The Fairhope Planning and Zoning Commission met in regular
session on Monday, September 12, 1977, at 5:00 P.M., at the Citv
Administration Building, 387 Fairhope Avenue, Fairhope, Alabama,
with the folloeing members present: Chairman John S. Parker,
Members : Sam E. Box, Harford Field, Dr. Pierce Fredric:, Jack
Kirk, Leona Newman, Mayor Nix, and Cecil Pitman.
Mr. Harford Field moved, seconded by Mr. Sam F. Box, to approve
the minutes of the August 1, 1977 meeting. Motion carried.
The first item brought before the Commission was the public
hearing on the petition for annexation adn zone change of Mr.
Robert S. Berglin. Mr,_-Berglin was present to represent his
petition. Mr. Berg 1inrequested annexation into the City limits
approximately 30 Acres -south of Big Head Gulley, and also request-
ed that the adjacent R-5 zone be changed to R-3. The prupose of
the annexation request was for developing single family develop-
ments upon lots meeting R-3 zone requirements.
There were no adjacent property owners present at the meeting
to object the annexation request.
Mr. Berglin also requested annexation into the city limits
at a B-1 zone a five (5) acre tract on the west side of South
Section Street opposite the City Landfill area..
Mr. Cecil Pitman Moved, seconded by Mr. Sam E. Box for the
Planning Commission to recommend to the City Council the annexa-
tion of Mr. Berglins approximate 30 acres south of the big head.

Mr. Cecil Pitman moved,.seconded by Mr. Harford Field to -
recommend to the City Council the annexation of the five acre
tract as petitioned by Mr. Robert S. Berglin as B-1, since it
would be an excellent buffer between the existing M-1 and R-3
district and recommended that rezoning of the existing R-5 area to R-3.
Motion carried.
The next item brought before the Commission was the subdivi-
sion application of Constantine and Juanita Syzmbroski for Pre-
liminary Plat approval of a resurvey and subdivision of Lots 7 &
8, Block 12, Magnolia Beach Addition to the Citv of Fairhope;
located at the northwest corner of Pecan and Kumquat Streets.
Mrs. Dot Yeager, of Wilson and Yeager Real Estate was present
at the meeting to represent the application on behalf of the
Syzmbroski's.
Mrs. Yeager told members of the Commission that the purpose
of this resurvey was to have Lots 7 & 8 subdivided to create two
lots that will front Kumquat Street instead of Pecan Street.
Mayor James P�. Nix recommended that Lot 8 include the exist-
ing house whereby Lot 8 cannot be developed further.
Chairman John S. Parker moved, seconded by Mr. Sam E. Box,
to grant preliminary approval of the Syzmbroski subdivision applic;
tion with Lot 8 to include the house on it with no further develop
ments to be made on Lot 8. Motion carried.
The next item brought before the Commission was the applica-
tion of Robert and Beverly Potter for Preliminary and Final
Plat approval of Linn Ridge Subdivision, Unit 3, a resubdivision
of lots 22-31 ( inclusive ) of Unit Two. The subdivision is
situated in Section 12,, Township 6 south, Range 2 east and is
located near Alabama Highway 104 approximately three and a half mi
east of the Fairhope Corporate limits.
Mr. Ack Moore of Moore Engineering, was present to represent
the Potter's application.
Mr. Moore told Commission members that this subdivision was
previously approved by the Planning Commission on November 1, 1976
Unit Two. Mn. Moore stated that the resubdivision Unit Three
design allows for a wider -right-of-way for Linn Ridge Drive due tc

unfavorable road base material in its original location. The
new right-of-way reduced the overall size of some lots from the
original design.
Mr. Jeff Blood�of the South Alabama Regional Planning
Commission remarked that Unit Two included the area shown as
Unit Three and that,it meets the approval of the Baldwin County
Planning Commission; the Baldwin County Health Department and th
Alabama State Highway Department.
Mayor James P. Nix moved, seconded by Mr. Cecil Pitman to
grant Preliminary and Final Plat approval to Linn- Ridge Sub-
division , Unit Three, subject to the prior Performance Bond
that was posted by the Potter's being continued. Motion carried

