THE FAIRHOPE PLANNING AND ZONING COMMISSION
Minutes for meeting July llth, 1977
The Fairhope Planning and Zoning, Commission met in regular
session on Monday, July llth, 1977, at 5:00 P.M., at the City
Administration Building, 387 Fairhope Avenue, Fairhope, Alabama
with the following members present:
Chairman John S. Parker
Vice -Chairman: Leona Newman
Members: Sam E. Box, Chester Billie, Harford Field,
Dr. Pierce Fredricks, Jack Kirk,Mayor Nix,
Cecil Pitman.
The minutes of the June 6th, 1977 meeting were approved as
recorded.
Councilman Jack A. Stipes came before the Commission to get
their recommendations on an Ordinance which he is proposing
regarding procedure on street improvements in new subdivisions.
The Commission recommended that Mr. Stipes get with the City's
Engineer and base the Ordinance on a period of two (2) years for
improvements with a Performance Bond.
The rezoning application of Callie and Virginia Andreades
was the next item to come before the Commission. The Andreades
application was for a change in zone from R-2 Medium Densitv
Single Family Residential District to B-4 Business and Profes-
sional District, for the property identified as Lots 24 and 25,
Block 15, Volanta Subdivision located on the north side of Grand
Avenue, approximately 100 feet east of the northeast corner of
Section Street and Grand Avenue.
Mr. Ack Moore of Moore Engineering was present to represent
the Andreades application.
No specific development was proposed at this time on the
Application.
Mr. Sam E. Box moved, seconded by Mayor James P. Nix, to
recommend to the City Council that the Andreades application for
rezoning be denied. Motion carried unanimously.
The Application of Moore Engineering; agent for East -of -the -
Sun Development Corporation, for a change in zone from R-3
Limited Multi -Family Residential to R-4 High Density Residential
District was the next item brought before the Commission.
The property under consideration is described as Lot 16,
East -of -the -Sun Subdivision; situated in the southeast corner of
the City Limits, located on Eastgate Drive, between Autumn and
Spring Drives.
James P. Nix moved, seconded by Harford Field to recommend
to the City Council that they grant rezoning from R-3 Limited
Multi -Family Residential District to R-4 High Density Residential
District to East -of -the -Sun Development Corporation providing:
l.� The City can secure the necessary easement along
the west side of Lot 16 for a sewer line construc
ion.
2. That the Engineer make sure that adequate drain-
age is provided.
Motion carried.
The Application of Calvin and Elaine Hanson for Preliminary
and Final Plat Approval of the Hanson Subdivision was the next
item brought before the Commission. The Hanson subdivision is
a subdivision of an acreage parcel containing 19.54+acres into
two (2) lots. This property is situated in the NE 3 of the SW�;
of Section 11, Township 6 South, Range 2 East; located one -fours'
mile north of Gayfer Street Extension approximately one-half mill
east of Belforest Road ( Baldwin County No. 27 ).

Mrs. Ruth Rockwell of the Fairhope Single Tax Corporation,
was present to represent the Hanson Application.
Mr. Sam E. Box moved, seconded by Mr. Cecil Pitman that
approval of the Hanson Subdivision be granted providing:
1., That fifty a (50)foot plat of land be shown
on the Plat as a road right-of-way, and be
held as a right-of-way.
2. That the street be named.
Motion carried.
The Application of Hawn Incorporated for Final Plat
Approval of Fairwood No., 20; a subdivision of 7.32 acres
more or less into 21 Lots; situated in Section 17, Tovmship
6 south, Range 2 east, within the City of Fairhope; located
generally east of Fairwood Blvd. on Ronforth and Kurlane
Streets.
Mr. Ack Moore of Moore Engineering was present to represen
the application on behlaf of Hawn Incorporated.
Mayor James P. Nix moved, seconded by John S. Parker, that
Final Plat Approval be granted subject to the following
conditions:
1. Eliminating the wording~Preliminary Layout from
the Final Plat.
2. Assigning a Lot number to each Lot in the propos-
ed subdivision.
3. The developer posting a surety bond or installing
the required improvements prior to the Final Plat
being signed by the Secretary of the Commission.
Motion carried.
The application of the Fairhope Single Tax Corporation for
Final Plat Approval of the Brown Tract Subdivision was the
next item brought before the Commission.
This is an acreage containing 1.98 acres more or less into
two (2) 'Lots; situated in Section 22, Township 6 South, Range 2
east; located outside the corporate limits approximately 314
feet north of1the northwest corner of Baldwin County Highway
No. 44 and an unnamed country road.
Mrs. Ruth Rockwell of the Fairhope Single Tax Corporation
was present to represent the application and informed members
of the Commission that a letter of approval from the Baldwin
County HealthlDepartment for the installation of an individual
water supply and sewage disposal system for each lot had been
received.
John S. Parker moved, seconded by Sam E. Box to grant
Final Plat Approval to the Fairhope Single Tax Corporation for
the Brown Tract Subdivision. Motion carried.
The application for a building permit for First Federal
Savings and Loan was the next item brought before the Commissi
Mr. Marshall Fischrupp of Dietz, Prince & Fischrupp,
Architects was present to represent First Federal Savings app-
lication.

The Commission discussed the proposed plans for a building
permit for First Federal Savings at length, regarding the side
yard requirements as stated in Article IV, Section 2,74, sub-
section 4.753 (b) (2); of the Fairhope Zoning Ordinance, that
each lot shall have a minimum side yard of ten (10) feet, and
Article VI, Special Provisions, Section 6.94, subsection 6.942
setback line of five (5) feet from the common property line or
lines when a parking lot is adjacent to property in a residen-
tial district. The drainage plans and the five (5) foot plant-
ing area were discussed,
Chairman John S. Parker moved, seconded by Mr. Cecil Pi
to grant a building permit to First Southern Federal Branch,
providing:
1. The building is built according to the 8k x'l1 drawin,
submitted at 7/11/77 meeting amending the prior drawin .
2. They develop the west edge planter strip and 'drainage
as sketched by Mr. Filed.
3. That the east property line of this parcel of land is
set back at the"apparent right-of-way as described on
the drawing to insure unaltered drainage of adjacent property
north and east, and to establish an adequate greenery barrier.
Motion carried.
The next item brought before the Commission was the applicatic
of Dr. Fred F. Diegman and Dr. Richard A. Roh for a building
permit. After a discussion regarding the incompletion of the
plans as presented to the Commission, Mrs. Leona Newman moved,
seconded by John Parker that the Commission hold a special
meeting to hear the application of Dr.'s Diegman and Roh for
a building permit once they have all of their plans completed
and acceptable for Mr. Pruitt's review. Motion carried.
There being no further business, on a motion duly made, second
ed and carried, the meeting adjourned at 6:55 P.M.
