FAIRHOPE PLANNING AND ZONING COMMISSION
Minutes for March 6, 1978
The Fairhope Planning and Zoning Commission met in
regular session on Monday, March 6, 1978, at 5:00 P.M.,
at the City Administration Building, 387 Fairhope Avenue
Fairhope Alabama with Chairman John S. Parker presiding.
The following members were present: Sam E. Box, Harford
Field, Dr. Pierce Fredrick, Jack Kirk, Leona Newman, Cecil
Pitman and Dr. Bill Workman.
Members absent: Mayor James P. Nix.
Mr. Jack Kirk moved, seconded by Dr. Pierce Fredrick to
approve the minutes of the February 13, 1978 meeting as
recorded. Motion carried.
The first item brought before the Commission was the
application of Mannich Realty, agent for Ms. Alma Britton
for a change in zone from R-1 Low Density Single Family
Residential District to B-2 General Business District for
the property identified as Lots 1 through 3, Britton Sub-
division; situated in the NWT of Section 16, Township 6
South, Range 2 East; located at the 'southeast corner of
Greeno Road and Gayfer Street.
Spokespersons for the Britton application was Lorena
Gregorius.of Mannich Realty and Dale Crittenden. They
stated that the proposed plans for the property was for an
office building and mortgage company, with one portion of
the property to be a life estate for Ms. Britton.
South Alabama Regional Planning Consultant Don Pruitt
said that he felt the application was inconsistent with the
City's Comprehensive Plan and that there was no'reason to
rezone this property since there was other property which
is already zoned for this purpose.
Ms. Gregorius said that the property owner could not
get the value out of the lots for residential purposes.
Commission members said that prior to advertising for
a public hearing the applicant submit an appropriate legal
description of the property. i
The application was held over until the April 3, 1978
meeting in order to advertise the rezoning request and hold
the public hearing.
Chairman Parker explained the procedures now being follow-
ed on rezoning applications by the Commission. Mr. Parker
said that a rezoning application will first come to the
Commission prior to advertising and a public hearing in order
to give Commission members an opportunity to check and be
sure the application is in order. The next regular meeting
of the Commission the public hearing and recommendation to
the City Council on the rezoning application will be made.

The next item brought before the Commission was the
application of Moore Engineering.,agent for WDM Corporation,
for Final Plat approval of a resurvey and subdivision of
Lots 10,11 and 15, Unit 1 and Lots 16, 17, 19 Unit 2
and correcting the dimensions of Lots 1, 5 through 8 and
12 Unit 1 of the Pines Subdivision: situated in Section
37, Township 6 South, Range 2 East; located adjacent to
and generally east of Greenwood Park Subdivision.The resurvey
involved correcting lot dimensions and sizes for the above
described Lots.The corrections were necessary because of
errors and due to the fact that Lots 15 and 16 of the Pines
( formerly lots in Oakwood Subdivision ) have been improved
with single family dwellings. The fences installed by the
owners of these lots encroach on other lots in the Pines
Subdivision, and the purpose of the application was to correc
the above situations.
Mr. Cecil Pitman moved, seconded by Mr. Jack Kirk to
accept the replat and grant Final Plat Approval subject to
the posting of the required bond or completion of the
improvements of the Plat. Motion carried.
The next item brought before the Commission was the
Application of Moore Engineering, agent for Mr. Chester
Billie, for Preliminary Plat Approval of a resubdivision
of the First Addition to Colonial Acres, a resurvey and
subdivision of seven (7) lots into seven (7) lots; situated
in Section 8, Township 6 South, Range 2 East, located south
on Washington Drive.
Mr. Ack Moore was present to represent the application,
and told Commission members that Mr. Billie wanted to re -
subdivide in order to make a simpler street which Mr. Moore
said he felt would solve some of the drainage problems.
The application was held over until the April 3, 1978
meeting of the Commission in order for the property owners
to be notified. The property owners were not notified since
the plans were hand delivered to South Alabaina Planning
Commission and the names and addresses of adjacent property
owners was not brought into the City in order for the proper
owners to be notified prior to the meeting.
The next item to come before the Commission was the
request as presented by Mr. Ack Moore to change the name
of Georgetown Park on the North Side of Parker Road by
Rosemont Nursing Home to Sibley Square and the street to
Sibley Circle.
Mr. Cecil Pitman moved, seconded by Dr. Pierce Fredrick
to approve changing the name from Georgetown subdivision to
Sibley Square subdivision and approve changing the streetyto
Sibley Circle. Motion carried. -ntmg-