The next item brought before the Commission was the applica7;
Lion of 0. Wesley Stapleton for Preliminary Plat approval of
First addition to Colonial Acres Part Two; a subdivision o" fn-iL
(4) acres more or less into (3) Lots. ; situated in Sectic
Township 6 south, Range 2 East; located off the proposed sot:i rri
extension of Colonial Drive on the proposed Valley Forge Drive
cul-de-sac.
Mr. 0. Wesley Stapleton was present to represent the applica-
tion.
Mr. Stapleton stated that he was seeking the guidance of the
Planning Commission before proceeding with the development and 1
said that he was seeking only Preliminary approval at this time.
Mr. Cecil Pitman moved, seconded by Dr. Fredrick to grant
Preliminary Plat Approval of the first addition to Colonial Acrel
Part Two; with a detailed utility layout showing the size and
location of the proposed water lines being provided as well as !�
a layout of proposed site drainage plans to be tendered before
Final Plat approval is granted. Motion carried.
The next item brought before the Commission was the applica'
tion of Edgar F. Sullivan for the Fairhope Single Tax Corporation.
for Preliminary Plat approval of Ingleside Unit. Three subdivision
a subdivision of 1 70 acres more or less into three lots, situate
in Section 17, Township 6 South Range 2 East located on the
Western side of Greeno Road on or near the intersection of FairhiF
Avenue ( Lots 1 and 3 ) and on northern side of Fairhope Avenue,'
approximately 118 feet west of the Fairhope Avenue-Greeno Road
intersection ( lot 2 ).
Mr. Claude Arnold was present to represent the Sullivan
application. '
Mayor James P. Nix :roved, seconded by Leona Newman to grant
Preliminary and Final Plat approval of Ingleside Unit Three for'
a resubdivision of Lot into three (3) Lots creating Lots twL (2)1
and three (3). Motion carried.
The next item brought before the Commission was the applica-
tion for a building permit by Edgar R. Sullivan on Lot Two (2)
of the re -subdivided Ingleside Unit Three subdivision. The
purpose of the building permit is to erect an E-Z Pik Grocery
Store to be located on the northern side of Fairhope Avenue,
approximately 287 feet west of Greeno Road.
Mr. Harford Field moved, seconded by Dr. Fredrick to grant
a building permit to E-Z Pik, Inc. by Edgar R. Sullivan subject
to the Building Inspector's review for compliance with the
applicable building, electrical, and plumbing codes and ordinanc(

Mayor James P. Nix moved, seconded by Cecil Pitman to recomme
to the City Council the payment of a bill from the City of Boulder
Colorado in the amount of $ 21.62 for a copy of their land use
regulations and sign code. Motion carried.
The next item brought before the Commission was the petition
�for annexation of Mr. Jack Pope for three and a half acres (32)
on the north side of Nelson Road , east of the Junior Food Store,
!land the Square Rigger Restaurant and Antique Shop. This three and
la half (3k) acres is the only contiguous point on the north edge
,adjacent to the south edge of Paddock Estates. Mr. Pope has
,requested the annexation into the City limits at an R-3 Zone,
iMulti-Family Housing Development. i
Several property owners from the area were present to object '
the annexation of this property, stating that they did not want
apartments built in this area.
Mr. Sam E. Box moved, seconded by Mayor Nix, that the Plannind,
Commission recommend the annexation of the Pope property to the i.
City Council as R-3 subject to the restriction that it be single
!family dwellings, and also recommend that the Council hold a
public hearing before annexation with proper notification to each
,property owner in the area. Upon being put to vote the following i
vote was recorded: AYES: Sam Box, Dr. Fredrick, Jack Kirk, Leona,
Newman, Mayor Nix and Cecil Pitman.
NAYES: Harford Field.
iMotion carried.
Chairman Parker told Commission members that Mr. Les Boone has
seven acres of land contiguous to Mr. Robert S. Berglin's property
which was recommended for annexation and told members that Mr.
'Boone was agreeable to annexation as B-1 providing, that he can
(continue with his present land use.
Mr. Harford Field moved, seconded by Mrs. Leona Newman to
(accept Mr. Boones property for annexation as B-1 with continued
land use ( grandfather clause ) as it is at the present time if
!Mr. Boone desires annexation. Motion carried.
Mr. Carlton Niemeyer came before the Commission for a prelimir a
discussion on a proposed subdivision of five (5) acres. into two (2)
parcels east of Belforest Road. It was recommended to Mr. Niemeyer
that he turn his plans over to the South Alabama Regional Planningi
Consultants for their recommendations. !
There being no further business, on a motion duly made, seconded a
carried, the meeting adjourned at 7:00 P.M.
