FAIRHOPE PLANNING AND Z(X3ING CaMISSION
Minutes for 5-01-78 meeting
The Fairhope Planning and Zoning Commission met in regular session on
Monday, May 1, 1978, at 5:00 p.m., at the City Administration Building
387 Fairhope Avenue, Fairhope, Alabama with Vice-Chainman Leona. Newren
presiding in the absence of Chairman John S. Parker.
The following members were present: Sam E. Box, Harford Field, Dr. Pierce
Fredrick, Jack Kirk, Dr. William Workman.
The following members were absent: Mayor James P. Nix, Cecil Pitman.
Mr. Jack Kirk moved, seconded by Mr. Hartford Field, to approve the
minutes of the April 4, 1978 Meeting. Motion Carried.
The first item to be brought before the Commission was the rezoning
application of Andrew W. and Juanita Hughes, for a change in zone from
R-2 Medium Density Single Family Residential District to B-4 Business and
Professional District for the property identified as Lots 5 and 6, Block
15, Division 4 of the lands of the Fairhope Single Tax Corporation:
situated in Section 17, Tcrv..mship 6 South, Range 2 East: located on Pine
Street approximately 132 feet east of the northeast corner of Bancroft
and Pine Streets.
According to legal description provided, the subject property
comprises two (2) lots which combined are 132 feet square having a total j
lot area of 17,424 square feet. An examination of the existing land use
maps indicates that these lots are occupied by a si*:gle fc--rlly residence.
Across on the south side of the Pine Street the area is zoned B-2 General
Business District but is being used for residential purposes. It appears
that this property is situated behind the Fuqua property which is under
petition for a similar change in zoning.
Ms. Hughes was present to represent her application. Mr. Gene Fuqua
was also present and told the members of the Ummissi.on that the majority
of the property owners within 300 feet were in favor of the rezoning
application and that part of the surrounding property was already used '
for business purposes.
Don Pruitt of the South Alabama Regional Planning Commission stated
that there has been no apparent change in basic land use conditions that
would justify a change in zone and that the Commission should consider.
that the property across the street that is zoned for.conTmrcial use is
being used for residental purposes therefore the requested change seems
to be out of scale. Mr. Pruitt suggested that the Commission consider I
the rezoning of the property of Ms. Hughes, Gene Fuqua and.Irene Pierce
(property discriptions to follow) along with the surrounding area on a '
Comprehensive Basis. With the permission of the said property owners, Sam Box-,
moved, seconded by Dr, Pierce Fredrick, to continue the hearing on the three
submitted applications and advertise for a public hearing on the remaining
areas to be rezoned. Motion carried.
I! The second item to come before the Commission was -the application
of Gene Fuqua for a change in zone from R-2 Meduim Density Single Family
Residential District to B-4 Business and Professional District for the
property described as Lots 3 and 4 of Block 15, Division 4 of the lands
of the Fairhope Single Tax Corporation; situated in Section 17, Township
6 South, Range 2 East; located at the northeast corner of Bancroft and
Pine Streets.
The property under petition consists of two (2)'lots which have
a combined lot area of 17,424 square feet. It is adjacent to the Hughes':
property which is under consideration for an identical change in zone;
therefore land use conditions and zoning which applies to the Hughes'
j property also applies to this petition. This application was included in
Conmission's decision of continuance in the Andrew J and Juanita Hughes
case.

1978 meeting
The next item on the agenda was the pre -application of Eastern Shore
Builders, Inc. for Preliminary Plat approval of an extension to Colonial
Acres; a subdivision of 92 acres into 20 lots; situated in Section 8,
Township 6 South, Range 2 East; located at the north terminus of Bon
Secour Avenue.
This proposal was reviewed by the members at the April 3, 1978 meeting.
At that time it was suggested that additional access be provided to the
proposed subdivision. Mr Byrd Moore was present to represent Eastern
Shore Builders Inc.and presented a copy of a sketch of the proposed
subdivision. It shows the dedication of a street between lots 6 and 7
on the west perimeter of the subdivision. An alternate to this proposal (by Pruitt
was presented showing Bon Secour Avenue being extended in a northerly
directio% thus providing access from the extension of Washington Drive
to the north and Bon Secour Avenue from the south. A road providing
additional access to the abutting property on the west would be optional.
Mr. Moore stated that in his opinion the Bon Secour Extension was undesirable
He stated that after conferring with the majority of the property owners
in the area to be affected, that they too would oppose this extension.
Property onwers present; Mr. Mcgregor, Ms. Boatman and Ms. Clark Taylor
stated that they were opposed to the proposed Bon Secour extension.
Don Pruitt stated that the proposed Bon Secour Extension would allow
axess to the proposed subdivision in case of emergencies.
Alternates to this proposal were discussed with the Commission but
no satisfactory plan was agreed upon. Dr. William Workman requested
a•topo-graphic map to be presented to the Commission at a later date.
Mr Robert Mason presented an application for a building permit to construct
a steel building on the property located on the Southeast corner of
Church and Magnolia Avenue; Part 9 and Part,10. This building meets all the
requirements and restrictions of the Southern Building Code. According to
the Zoning Ordinance of the City of Fairhope a building of 4500 square
feet requires fourteen (14) parking spaces. On the submitted Plot Plan A
three (3) of the fourteen (14) spaces shown are in violation of the Ordinance.
With the City of Fairhope's agreement, Mr Mason will be allowed to use
three (3) of the City's parking spaces in order to meet the regulations.

