1979 at 5:00 p.m. at the City Administration Building, 387 Fairhope Avenue
for their monthly meeting with Chairman John Parker presiding.
Those present: Dr. Pierce Frederick, Dr. William Workman,
E. Jack Kirk, James P. Nix, Sam E. Box,
Cecil Pitman, and Jeff Blood representing the
South Alabama Regional Planning Commission
The minutes of the January 8, 1979 meeting were unanimously approved
on motion by James P. Nix, seconded by Bill Workman.
The first item on the agenda was the request of Olympia C. Dyas
for the final plat approval of Bayou Volanta Commercial Park,
Unit One. This had been discussed and preliminary approval grant-
ed at the August 8, 1978 meeting. Mr. Blood was asked to read the
comments of the SARPC. He pointed out the two things that were
of concern of SARPC. One being the water line intended to serve
the five lots; two, the approval of the County Health Department
on septic tanks. Mr. Dyas stated that they intended to hook up
with the Daphne water lines that are available, and that the Count
Health Officer had,voiced approval but he was waiting for the Plan
ning Commission approval. Both questions being satisfied, it was
put in the form of a motion by JPNix, seconded by Cecil Pitman and
unanimously carried that final plat approval be granted.
The application of George B. Klumpp for preliminary and final
plat approval for Blueberry Orchard, Unit Two was considered.
This is a request for a subdivision of 87 acres, more or less,
into two parcels. Mr. Blood was asked to state the recommendation
of the SARPC. He remarked that everything was in order and they
suggested approval. Mr. Pitman put in the form of a motion grant-
ing preliminary and final plat approval, seconded by J.P. Nix, and
carried unanimously.
Consideration was given to Mr. Robert Peterson's request for Final
Plat approval on resubdivision of land on Greeno Road. This had
been discussed at previous meetings. Mr. Pruitt's comments were
noted including the incomplete plat Mr. Peterson submitted not in
compliance with Section 509.6 of the City's Subdivision Regulation!
Mr. Nix made a motion granting final plat approval subject to a
complete plat being presented for approval as per Section 509.6.
Mr. Pitman seconded and motion carried unanimously.
At this time Mr. Parker stated that we had two requests for annex-
ation into the City Limits of parcels of land that the City Counci:
had forwarded to the Planning Commission for consideration.and zon•
ing.recommendation. The first request being from Mr. Charles Inge]
soll on the property located East of Greeno Road and South of
Nichols Street, some 4.3 acres of land. Mr. Ingersoll also request
ed that this be zoned 1I-1 Light Industrial District, this being
what the adjacent property is zoned to the north. The second
request was from the Fairhope Single Tax Corp. for approximately
120 acres of property located to the east of the present city
limits, and bounded on the North by Fair*ope Ave. on the east by
Troyer Road and on the south by Nichols Street. Mr. Nix suggested
that before getting involved in the Colony's request that we
should move on the request of Mr. Ingersoll. He stated that the
M-1 zoning request was in keeping with the zoning now in that area,
and he put in the form of a motion accepting this property with M-:
zoning and forwarding to City Council same. Mr. Box seconded the
motion and it carried unanimously.
Mr. Gooden addressed the commission on behalf of the Single Tax,
Corporation stating he wished to request B-2 zoning for the Single
Tax Land. It was pointed out that this was a large area of land
to annex as a business district, and in the past the Commission
has voiced an opinion that we did not need this much commercial
property. Mr. Gooden remarked that the Single Tax Corp had held
up on the presentation of this request in order to get all lease-
hold owners to agree to annexation and not present spot zoning
requests and that now one lessee in particular was requesting
action now because of a commitment on a planned development of the
land, that he had been held up because of the amount of time it
had taken to get all leaseholder's compliance with the annexation
requests. Mr. Parker was asked what Don Pruitt's

comments were on the request of the Fairhope Single Tax Corp.
He said that Mr. Pruitt had also commented that this was too muc
commercial property to have at this time, that if we could keep
the eastern end for residential use, that this might be better
planning. Mr. Pitman moved to hold off on any action at this ti
until the request could be given further study.
Mr. Gooden stated again that he wished we could take some action
on this one piece tonight. Mr. Nix asked where the property was
located. Mr. Gooden said it was the property backing the shopping
center from Fairhope Ave. to Morphy containing some 20 acres.
Mr. Nix said since this already joined B-2 zoning that he did no
see where we could not go ahead with the zoning requested at this
time. Dr. Workman stated that he felt that if we went ahead
and granted the request for this property that it would tend to
influence the decision on the rest of the land under consideration
Mr. Nix made a motion recommending to the City Council B-2 zoning
for this 660 by 1320 feet strip(20 acres), Mr. Box seconded
the motion, and the vote was as follows: For -Box, Nix, Kirk,
Parker; Against - Pitman, Workman, Frederick. The motion passel.
At this time Mr. Parker stated that he had asked Mr. Stearns
to furnish him with a copy of the building permits and certificates
of occupancy that had been issued for the prior month. He felt
that by doing this the Building Inspector could be of some help
in co-ordinating with the Planning Commission the construction going
on in the City and the Commission's duty regarding same. Mr. Stearns
agreed to have this information to present a copy at each meet-
ing. It was suggested having a log numbered on file so we could
keep up with cases and the progress.
Mr. Pitman brought to the attention of the commission the change
he had made on the plat he was using in the construction of his
business on Magnolia Ave., and stated that in order to keep the
large trees on the property he had to reverse the drive. He was
informing the Commission so no questions would be forthcoming
in the future. He wished approval for the amended plat, and was
granted same.
Mr. Parker read to the Commission two articles that had recently
appeared in the newspaper which stated concern about the way
Highway 98 from Spanish Fort to Fairhope was being jeopardized
by commercial development. He inquired of the Mayor what had been
the reply received from a letter the Planning Commission and the
Council had jointly sent to the State Highway Dept. in the past.
Mr. Nix replied he had received a verbal reply only on this matter -
After further discussion it was put in the form of a motion by
Mr. Workman to resubmit this letter regarding median crossing,
curb cut policy and strip commercial development and showing
the City Council and the Planning Commission's concern and seek
further information as to what could be done to better control
highway 98 development. The present influx of businesses is
causing an increase of cross-overs under present policy adding to
dangers already existing on this highway. Mr. Box seconded the
motion and it was unanimously carried.
Mr. Nix mentioned that each member should have received a copy
of the Community Appearance Board's comprehensive amendment
to the Zoning Ordinance and that he wished each to study same and
at the March meeting have some suggestions or comments regarding
this.
