FAIRHOPE PLANNING AND ZONING COMMISSION
MINUTES FOR MEETING 2-13-78
The Fairhope Planning and Zoning Commission met in regular
session on Monday, February 13, 1978, at 5:00 P.M., at the
City Administration Building, 387 Fairhope Avenue, Fairhope,
Alabama, with Chairman John S. Parker rpesiding.
The following members were present: Sam Box, Harford Field,
Dr. Pierce Fredrick, Jack Kirk, Cecil Pitman, and Dr. William
Workman.
The following members were absent: Mayor James P. Nix, Mrs.
Leona Newman.
Dr. Pierce Fredrick moved, seconded by Harford Field to appro-;
the minutes of the January 9th, 1978 meeting. Motion carried.
The First item borught before the Commission was the continued
application of Mr. Amos Wagner for a change in zone from R-4
High Density Dwelling Residential. District to B-4 Business
and Professional Offices District for the property identified
as the east 250 feet of the Amos Wagner leasehold and located
on the west _.i.Ae_,of Greeno Road, 300 feet north of Fairhope
AvenerL-'.fh.e area under c_o; "!deration consists of an acreage
parcel containing 1.85 acres more or less. The two (2)
existing structures on the premises would be remodeled.
Mr. Carlton Niemeyer was present at the meeting to represent
Mr. Wagner's application. Mr. Niemeyer stated that there woul
be one (1) single acees in the middle of the property.
Mr. Don Pruitt Planning Consultant from South Alabama Regional
Planning Commission stated that this particular piece of
property was discussed as length during the Comprehensive
Planning in 1974 and 1975 and said that he felt the rezoning o
this property would be inconsistent with the Comprehensive
Plan and also there was considerable property zoned for this
specific purpose.
Chairman Parker stated that Mr. Wagner had asked guidance in
this matter and was told that this area had been debated at
length during the Comprehensive Planning. Mr. Parker further
stated that the Fairhope Single Tax Corporation desired to be
consistent with the City of Fairhope's zoning.
Mr. Don Palamore of Edwards Avenue was present at the meeting
and asked if the property was rezoned from R-4 to B-4 would
multi -family housing still be allowed.
After a discussion, Chairman Parker called for a show of hands
of property owners within three hundred .feet of the Wagner
property who were in favor of the re -zoning. The vote showed
five (5) in favor and none opposed. Mr. Parker than asked for
a show of hands of all property owners who reside in the City
Limits but not within three hundred feet of the property who
were in favor of the re -zoning. The vote showed two (2) in
favor of the rezoning and twelve (12) opposed.
Mr. Carlton Niemeyer asked that the minutes show that he
cited Paragraph 7.52 of the City of Fairhope Zoning Ordinance.
Dr. William Workman moved, seconded by Sam E. Box for the
application of Amos Wagner to be recommended for denial to the
City Council for rezoning. Upon being put to vote the follow-
ing vote was .recorded: AYES: Sam Box, Harford Field,Dr. Pier
Fredrick "!r. William Workman and Jack Kirk. NAYES: Cecil
Pitmen. —otion carried.

The next item brought before the Commission was the applicatic
of Mr. Elliott Powe for preliminary plat approval of a resubdivisic
of Lots 5,6,7, and 8, Hoyle-Worchester Addition to Fairhope, Alabar.
a .resurvey and subdivision of four (4) lots into five (5) lots;
located on the north side of Middle Street approximately 220 feet
west of the northwest corner of Ingleside Avenue and Middle Street.
Mr. Ack Moore was present to represent the application. Mr. Don
Pruitt of South Alabama Regional Planning Commission said that
the area on Lots 1, 2, and 3, were subject to standing water
and that this would have to be corrected before Final Plat Approva
Commission members discussed the drainage problem, and recommended
shading a defined area on the Plat with a twenty (20) ft. easement
restricted area for water course.
Dr. Pierce Fredrick moved to approve subdivision subject to
designation on Plat of a twenty (20) foot wide drainage easement
subject to approval of Jack Kirk. Sam Box seconded the motion.
Motion carried.
Mr. Ack Moore came before the Commission regarding the Parker Road
Georgetown subdivision of Commercial Park. Mr. Moore stated that
the developer has decided to change Commercial. Park from Commercia
to Residential development. Mr. Moore told Commission members
that he has received verbal approval. from Mr. Zaynor of the Health
Department for the subdivision.
Mrs. Carolyn Alsop adjacent property owner_ was present at the
,meeting and told Commission members that the drainage of the
idevelopment has caused property damage to the property owners in
the area. Mr. Ack Moore said that the developer understands that
damage to property due.to construction would be his responsibility
Mr. John Edgars adjacent property owner told members of the
Commission that when the developer cut down the trees to put in
the pipe they raised the lot causing a drainage problem on his
property. 1
Mr. Sam Box moved, seconded by Jack Kirk, to grant Preliminary
Plat Approval of the subdivision subject to the engineer and owner
'reporting back to the Commission on the steps being taken to insur
adequate drainage on the north side of the property. Motion
carried.
The next item brought before the Commission was the application
of Chateau Royale, LTD., for approval of a building permit for.
an addition to Chateau Royale Apartments. Mr. L. Tracy Girdler
,told Commission members that he would need a ten ft. variance
Ion the east end of the rear yard in order to maintain a park like
larea and preserve the tree in the area.
Mr. Harford Field moved, seconded by Sam E. Box, to approve the
application for a building permit for Chateau Royale Apartments,
subject to a variance of ten feet being granted by the Board of
Adjustments and Appeals and subject to the results of the inves-
tigation of Mr. Jack Kirk for a drainage easement on the south
;Iside of the property. Motion carried.
V. I The amendments to Section 1101.1 of the subdivision regulations
was held over until the March 6, 1978 meeting of the Commission.

Mr. William Labon Richmond came before the Commission about
the area on North Section Street by the High School to the
Better Burger,which is zoned B-1. Mr. Richmond asked if a
food service is allowed in a B-1 zone. Mr. Richmond said that
the property he had in mind was located on the west side of
Section Street north of Gayfer Court.
Mr. Harford Field moved, seconded by Dr. Pierce Fredrick
to approve a restaurant being allowed in B-1 zoning as being
inferred in the Zoning Ordinance. Motion carried.
There being no further business on a motion duly made, seconded
and carried, the meeting adjourned.