The next item to come before the Commission was the
preliminary discussion on a building permit for Mr. Mulcahey.
Mr. William Labon Richmond was present to represent Mr. Mulcah
and stated that he had come to seek the Commissior�; guidance
regarding plans for a building permit to expand the existing
building located on North Section Street beyond the Fairhope
High School, the property consisting of four (4) lots with a
vacant building, presently zoned B-1. ( Old Godard property ).
Mr. Richmond said that the proposed plans consist of
expanding the existing building for Restaurant facilities and
to provide parking on the empty area north of the building.
Mr. Richmond said that the driveway area entrance and exit
would be located over the crest of the hill, and said that
the entrance would be placed where the light is located north
of the crestQ'ba° 160 feet.
Mr. Richmond said that the applicant plans to submit his
application for a building permit at the April 3, 1978 meeting
of the Commission.
Chairman Parker told members of the -Commission of a
letter received from Mr. Jack Cummings expressing appreciation
to the Commission for their help on the apartment dwellings at
St. James and Summit Street.
Chairman Parker also informed members of the Commission of
a letter he received from Mr. Clarence McCoy, Chairman of the
Board of Adjustments and Appeals regarding a recommendation
that "section 60.41 of the City of Fairhope Zoning Ordinance No.
557 be clarified in regards to the erection of signs. This
recommendation was taken under advisement in order for Com-
mission members to study and decide whether or not this section
should be clarified in regards to signs.
Councilman Jack A. Stipes came before the Commission to
discuss drainage requirements by the Commission on new streets
put into subdivisions. Mr. Stipes said that he would like for
the Commission to scrutinize the drainage plans and see that
City Superintendent Phil Rutherford gets a set of the plans
so that he can look them over and make sure that everything is
in order.
Chairman Parker said that there was a check list for the
City to follow before accepting applications on subdividing or
rezoning. Mr. Parker said that this check list should be follo -
ed in order to assure that all points are being met before any
applications are accepted. Mr. Parker said that he felt a
training session with the City's staff would prove beneficial
in seeing that all points are being met before applications are
accepted.
Mr. Harford Field said that he felt if Mr. Stearns, Build-
ing Inspector, as soon as he receives a subdivision application
with drawings would turn them over to City Superintendent Phil
Rutherford in time for Mr. Rutherford to review and send his
statement to Mr. Don Pruitt at South Alabama Regional Planning
Commission, it would help to insure that all applications are
in order before they are presented to the Commission.
Mr. Byrd Moore came before the Commission for an informal
discussion on =;--Wand
half ( 92 ) acre tract of land at
the corner of Highway 104. Mr. Moore said that
he does not want the landpif developed.,to come in Bon Secour
but rather come off Washington Drive and continue Colonial
Acres as it is now. Mr. Moore said this property is zoned R-2.
Mr. Don Pruitt of South Alabama Regional Planning Commissi
said that he felt there needed to be another access rather

than Washington Drive for fire fighting and safety considera-
tions and further stated that it should fit in with the over-
all road development and plans.
Chairman Parker said that he wanted to make Commission
members aware of the interim Community Appearance Board
appointed by the City for the purpose of preserving the
attractiveness of the City and urged all interested members
to call.
Mr. Harford Field reviewed Ordinance No. 608, an Ordinanc
to amend the City of Fairhope Ordinance No. 557, by amending
Section 4.2 thru 4.6. Mr. Field noted that there were several
typographical errors and word ommissions and clarified them
for publication after final adoption.
There being no further business on a motion duly made,
seconded and carried, the meeting adjourned.
