HomeMy WebLinkAbout12-05-1977 Regular MeetingI 0 II FAIRHOPE PLANNING AND 7.01ING CCHMISSION MINUTES FOR DEC. 5TIf, 1977 The Fairhope Planning and Zoning Commission net in regular session on Monday, December 5th, 1977, at 5:00 P.M., at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama with Chairman John S. Parker presiding. The following members were present: Mr. Sam E. Box, Dr. Pierce Fredricks, Mx. Harford Field, Mr. Jack Kirk 11rs. Leona Newman and Dr. William Workman. Members absent: Mayor Nix and Cecil Pitman. Mr. Clarence McCoy attended as a liaison repr. for the Adjustment Board. The minutes of the November 11, 1977 meeting were approved. The first item brought before the Commission was the rezoning application of residents within the Rosa Acres Subdivision for a change in zone from R-3 to R-2 for the purpose of restricting to single family residences the Rosa Acres Subdivision. Mr. Glean Gilbert,property owner and resident of Rosa Acres,was the spokesperson for the application. Mr. Gilbert stated that the purpose of the rezoning request was to restrict Rosa Acres to single family residences without duplexes. Members of the Commission reviewed the case with the property owners. Mr. Parker stated that when Unit I of Rosa Acres was rezoned Mr. Moore was to present a letter of commitment restricting to duplexes. Unit II of Rosa Acres which 4ras rezoned in February of 1977- to R 3 was restricted to single family or duplexes. The question at hand was whether or not the rezoning of unit I specified single family residences or single family residences and duplexes." Mr. Parker told the applicants that R-3 allows up to four units in a building and the developer had restricted himself to two units in a building. Mr. Harford Field moved, seconded by Mrs. Leona Neuman to ,'recommend denial of the rezoning application to the City Council for changing the zone of Rosa Acres Subdivision from R 3 to R-2 stating that the developer has done as he so stated by restricting the development to duplexes with two units to a structure and has not done anything in conflict with that agreement with the city. Motion carried unanimously. The next item brought before the Commission was the rezoning application of Paul D. Strickland for a change in zone from an R-1 Low -Density Single Family Residential District to R 4 High Density Dwelling Residential District for the property identified as the Northeast corner of Summit Street and St. James Street, containing .92 acres more or less. The applicant desired a change in zone in order to construct apartments containing a total of fourteen (14) units. Mr. Jack Cmmings, Developer, was present to represent the application. After Commission members reviewed the proposed plans for the apartments , Dr. Pierce Fredrick moved, seconded by Mr. Harford Field to recommend approval of the application to the City Council for rezoning as per Plan Alt. " A " revised December 5th, 1977. upon being put to vote the following vote was recorded: AYES: Sam Box, Dr. Fredrick, Harford Field, Jack F.irk, Dr. William Workman. NAPES: Mrs. Leona Newman. Motion carried. t ! lr. Jack Cummings said that with the City of Fairhope's permission he would 4 i like to build a sidewalk along Summit Street according to City specifications �i for safety pruposes. I III. Mr. Carlton Niemeyer's application for plat approval of certain properties f of the Fairhope Single Tax Corporation situated in Section 11 ,Township 6 ' South, Range 2 East; located on the north side of Gayfer Street extension east of Belforest Road. Mr. Niemeyer was requesting subdividing of five (5) acres into two (2) lots. Mr. Niemeyer was present to represent the applica- tion. Mrs. Ruth Rockwell of the Fairhope Single Tax Corporation was present jas the Single Tax representative for the application. Commission members j discussed the road right-of-way with Mrs. Rockwell regarding the Colony's reserve strip for future right-of-way. \ ' Mr. Jack Kirk moved, seconded by Dr. Pierce Fredrick, _for.approval of the two lot subdivision for Carlton Niemeyer , with the understanding that + the Colony will reserve for future .right-of-way the 660 foot strip along the entire east edge of Parcel " B ". Upon being put to vote the following vote was recorded. AYES: Sam Box, D-. Fredrick, Harford Field, Jack Kirk, Dr. Workman. NAYES: Mrs. Leona iye4anan. Motion carried. +- IV. V. 1. VI. VII airhope Planning and Zoning Commission