FAIRHOPE PLP_14NING AND ZONING COMMISSION ,Minutes or meeting 0- -77 The Fairhope Planning and Zoning Commission met in regular session on Monday, October 3, 1977, at 5:00 P.M., at the Citv Administration Building, 387 Fairhope Avenue, Fairhope, Alabama with Chairman John S. Parker presiding. The following members were present: E.J. Kirk, Mayor James P. Nix, Leona Newman, Cecil Pitman. Members absent: Henry Bishop, Harford Field and Dr. Fredric] James P. Nix moved, seconded by E.J. Kirk to approve the minutes of the September 12, 1977 meeting. Motion carried. Chairman Parker announced to Commission members that Mr. Henry G. Bishop, was the new City Council representative on the Plan- ning Commission replacing Mr. Sam E. Box. Mr. Parker told Commission members that Mr. Chester Billie's term has expired and that Mr. Billie did not elect to return for another term. Mayor Nix is presently considering a new member to replace 1?r. Billie. Mr. William Labon Richmond was present at the meeting and asked Commission members how members were elected to the Com- mission, how long they served and how the Chairman was determined Mr. Parker told Mr. Richmond that appointments to the Planning Board were made by the Mayor, and that no qualifications were outlined in the State Laws. Mr. Parker stated that members were appointed for a six -year term, and that the Chairman, Vice -Chair- man and Secretary of the Commission were elected by the Commissio members in November of each year for a one year term. Mr. Greg McDonald asked Mayor Nix what qualifications he looked for in appointing members to the Commission. Mavor Nix said that there were no requirements that they be a resident of the City of Fairhope and that he looked for people who were will- ing to serve on the Board, people that had Fairhope's overall best interests at heart and people who were knowledgable of Plan- ning. Mr. Byrd Moore asked the Commission members their opinion on rezoning of property on Middle Street from R.-2 to R-4 Multi - Family Dwellings. Commission members told Mr. Moore to proceed with formal application for rezoning and stated that the rezoning would be handled in the same manner as all other rezoning applica tions. The next item brought before the Commission was a discussion on a proposed subdivision by Mr. Carlton Niemever affecting certain properties of the Fairhope Single Tax'Corporation situat ed in Section 11, Township 6 South, Range 2 East, located on the north side of Gayfer Street Extension east of Belforest Road. This proposal was reviewed by Commission members at the Septem- ber 12, 1977 meeting. The subdivision consists of dividing an acreage parcel containing five (5) acres more or less into two(2) parcels of 2.4 acres each. Proposed Parcel " B " would have access via a street designated on the plat (30') Reservation for future right-of-way development. "1 Mrs. Ruth Rockwell was present at the meeting to represent the Fairhope Single Tax Corporation. After a discussion regarding the compliance with the provisi of the subdivision regulations, the Commission members decided to study further and see if they could come up with an acceptable plan regarding Fairhope Single Tax Corporation subdivisions uhere a 30' reservation for future right-of-way development is noted. I= V Fairhope Planning and Zoning Commission Minutes for meeting October 3, 1977 Page No. 2 Chairman Parker told Commission members of the actions taken t the September 12, 1977 meeting of the Fairhope City Council egarding the issuance of a building permit to Attorneys -at -Law aylor, Benton and Irby. Mr Parker told members that the ntention of the regulation was to insure a certain standard of ire safety, and that the provision in the Fire Ordinance states hat a building permit in Fire -zone # 1 must be issued by the ity Council. Mr. Parker said that the City Council moved and assed to refer the building permit to the Planning Commission or their action. Mr. Parker told members of the Commission that special meeting had been held to act upon a building permit or Taylor -Benton & Irby. ( See enclosed minutes of Special Meetin Mayor James P. Nix recommended that the Ordinance be amended o allow the Planning Commission to act upon building permits .for 11 commercial buildings, regardless of the Fire District. VI. Commission members discussed amendments to Section 6.94 Special Requirements, of the City of Fairhope Zoning Ordinance These amendments shall become a part of these minutes. Commission members did not take action at this time in order to give all members an opportunity to review the amendments. VII Member Cecil Pitman asked Mr. William Labon Richmond if he would like to study the proposed amendments to the Zoning Ordinance and give some in -put at the next meeting of the Commission. VIII Chairman Parker asked members of the Commission if they felt they should communicate with the State Highway Department and the County Commission regarding the preservation of throughfares. Mr: Parker said that Highway 98 is a lifeline to Fairhope and that the ay things were going center median cross-overs would be an obvious jeopardy to the City of Fairhope causing a strangulation of throughfare features of Highway 98. Mr. Parker stated that there were eleven (11) lots on the west side of Parker Road south ,to Fly Creek that were going to be developed and center median cross-overs would be a jeopardy to the safety of Highway 98 in its throughfare functions. Commission members felt that they should pursue the situation by communicating with the State Highway Department and the County Commission, voicing_ the opinion of the Commission by way of a Resolution. chairman Jo n-S'.
