The Planning & Zoning Commission of the City of Fairhope, Alabama
met for their monthly meeting Monday, March 6, 1979 at 5:00 p.m.
at the City Administration Building 387 Section Street, Fairhope
Alabama.
Those present: John Parker, Chairman, Leona Newman,
Cecil Pitman, Sam E. Box, Sr. Pierce
Frederick, Bill Workman, E. Jack Kirk
The minutes of the Special called meeting of January 22, 1979
and the regular monthly meeting of February 5, 1979 were approved
on motion by Bill Workman, seconded by Pierce Frederick, and
carried unanimously.
The application of Crittenden Enterprises for Preliminary Plat
approval of Pecan Orchard, Unit One a subdivision of 9 acres
more or less into 12 lots located on the east side of Oberg Road
at the southeast corner of Morphy Avenue and Oberg Road.was con-
sidered. Mr. Dale Crittenden addressed the Commission. There
followed discussion on the "topo" and the right of way strip
designated on the subdivision to be reserved for if/when it was
needed. Mr. Pruitt suggested that it be eliminated because in
the past we had run into problems with the developer as to maint-:
enance. Mr. Box remarked that he thought it should stay as it isl
because this is colony land and we had also had trouble in the past
with a lessee in allowing access to roads. Mr. Pruitt's comments
were noted: 1. that a detailed drainage plan should be submitted
2. should show whether or not fill was going to be used on the
low lots, and 3. indicate if approval of the septic system has
been granted. Mr. Workman moved that this be carried over based
on the consultant's recommendations, Mr. Frederick seconded, and
it was unanimously carried. Mr. Crittenden thanked the Commissio
for thier guidance.
Ack Moore addressed the Commission on the application of James L.
Shores, Jr. for a preliminary plat approval of Windmere Place.
This is located in Montrose on the West side of Old U.S. Highway
98, close to the Post Office. it was brought out in discussion
that Mr. Shores intended to keep a 50 ft strip at the end of
the cul de sac for access to his bay property. Mr. Parker point-
ed out to Mr. Moore that this could not legally be done, he suggest-
ed that the street be extended and have the turn around at the
end, and that he redraw the plat showing the five lots instead.

ick to carry this over, motion carried unanimously.
Ken Pritchard presented to the Commission his sketch for consideration
on his application for a building permit. This is for the property
located at the corner of School and Equality Streets. He request-
ed one building with six offices on the first floor and four
apartments on the second story. This was the first time a request
of this nature had come before the Commission. After discussion
it was suggested to Mr. Pritchard that it would be best to stick
with one request only in this building. Mr. Pritchard thanked
the Commission for advising him on this and stated he would presen
a more detailed plat at a later date. It
Ack Moore showed the commission a drawing of a Covered Bridge that
Jack Pope hoped to use at Covered Bridge Estates. A discussion
led to all saying it would be a unique and attractive thing for
the City of Fairhope and to proceed with his plans as long as
the requirements for the City are met in width, height, drains, et -
The zoning of the 100 acres of Single Tax Colony land that was
recently approved for annexation was brought up at this time.
A discussion by Single Tax Colony representatives and the Commiss-
ion led to the Single Tax remarking that they would be agreeable
to waiting until Mr. Pruitt had a chance to further study to see
what would be consistent with the comprehensive plan for the City.
Mr. Pitman moved, seconded by Mr. Frederick and unanimously carrie
to hold this over until the next meeting.

Mr. Parker passed out to each member a copy of a draft on the Amendment to
the Fairhope Subdivision Regulations of January, 1972 which was adopted
January 8, 1979. He pointed out the changes which had been discussed at
the February meeting, and were thought necessary to further clarify said
amendrent. On motion by Bill Workman, seconded by Leona Newman, it was
unanimously voted to advertise for a public hearing to be held at the next
regularly scheduled meeting.(copy attached)
The Community Appearance Board committee's study was brought up at this
time. It was suggested that a special meeting be held to devote time
for in depth discussion on same. The Commission agreed on having this
meeting March 19th, at 5:00 p.m.
The League of Women Voters had a 20 minute slide show presentation that
they wished the Commission to see on the necessity of keeping our
natural habitat along the coastline and the job of the Coastal Area
Board in regards to same.
Byrd Moore addressed'the Commission seeking their feelings on a new idea
he would like to try in a subdivision he plans to develop on Gayfer Road
and Bishop Road(also known as Troyer Road). This property is not in the
City Limits, although he is tying in with City Utilities, and has stated
he wishes to annex the land if and when the City reaches his property line.
He presented to each member a booklet shoxring better what he was proposing,
and stated that according to all the new material he was receiving, the new
concept was to not have curb and gutters in the developments in an effort
to help retain storm water in the area through seepage in grassed swales.
He suggests using the approximate 20 acres but only developing about 6
acres as a Planned Unit Development with zero lot line design, leaving the
remaining area for standard subdivision development, and also not using
curb and , but using swales with a small pipe running Linder the drive-
ways for water runoff. Tlr. Parker stated that the Commission was open
to innovation relevent to the current Zoning Ordinance, but we had to do
things in due process. Mr. Moore stated he would like to know if some-
thing could be done within a two month period, as he has a time limit.
Further discussion led to the Commission stating that they would be open-
minded in trying to work with him on his new idea if he had time to allow pro
er consideration.
There being no further business to come before it, the meeting was duly
adjourned. i