Motion made by Hartford Field, seconded by Dr. Pierce Fredrick to approve
the site development subject to: (1)elimination of the three (3) parking
spaces off Magnolia Avenue, (2) the stipulation of a 25 foot setback from
Magnolia Avenue K.O.W., &(3) property will be landscaped per ordnance,
Harmon Stearns is to confer with the architect and approve the
building perrut when these provisions are met. Motion carried.
Carlton Niemeyer was present to represent the applications of Olympia
Corte Dyas for zoning changes as follows:
a. R-4 Low Density Multi -Family Residential District and R-1 Low
Density Single Family Residential District to B-4 Business and
Professional District for an aceage parcel situated on the north
side of U.S. Highway 98 Business Route and Baldwin County 11.

b. R-1 Low Density Single Family Residential Development to
R-4 low Density Multi -Family Residental District for an acreage
parcel located on the north side of Alabama Highway 104
approximately 570 feet east of the intersection of Alabama 104,
U.S. Highway 98 Business Route,lSection Street and Baldwin County

c. R-1 Low Density Single Family Residential District to B-1 Local
Shopping District for an acreage parcel flanked by U.S. 98
(4 lane) on the east and U.S. Highway 98 Business Route on the
north.
d. R-1 Low Density Single Family Residential District to B-4
Business and -Professional District for a parcel located on.the
north side of Alabama Highway 104 and running in a westerly
direction for approximately 1,230 feet from the northwest
corner of Alabama Highway 104 and U . S 98 (4 lane)
Dr. William Workman moved, seconded by E. J. Kirk to advertise the said
applications for a public hearing on June 5, 1978. Motion carried.
The next item to cane before the C mi ' sion was the application of Irene
Helen Pierce for a change in zone from R-2 Medium Density Single
Family Residential District to B-4 Business and Professional District
,;for the property identified as Lot 2, Block 15, Division 4, of the lands
of the Fairhope Single Tax Corporation; located on Bancroft Street
between Oak and Pine Streets. This application was included -Vrith the
Commission's decision of continuance in the Andrew J. and Juanita
Hughes case.
The CTmission'determined that a letter was received from the State Highway
Department concerning the City of Fairhope's letter on control of Median
Crossings on Hwy. 98 (Spanish Fort to Fairhope) and is recorded in the record
book.
Mr. B.W. Milling Jr. was present to discuss the erosion on his property
at the northeast corner of Myrtle and Olive Street cause by the development
of Greenwood Park Subdivision to his north. Mr Milling stated that he
could not confirm with the involved party whether or not there were any
specific plans to correct this problem. Phil Rutherford, representing
the City of Fairhope and Byrd Moore, representing Eastern Shore Builders,
the developExs,produced a blueprint which was submitted and approved in
1973 by the Commission. These plans called for a concrete flume to be
installed to correct the erosion drainage problem. Mr. Milling requested
that the Camission re-evaluate the plan to determine if this type of
flume would handle the amount of water draining and to consider the
safety factor.
Don Pruitt stated that Mr Milling did not need to address the Commission
because the Commission could not re -open a case that has been approved.
The Commission suggested that Mr. Milling discuss the issue with the
City Council.
Ack Moore, engineer for the Pines Subdivision requested that the Commission
record a correction on the Pines Subdivision Plat to read;
W.D.M.- partnership instead of W.D.M. Corporation
A Commission Study session was set for Thurday, May 18, 1978, 7:00 p,m.
at the Fire Hall in Fairhope.
