirements, and the Commission emphasized that it was a unique idea and they wished him to carry through with it but to work out somehow the maintenance problem of the superstructure. There being adjourned on carried. io further business to come before it, the meeting was duly motion by Ted Bennett, seconded by J.P. Nix, and unanimously Approved: 7
