THE FAIRHOPE PLANNING AND ZONING COMMISSION
Minutes for meeting June 6, 1977
The Fairhope Planning and Zoning Commission met in regular
session on Monday, June 6, 1977, at the City Administration
Building, 387 Fairhope Avenue, Fairhope, Alabama, at 5:00 P.M.,
with Chairman John S. Parker presiding.
The following members were present: Mr. Chester Billie, Mr. Sam
E. Box, Mr. Harford Field, Dr. Pierce Fredricks, Mr. Jack Kirk,
and Mayor James P. Nix. Also present, Mr. Don Pruitt, Consultant
from South Alabama Regional Planning Commission.
Members absent: Mrs. Leona Newman and Mr. Cecil Pitman.
Mayor James P. Nix moved, seconded by 11r, Jack Kirk, to approve
the minutes of the May 2, 1977 meeting. Motion carried.
The first item brought before the Commission was the applica-
tion of Alma E. Britton, owner, for Final Plat Approval of
Br_i.t.ton SUbdlyisiOn; a subdivision of acreage into two (2) Lots.
This property is situated in the NW4 of the NGI4 of Section 16,
Township 6 South, Range 2 East; located at the southeast corner
of Gayfer Street and Greeno Road. Mrs. Dot Marshall of Mannich
Realty was present to represent the application. Mrs. Marshall
gave a letter to the Commission from the Baldwin County Health
Department which stated that the property will require two (2)
feet of fill in an area 100 feet square before a septic tank can
be installed.
Mayor James P. Nix moved to grant Final Plat Approval to
the Alma E. Britton Subdivision subject to the County Health
requirement of fill being met. Mr. Chester Billie seconded the
motion. Motion carried.
Mr. Ack Moore came before the Commission for an informal
discussion on the rezoning of the area known as East of the
Sun from R73 to R-4 in order to meet the requirements of the
Zoning Ordinance regarding the number of units per acre.
Commission members said that they didn't feel there would be any
problem in rezoning since Mr. Forsman owned all of the surround-
ing property.
The next item brought before the Commission was a discussion
on the Eastern Shore Art Center's need for a variance because of
the proximity of the expanded Art Center to Section Street road
right-of-way. Member Harford Field questioned the need for a
variance because he felt the Art Center was in compliance with
the set back restrictions of the R-2 zone.
Mr. Don Pruitt stated that he felt it did not meet the
requirements of the Zoning Ordinance and that the only way to
handle the situation was for the Art Center to apply for a
variance,
Members of the Commission discussed whether the Art Center
would be considered a private or public building.
Mayor James P. Nix moved, seconded by Harford Field to grant
a building permit to the Eastern Shore Art Center based on the
following:
1. The building meets the set back requirements for a
residence in an R-2 zone.
2. The building meets the set back requirements for a
business in an R-2 zone.

Dear Mayor Nix:
Inquiry was made to this office concerning the width of right of way along
Greeno Road, more particularly in the area of the intersection with Coleman
Avenue.
At the time of surveying for the subject project, extensive research was
done in the probate records of Baldwin County as to the width of right of
way possession by _this Department. Our records indicate that the width is
80 feet or 40 feet on each side of the existing roadway. A sketch is at-
tached reflecting the subject findings.