Minutes for Dec. 5th, 1977 meeting Pale No. 2^ _ _ _ Chairman Parker asked Dr. William Workman to study the policy of the Fairhope Single Tax Corporation regarding. reserving road right-of-way for future use, and come up with a policy for the Planning Commission regarding this practice. The application of Mr. Carson Rockett for a two (2) lot subdivision for Seaview Subdivision, a subdivision of 1.45 acres more or less, into two (2) lots of .73 acres more or less each, located outside the corporate limits on Seacliff Drive. The subdivision fronts on an improved paved street and is served by the City of Fairhope crater system. Mr. Ack Moore, of Moore Engineering, was present to represent the applica- tion. Mr. Moore said that he did have approval from the health department on septic tanks. Mrs. Leona Newman moved to grant preliminary and final plat approval of the Rockett Subdivision application subject to approval from the health department with the subdivider submitting the necessary documentation reflecting that septic systems are an acceptable method of sewage disposal. Mr. Harford Field seconded the motion. Motion carried. The next item brought before the Commission was the application of Mr. Cheste Billie for Preliminary and Final Plat approval of the First Addition to Colonial Acres; a subdivision of 4.37 acres more or less into four'(4) Lots; situated in Section 8, Township 6 South, Range 2 East; located south of Washington Drive on the west side of the extension of. Colonial Drive South. Mr. Claude Arnold was present to represent_ the application.' Mr. Arnold discussed the drainage with the.Commission members. Mr. , A.rnold presented a construction drawing which was looked over by Commission members. South Alabama Regional Planning Consultant Jeff Blood said that the engineering will accomodate the drainage if constructed as per the proposed plans. Mr. Arnold stated that one of the factors was the outflow from the drainage coming from the football field. Mr. Arnold told members of the Commission that there was no way to maintain the seven percent grade and that, he could get the street grade no less than ten percent. 1 1 Mr. Harford Field moved, seconded by Dr. Pierce Fredrick to grant preliminary and final plat approval in accordance with the design presented at,the meet ing, subject to posting a performance bond or completion of installation of the improvements. Motion carried. : Mr. Sam E. Box moved, seconded by Dr. William Workman for the Plat of the first addition to Colonial Acres to show the ponding area in red on the Plat. Motion carried. I , The next item brought before the Commission rras the application of'W.D.M.; It owner, for Preliminary and Final Plat Approval of the Pines'Subdivision: a subdivision of 20.53 acres more or less, into 46 lots; situated in Section 37, Township 6 South, Range 2 East, located adjacent to and generally east of Greenwood Park Subdivision. The Fairhope Planning Commission gxanted this proposal Preliminary Plat approval subject to a seven (7) percent grade being met. Mr. Ack Moore of Moore Engineering was present to represent the application. Mr. Moore stated that they had met a 7.36 percent grade coming down the hill. Commission rrembers discussed the street that the subdivision v-ill tie into, and recommended that no thru street be made to Patlynn but rather the subdivision should be prepared to tie into Greenwood. Mr. Jack IUrk moved, seconded by Harford Field, to accept the staff recommen- dation that the applicant's engineer has submitted a redesign of the slope gradients that approach the seven percent grade requirements, and grant Preliminary and Final Plat Approval of the Pines subdivision in accordance with the presented drawing, rbtion carried unanimously. Councilman Sam E. Box told Commission members that the Council has requested that anytime an engineer working on a project that presents a conflict of interest the Planning Board should adopt a policy whereby another engineer is required for the inspection as well as the design. Ii . Pox stated that he felt it was important for the Commission to adopt a written policy to address both inspection and desio..-:7hen there may be a_possible conflict of interest. Consultant Blood agreed to develop such a volicv.statement .__ for consideration by the Commission. There being no further business on a motion duly made, seconded and carried the meeting adjourned at 8:35 P.M.
