The Planning & Zoning Commission held a special called meeting
January 22, 1979 at 5:00 p.m. at the City Administration Build-
ing, 387 Fairhope Avenue, Fairhope, Alabama with Chairman John
Parker presiding.
Present: James P. Nix, Sam E. Box, Leona Newman, Ted Bennett
Bill Workman, Pierce Frederick
Absent: E. Jack Kirk, Cecil Pitman
The purpose of the meeting being to discuss the excavation
being done on the property on Volanta Avenue by Fly Creek by one
Carson Rockett. i
Mr. Parker stated that there was not adequate information on
file, that although the work is obvious, no application for
a building permit has been filed.
Mr. Erling Riis, introduced himself to the Commission members,
stating he represented Mr. Rockett and Mr.Roberts -(also present)
owners of the property. He presented a copy of a letter(attached)
from Mr. Stearns that his client had received in May of 1978.
It was a letter stating the City of Fairhope had no jurisdiction
over boat slips and bulk heads in Fly Creek. Mr. Stearns referr
ed Mr. Rockett to the Corps of Engineers who issued permits on t e
matter in question.
Mr. Parker stated he was unaware that any correspondence had
taken place in this case, nor did Mr. Stearns offer this informa•
tion when the topic was discussed in his presence at the Commiss•
ion's meeting of January 8, 1979 and that it did put a different
light on the matter. But that it stated clearly in the Ordinanc(
that before any excavation or building of a structure could begii
one needed to obtain a building permit from the City.
Mr. Nix at this time remarked that in the past the Planning &
Zoning Commission had not required persons building bulkheads
or boatslips to obtain a building permit from the City. That
in fact this was the issue, whether or not the Planning & Zoning
Commission wished to do differently in the future.
Mr. Workman addressed the Commission, remarking that he had a-
ssisted Mr. Rockett as agent in the initial work at this prop-
erty. That Mr. Rockett had had to obtain permits from various
agencies(Corps,State, etc.) before any dredging work could
proceed. He was going to abstain from any action taken by the
Commission because of his involvement with the project.
Mr. Parker re -iterated that because of the way the Ordinance
read that a building permit request was in order. He wished
the Commission to voice their feelings on same.
After discussion between all, it was put in the form of a motion
by Mr. Nix that as long as permit issued is followed, that the
Planning & Zoning Commission not get involved in issuing of per-
mits for construction of bulkheads and boatslips that require
a permit from the Corps of Engineers. Mr. Box seconded the
motion and it carried with Mr. Workman abstaining.
Mr. Riis addressed the Commission again stating that his clients
did not know what they were going to do with the property at this time,
that they would probably do whatever was in order as far as property is
zoned, and also make m oney for their investment. That they would keep
the Commission informed as to the steps taken as they advanced and apply
for a building permit with the Planning Commission before any construction
is commenced beyond bulkheads for boatslips. Mr. Parker thanked Mr. Rockett
for coming and advising the Commission of their plans.
The Meeting was duly adjourned.
