THE FAIRHOPE PLANNING AND ZONING COMMISSION
Minutes for meeting August 1, 1977
The Fairhope Planning and Zoning Commission met in regular
session on Monday August 1, 1977, at 5:00 P.M., at the City
Administration Building, 387 Fairhope Avenue, Fairhope, Alabama,
with the following members present:
Chairman: John S. Parker
Members: Sam E. Box; Chester Billie; Harford Field, Dr. Pierce
Fredrick; Leona Newman, Mayor James P. Nix; Cecil
Pitman, and Planning Consultant Don Pruitt.
Members absent: Pir. E.J. Kirk
The first item brought before the Commission was the subdivision
application of Haver # 1 Subdivision; a subdivision of 2.0
acres more or less into four (4) lots; situated in Section 19,
Township 6 south, Range 2 east; located on the north side of
East Pecan Avenue approximately 450 feet east of the intersectio
of Church Street and East Pecan Avenue.
South Alabama Regional Planning Consultant Don Pruitt stated
that he felt the 12 inch water line would be large enough to
provide adequate service to the four (4) lots.
Mr. Pruitt recommended that the Commission stipulate in conjunc-
tion with subdivision plat approval increased sewer and water
lines or that lots 3 and 4 be served from Pecan and that the
Commission waive the right-of-way requirements and accept a
40 foot right-of-way for the 160 foot length that meets the
diameter on the cul-de-sac.
Mayor James P. Nix moved, seconded by Leona Newman to grant
Preliminary and Final Plat approval to Haver # 1 subdivision,
subject to the following conditions:
1. Bond being posted for the necessary improvements.
2. Sewer and water connections be provided off of Pecan
Street for Lot 3 and 4.
3. That further subject to the Final Plat drawing be in
accord with the requirements.
Motion carried.
The next item brought before the Commission was the application
of Mary K. Gail, leaseholder, for Final Plat approval of a
subdivision of acreage into two (2) Lots.
The property is situated in Section 15, Township 6 south, range
2 east; located outside the corporate limits at the northeast
corner of Oberg Road and Fairhope Avenue.
Mr. Tod Gail and Mrs. Ruth Rockwell of the Fairhope Single Tax
Corporation were present to represent the application .
Mayor James P. Nix moved, seconded by Dr. Pierce Fredrick for
Final Plat Approval subject to assigning a tract number to the
proposed two (2) tract subdivision. Motion carried.

Fairhope Planning Commission
The next item brought before the Commission was the application
of Constantine and Juanita E. Szymbroski for Preliminary Plat
approval of resurvey and subdivision of Lots 7 and 8 and
the north 100 feet of Lot 9, Block 12, Magnolia Beach Addition
to the City of Fairhope; located at the northwest corner of
Pecan and Kumquat Streets. The applicant desired the resurvey
in order to have lots 7 and 8 and the north part of Lot 9 sub-
divided to create two (2) lots that will front Kumquat Street
instead of Pecan Street.
Mrs. Dot Yeager of Century 21 was present to represent the
Application of the Szymbroski's.
The Commission recommended that the applicant go to the two (2)
lot approach and also submit a drawing to outline the chosen
alternative of the proposed lots, and submit another application
to the Commission once these clarifications are made.
The next item brought before the Commission was the Final Plat
approval of Mr. and Mrs. Walter Anacker, of a subdivision of
the east one-half of the SE 4 of the NE4 of Section 14, Township
6 South, Range 2 East, land of the Fairhope Single Tax Corpora-
tion, located three (3) miles outside the corporate limits on th
north side of Baldwin County Highway 48.
This application was brought before the Commission at the April
4, 1977 meeting with final plat approval subject to all lots in
the proposed subdivision being assigned an identifying number
or letter. Mayor James P. Nix moved, seconded by Sam E. Box,
to grant final plat approval since the applicant has complied
with the request to assign identifying numbers on the final plat
Motion carried.
The next item brought before the Commission was the application
for a building permit for the Eastern Shore Medical Center.
Marshall Fischrupp, Dr. Fred Diegman and Mr. Skipper Tonsmire
were present at the meeting to represent the application.
Mr. Harford Field stated that he had reviewed the plans and
suggested the following wording on exhibit B and C of the plans:
B. Landscaped strip to have at least one tree for
each 50 feet and evergreen shrubs such as
camellia or holly, or both, planted at random
so as to provide a visual screen between the
parking areas and Morphy Avenue.
C. Landscaped strip to have at least one tree at
random locations every 50 feet with clusters of
shrubs according to accepted practice in attracti
landscaping.
Marshall Fischrupp and Dr. Diegmann stated that they had no
objections to changing the wording as recommended by Mr. Field
on exhibit's b and C.

Chairman Parker urged the developer to offer interruptions
on the parking surfaces to avoid having long expanses of
asphalt by allowing landscaping to go out in row of parking.
Cecil Pitman moved, seconded by Mayor James P. Nix, to approve
the issuance of a building permit to the Eastern Shore Medical
Clinic, on the first three units as introduced by the exihibits,
with the changes as recommended by Harford Field and accepted
by Mr. Fischrupp, on exhibits " B " and " C ". Motion carried.
The next item brought before the Commission was the Petition for
annexation by Jack E. Pope. Mr. Pope was present on behalf of
his petition. Per. Pope stated that he wished the following
described property to be annexed as R-3:
From the half section corner of the west line of
Sectionl9, Township 6 south, range 2 east, run south
398 feet to a point, thence run east 347 feet to a point
thence run n. 89-01-09E, 36.03 feet to a point, thence
run N 88-55-36E, 631.33 feet to an iron pipe on the nort]
margin of Nelson Drive for the POINT OF BEGINNING; thence
run N01-17-48W, 342.75 feet to an iron pipe, thence run
south 84-20-28E, 39.35 feet to an iron pipe, thence run
south 84-17-45E, 473.87 feet to an iron pipe on the west
right-of-way of a 20 foot lane, thence run S06-29-53W,
along said right-of-way, 284.97 feet to an iron pipe on
the north margin of said drive, thence run 588-58-02 W,
along said drive, 433.03 feet to an iron pipe, thence
run S88-55-36W, along said drive 43.7 feet to the
POINT OF BEGINNING, Containing 3.55 acres.
Mr. Pope told members of the Commission that he felt requesting
annexation as'R-3 would be contiguous to the existing property.
Chairman Parker told Mr. Pope that all new land was annexed as
R-1 unless recommended by the Planning Commission to be annexed
at another zone. Mr. Pope said he desired anne-ation as R-3 in
order to construct rental apartments.
Mayor Nix stated that he would rather have a public hearing on
annexing Mr. -Pope's property as R-3 in order to see how the
other property owners in the area felt about the R-3 zone.
Cecil Pitman moved, seconded by Leona Newman to advertise for
a public hearing stating that the request has been received for
annexing Mr. Pope's property and it was being considered for
annexation at an R-3 zone. Motion carried.
Mr. William Richmond came before the Commission to discuss off-
street parking in Fairhope, and stated that he felt many of the
new buildings in Fairhope did not comply with the zoning
ordinance.
Mr, Matt Dial came before the Commission to ask their opinion
on Article 201.32 of the subdivision regulations regarding
subdividing of land within a five mile radius of the City Limits
Mr. Dial stated that he wanted to divide land into parcels
containing five or more acres each and asked if it would be
necessary to apply to the Commission. Mr. Pruitt said that the
property could be divided by a metes and bounds description and
that it would not be necessary to make application to the
Commission since the lots would be fronting on an existing road.

The minutes of the July llth, 1977 meeting were approved as
written.
Commission members discussed the urgent need for a qualified
Building Inspector who would be familiar with the Southern
Building Code and attend all meetings of the Planning Commission
Mrs. Leona Newman was appointed to go before the City Council
and inform them of the Commissions request that the City
obtain a qualified building inspector as soon as possible.
There being no further business on a motion duly made, seconded,
and carried, the meeting adjourned.
